      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I'm new to this and at the moment am just contemplating pursuing a claim for my bank charges.

 

I was just wondering if any of you that made a claim have had your account closed by HSBC. I have a savings account and a personal loan with HSBC but I am worried if I pursue a claim with them for charges on my current account they will close my savings account and my loan too.

 

Any help/advice will be much appreciated.

It would be unusual for them to close it on the first claim so should be ok and you dont need luck just determination. GOOD LUCK ANYWAY

After reading all of the information and advice on here I've decided to go ahead and make a claim. I'm claiming for £820, not a huge amount, but on principle and the fact it's my money!

 

I'm going to be sending the prelimnary letter today, as I managed to get my statements online. The other thing I'm not sure about is the bit about manual intervention. I don't actually understand what that is/means :oops: Could someone shed some light for me please. At the moment I have left that section out of my letter but I'd rather put it in if I need it.

Hi Natalie and welcome

 

£820 is a significant amount - and as you say, especially when it is legally yours.

 

Manual Intervention - the banks are only allowed to charge for services that require a member of bank staff to actually be required to personally take time to work on your account - for example when you are charged for a direct debit not being paid, the bank needs to prove that a member of staff actually had to do something - which of course they do not as everything is automated.

 

You must put this section back as it is a critical part of the argument on which the ruling has been made that allows us to reclaim these unlawful charges.

I've amended my letter to include the part about manual intervention now, thanks for explaining what it meant.

 

This forum is fantastic, I know I would be completely lost without all this help. I've already told all of my friends and family about it!

How would you go about rewording the template if the bank actually did reply to your first letter, saying they dont agree. The template says "I'm disappointed you havent replied to my letter...."

 

Sorry if this was answered elsewhere. I did try searching.

I am completely lost! :sad:

 

I am filling out the moneyclaim online but I have a feeling I am not working out the interest correctly. The spreadsheet is not working it out for me, it just says value on it. So I tried to work it out by hand but I think I may be doing myself out of money. Is the 8% just a standard 8% of the value or does the date of the charge affect the amount?? i.e I was calculating the interest for £100 charges in Oct 05 as just £8. Is this right?

 

Sorry for asking dumb questions. I've looked everwhere on here and can't find an answer.

If you sent your lba on the 6 Sep giving them 14 days to respond why are you waiting until Friday to File? Even allowing a couple of days for posting you can still file now, unless I am missing something.

 

I sent m lba on 7 Sep and have already filed.
