    • Thanks dx for your guide. Yes, I will use their services, but not often. I usually spend around 80 per month, but the season ticket price is 160. I plan to renew it as long it could help me to show that I will not do it again.

You will note  that I have included the Solicitor's Regulation Authority into our conversation in order to ensure your reply. And your old excuse of "admin. error" is surely wearing a bit thin even with the SRA. so I look forward to an apology for your error and a declaration that you will desist from trying to hoodwink other motorists in future.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Must admit my friend had a lot of success with this company but they never got charged for any phone calls either way so things must have changed with them. Has anyone checked out their website looks like its been altered.

My friend did get quite a sum written off and still has a couple to go. My friend was happy with the service received. I can't pass any personal judgement on them as I'm not on one of their plans I can only tell you what my friend said.

Noticed hell-yeah post saying they are not regulated, they are, on the website there is a consumer number and a ministry of justice number so they could be inspected at any time.

I got their website up at [MOD EDIT - NO COMMERCIAL LINKS PLEASE!]

Anyone who has any debt and is not paying a creditor will have a lousy credit rating

Go for it. I can only say my friends have found its working for them. I suppose its only like the CCCS saying they will get interest and charges stopped for me, they haven't on some of my debts the only difference is they don't charge me for it also they don't actually do anything for me except take my money every month and pass it on to the creditors. I still get the phone calls and nasty letters and have to call the creditors and write to them myself. I even had the claim form from one of my creditors and they just told me fill it in, acknowledge you owe the debt and sign it. if I'd done that and not found this site at the time I would probably have a ccj against me.

Sounds like you've had a rough time with them and looks like you've thought long and hard about it.

Have you not had anything written off as they call it.

My friends have done alright so far with them but I don't know them as I've not dealt with myself.

Seems like some peoplee do alright and others like yourself have a bad time of it.

Keep us posted as to what your solicitor says. Remember not too much personal details about yourself.

Exactly the same agreement as my friends. They told me the reference at the top is your reference with them so I would suggest your remove it quick otherwise they will be prepared for you.

Did you miss any payments to FSF the way I understand it is if you don't pay them or you don't pay them on time they will not make any payment to any creditor.

 

My friends had to wait a while with a utility company till they sent the invoice that FSF had requested as they needed the proof that they actually owed it to the utility company so I suppose a few weeks could pass in that respect before the payment started to be made.

 

Suprised by the charges, don't you get any information as to how many call and to who. How many update calls did you get. What was the courier charge for?

 

As I said before I don't have first hand knowledge of FSF but my friends seem to be happy with them.

They have nearly 30k and it is looking like they are about to have one for 9k+ written off due to defective agreement.

 

I do hope you get your problem with them sorted to your satisfaction, but do keep us all posted.

My friends who are with them say its actually a credit licence they have that is mind to revoke and as they do not loan money they actually dont need that licence the one they need is the ministry of justice one. Dont know how right that is tho but Im sure that Lord_Tiger will know if thats right or not.

Hi efc

 

Ask them if your account now has a credit balance in your pot you will probably find out that it hasnt got one remember they take fees out every month out of what you pay to them. It does take sometime for your pot to start having an actual credit balance. My friends have now cancelled with them. Rumour has it that they are not doing any full and final settlements with creditors at the moment unless they have already begun negotiations with them. I am now helping my friends sort things out with the remaining creditors that they owe money to. We have asked the creditors how much money have they been paid by fsf and we have asked them to provide a statement which all the remaining creditors have agreed to provide. The majority of my friends creditors are easy to deal with and are polite when they have asked for the information.

 

You can do everything fsf are supposed to be doing for yourself and for free and there is plenty of support on this forum to help get you started.

Funny that Bill Waring doing his act he was supposed to have left fsf before redundancies were made - gone back - how strange. Make loads of people redundant and then take staff one - just so strange. Dont believe for one minute that they didnt want to rub the noses of those made redundant in it thats not how they work. Just another call centre now like the rest they are only running the company to line their own pockets.

Hi PCB

 

My friends have cancelled with FSF. We've gone direct to the creditors they still have debts with and have agreed payments with them with a guarantee from the creditors in writing that they will not add any charges or interest as long as they keep up with the agreed payments so my friends are much happier now. FSF are dragging their heels in sorting the cancellation out but thats no suprise to anyone.

 

Not heard of Debt Settlers but its certainly worth checking around to see if anyone has anything to say about them but I say once bitten twice shy and I'd be careful of going into a contact with anyone if it was me.

Conflict of interest its called. Don't know what the OFT and FOS would say although I doubt if it is in their names.

They can give you the information its all on the computer they can't delete it.

Hi all

 

not been on for the forum for a while, ill health, work and now I have a grandson.

 

FSF do not destroy your details, the only things they destroy are the debt collector letters

that is when they tell you to send them in which is not very often.

 

They cannot destroy your information and when they tell you they have they are lying.

 

They have paper files as well as the details which they have on their pc's.

 

They are also well known for treating their staff the same way they treat their clients.

 

If they are going it can't be anything but good for all.

 

My friends are still in debt thanks to FSF up I managed to get the creditors to agree to payments from them.

 

Joining FSF was the worst thing they ever did.

 

I do hope that all goes well for all concerned who are trying to get money back from them.

Hi well done PCB. Glad you got it sorted before the previous employees took it over. So many people have paid so much over the years that company started and still find themselves in a mess because of them.

Debt Help and Advise aka First Step Finance and other associated companies have finally gone into Administration all staff have lost their jobs. Dont pay any more money to any of them and make sure your d/d, s/o etc are cancelled as no money will go to any creditor

It appears that they have oft it to Spain. Looks like none of the staff are going to get a penny either. Im sure that all the bosses involved will have made sure they have money in the bank thats the type of people they are.

I agree, they have ruined so many lives. As with most of these type of people they squirrel the money away and presto they get on a plane and get lost. Her hubby has been bankrupt before and I understand everything is in her name so its possible she could end up going the same way, money probably in the kids or family name so nobody can get it

Bluestone Claims of Stockport I believe is also part of this disgraceful lot.

They were also talking about FSF and the rest on Moneybox on Radio 4 this lunch time.

Administrators said they have a lot to go through re the trading of FSF and the rest.

The whole family should be they are all involved in it one way or another, sisters, aunts, uncles, sons and daughters and the others who just changed the name are as bad as they knew exactly what was going on
