    • I decided on confrontation - which I hate.  Omg the arrogance of the driver.  They refused to say who had given them the alleged permission to park on the private land - unless I proved ownership.  I couldn't believe they could be so objectionable.   They advised they couldn't take public transport to work as they lived too far away.  They couldn't rent a local garage as none were available. I simply said that's their issue not mine. It was infuriating that this person had such misplaced entitlement.  However I decided to humour them and show them the title deeds.   They couldn't respond.  Although at this point they alleged some guy in a city up north - whose name they couldn't remember - gave permission!!    They then asked if they could buy the garages and land!! Yet can't afford to park on a meter !! They seemed to back down and agree to now park elsewhere.  I hope so. 
    • I've worked out the contractor invoiced apx 250k - Without adding vat to the invoices.  So based on above he should have added vat to all invoices once he reached 85k?  Obviously he had to pay his labourers - would those payments get taken off what he received?  Or it doesn't matter cos he invoiced for the high sum?
    • Greetings, I'm writing to seek assistance with an ongoing issue I'm having with Manchester Council.  I parked my car in a residential area behind Wilmslow Road to go purchase some food, not realizing it was a no-parking zone. I later received a letter stating I had failed to make the required payment, and the penalty had increased. I appealed the fine, explaining that I had parked there but never received the original Penalty Charge Notice (PCN), so I was unaware of the need to pay. However, the council's reply did not address my initial concern. Is there anything I can do in this situation? I admit to parking there, and I was willing to pay the original fine, but I don't think it's fair for them to demand a doubled amount when they failed to send me the initial PCN.  Any advice or guidance you can provide would be greatly appreciated.     • If you look at some of the other debt related threads will see that one of the first things which will be asked will be for you to list out your debts in a brief chronological order, including date of debt, amount, creditor, amount outstanding, defaulted – yes/no – date of default, date of last payment made, have you acknowledged the debt at all to the creditors. That lot at least. I expect that my colleague @dx100uk will be along but will meet to know at least that information
    • Hi, I have found this group very helpful hence I am here seeking help and advice.   I got myself into a situation where I have now more than £50k in unsecured debts (personal loans & credit cards) and things are now getting out of control as I am struggling to make payments. This is purely my own created situation and I am taking 100% responsibility for it. I am keen to get out of this situation as soon as possible hence I would appreciate any help and advice in this process. I am employed at the moment and don’t want to risk going into IVA or bankruptcy as this would risk losing my job. Being sole bread earner of my family, I cannot afford to lose my job. I have been trying to keep up with the payments so far and had few missed payments instances until 3/4 months ago but got caught up with missed payments somehow using my savings. All my debts are still with original lenders. However I know I am getting into same situation again shortly and won’t be able to get out of it again. I have started exploring Debt Management Plan (DMP) option through StepChange but haven’t submitted it yet. Based on budgeting, I have around £820 available to make payments to all lenders after taking care of all other essential expenses. This is definitely lot more affordable than what I am currently paying to different lenders. 1. Is DMP right option for me in current situation? 2. what are the negative consequences of availing DMP? 3. is there something else that I can do to get out of this situation?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all,

 

I originally submitted my SAR to egg back in January this year.

Well today they have finally managed to send me the statements that i was requesting !!!! It's only taken then 9 months!!

 

Anyway i've been preparing a spreadsheet as i want to re claim the CRP (credit card repayment protector) that they added on without my say so!

 

I've added it up and it comes to over £800!! and if i add contractual interest on it jumps to over £2200!!!!

 

The only thing is the charges date back to 2002.

 

Will they rule anything out that is over 6 years old?

 

Also seeing as Egg were fined for mis-selling of insurance, does anyone know if this will make it easier to re-claim back??

hi livis firstly good luck, egg may not be as easy as you think to crack have a look n the egg section to see how others are faring it seems that many people are taking egg to the fos as they dont seem to be playing ball despite the hefty fine (which was for telephone sales) the fos have just made their decision with my case against egg in my favour however im still waiting for the cheque :rolleyes:

I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

Hello all,

I have today recieved a reply back from egg, basically telling me the PPI was not mis-sold as i selected it on an online application.

 

They have enclosed screen prints, although the screen print with the Payment Protection box on it was not sent to me with the Subject Access Request docs i previously recieved.

 

Also they have written on their notepads that they do not have the copies of the original application.

 

I also have a pre-existing medical conditon, which i informed them off in my initial letter.

 

Please can someone help me with how to respond to them.

Well, you must know that Egg do not roll over that easily!

 

Correct me if I am wrong but I understood that your concerns relate to pre-existing conditions and the Egg exclusion clauses. Your PPI purchase was a non informed purchase of PPI, you were not covered for pre-existing conditions, thus your policy would have been mis-sold.

If it were me, then I would want to have sight of the alleged credit agreement, together with the Terms & Conditions applicable at the time of entering into said agreement.

Also, I would want to have sight of the inception PPI policy, terms of that policy and;

the underwriting sheet or other documents containing any commission payments received: commissions received on every policy sold by EGG.

 

Egg need to be brought to account re: the mis-selling of their far too expensive Payment Protection product...Humpty Dumpty will again fall off the wall...

 

If Egg will not provide a copy of the executed agreement and any other document referred to in it under your SAR, then make a section 77/78 CCA Request.

Egg will have 12+2 days to comply.

Thanks AC for looking in on this for me, i sent them a CCA request also back in January, and they haven't sent me anything at all for it.

It was only when i read their notes that they had made that i saw that they wrote they couldn't locate my cca.

So i think my next step should be to put in a complaint to the FOS :rolleyes:

Hello all,

I've put this letter together, i just wondered if someone could have a look for me and see what they think.

Is it worth sending this to Egg or should i put a claim in to the FOS straight away ?

 

I am writing in response to your letter dated 28th October 2009, with regards the insurance sold with the above numbered credit card.

 

I do not feel your letter has offered a satisfactory justification that my policy was sold fairly, reasonably and within my best interests so I request that you look into my complaint again.

 

I have already informed you that I had a pre-existing medical condition at the time this policy was added to the account, and therefore on that basis I deem this policy to be mis-sold.

 

I would like you to specify if the Insurance was a pre selected tick box or was it one that I the customer had to opt for as I do not agree that I requested the insurance to be added.

 

I am also requesting again that you send me a copy of the credit agreement together with the terms and conditions applicable at the time of entering into this agreement.

 

Please be aware that I have seen your notes made saying that you cannot locate the agreement, if this is the case please can you confirm that in writing to me.

 

Also I request you to send me the terms and conditions of the Credit Card Repayment Protection Policy that was applicable at the time of inception.

 

If I do not receive a more favorable response within 14 days I shall be pursing my claim for repayment through the court system.

 

I enclose a schedule of charges that I am claiming along with this letter.

Your letter is fine, however, I would consider including the following:

 

The small print wasn't explained to me, including any exclusions to the policy:

I wasn't told about any alternative products or cheaper products.

 

I believe that it would be worthwhile to have another go at Egg, remind them that they have already been fined by the FSA.

 

And yes, you are entitled to a copy of the alleged credit agreement.

Hello all,

 

need to update ....

egg finally sent me the cca for this account, despite writing all over their notes that they cannot locate the cca???

Anyway, it's the usual egg CCA with the approved limit wording.

 

I wrote back disputing the account on this basis and i'm attaching their reply below.

 

I can't see why they are saying they don't know anything about my payment protection insurance complaint as i have a letter from them about it ????

 

That's now been passed to the FOS to look at.

 

Can anyone help me with a reply letter to send back to them please?
