    • Hi there,  Long story short, I was working a year ago in a city centre and the site operator I was working with told me I could park in a private car park as they had an arrangement with the owner. I came back to a parking charge  from UK Parking Control, and the site operator subsequently couldn't get hold of the private car park owner and haven't been able to since. Fast forward to today, I have received multiple legal threats from DCB Legal acting for UK Parking Control I have now been issued with a court hearing along with a date. I have to file my witness statement for a court hearing later this summer.  I realise that I could have handled the situation better and am already aware of that. I was wondering what my options are at this stage? I am very keen to avoid a CCJ as it would obviously be disastrous for my credit score. Any advice appreciated. My current plan is to file a witness statement and hope the case is discontinued. Thank you for any advice in advance.
    • I run a small retail business selling cards & gifts ( all my sales are done on a face - face basis  ) & noticed one of the settlement amounts on the card terminal bank deposits was short so contacted the card company which said a customer has requested a chargeback on a sale the reason saying the goods bought was not fit for the purpose purchased for. I have old fashion till which does not show any sales or descriptions of what is bought, plus when the settlement statements match up i shred the sale receipts. The card company told me the transaction was paid for with the customers phone & shows on my portal. They have asked me for sales prof, cctv, terminal receipt of the transaction which I have none, as this was done a few weeks later. I have asked for pictures to prove the items are not fit for the purpose purchased for plus said if the customer can return them i would give them a full refund but have had nothing back plus no pictures. Also I have had no communication with the customer even asking me for a full refund. They have now closed the case & awarded the customer the full refund. Any advice would much be appreciated

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Received a letter from Kensington 11/8 in response to my SAR asking me to clarify what info I needed and if agreed to only receiving some of the information they wouldn't charge me for it. Very generous of them. Sent same day response to the effect that I want everything and they now only have 37 days left (as of yesterday).

A while since last posted on this thread so missed a few bits. Had 3 letters from Kensington advising me they were taking more time to respond to my prelim letter. Sent Lba at correct time. Now filed N1 which was considered served today. Let them take liberties with that.

Doesn't look as though they have a standard procedure yet does it?

Hi Zoot,

 

They are applying for a strike out on basis that it's not a penalty because I was allowed to terminate early. Pretty much along the lines of Jarmorgan. They have only asked for the strike out in relation to the ERC not the charges (I rolled it into one claim).

 

The case management conference is 45 mins and the court will consider :-

 

1) appropriate track

 

2) time estimate

 

3) the need for expert evidence when the defendant says this is an accurate pre estimate

 

4) directions generally

 

5) striking out the claim in respect of the early redemtion fee

Ok the claim is as follows :-

Erc £8,068.49

Charges £270

Stautory interest £1,286.80 at time of claim.

 

They have not asked for evidence or witness statements

 

I sent a letter with the AQ, which said:

 

With reference to the above claim, I have recevied the defence from the defendant and feel this is not complete in that the calculations requires to prove the costs of the purported breach of contract are not included within the defence.

 

In your indulgence, I would respectfully ask, Sir, that you order disclosure of the calculaitons which justify the charges in question, that the defendant may intend to use to defend the claim.

 

I understand that this is within your discretion to do so.

 

I beleive such an order would bring a rapid end to this litigation.

Paras 12 13 and 15 simply reiterate the case law we are already relying on.

 

In light of recent events regarding the ERCs it would be wise for you to perhaps make an offer to Kensington to drop the ERC claim on condition they payout the charges.

I have now pulled the claim. Originally they wanted thier full costs to date. After advice from Zoot I went back and told them I was withdrawing the ERC claim but not the charges. They then called back and offered to agrre no costs if I withdraw the entire claim. As the charges were only £200 ish I accepted. I would advise anyone to withdraw now. The consequences can be frightening. this could include as was threatend a charge on your property to cover the legal costs which could result in you losing your home.
