    • This is what I have said in my email of complaint:   On 29th November 2023 I took out a loan of £5000 with you. Unfortunately very early into 2024 I have found myself in financial difficulty and I contacted you on 13th February 2024 asking if there was any way I could extend the length of my loan to 36 months and I fully explained why I was requesting this and asked for your help. I again contacted you on 7th March 2024 to advise you of a change in my circumstances which resulted in me having to take out a DMP and asking you to confirm that the direct debit had been cancelled. You would have also received confirmation of this DMP from StepChange but you did not acknowledge receipt of my email.  I have now therefore fallen behind on several of my debts, yours included, and as a result you have lodged a Cifas marker against my name for "evasion of payment", which has resulted in me having to change banks, which has been an extremely difficult process because of the Cifas marker. I do not feel you have been fair or given me the opportunity to fully explain my situation to you before you lodged the marker against my name.  I cannot stress to you enough how much this has affected my mental health. I am having trouble sleeping and my existing health condition has been exacerbated by all of this.  What I would like you to do is to please remove the Cifas marker and let me make arrangements to pay the loan back through a DMP. If you fail to resolve my complaint within 8 weeks, or if matters are not settled to my satisfaction, I will have no alternative but to refer my complaint to the Financial Ombudsman Service.     • Right... Misuse of Facility is a Cat 6 and is considered the worst out of all of the CIFAS Categories for CIFAS Markers.  However lets see what happens when MCB come back to you. Make sure you refer it to the CEO.    IF YOU DONT HAVE A VALID REASON FOR THE ISSUE WITH PAYMENTS ETC - Then the marker will stay.

I can prove that I had to buy a new washing machine, I have my pay slips showing the emergency tax code and a letter from the tax office after I had spoken with them to get it corrected and of course I can get a copy of my vet bill. And all of this was in the first 2-3 months of 2024.  I panicked. Stupid I know and as you say, I have learned the hard way and I am not in any way denying anything that I have done wrong, but it just feels a bit unfair.  It is what it is I guess and if I have to have it on me forever then so be it. I am just so worried about the bank situation 😕

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi i went through a company last year for another ppi, roughly owing me 2240.00 i did,nt think i could do this on my own.

 

So went through a company in March 2008 and at this moment, they have done nothing to resolve the matter, now in fact they has passed me over to a solicitors and having to fill out all the paperwork i did last year, so looks like i am back to square one. i would prefer now to deal with it myself and having told them i would not like them to act for me. It did not go to the ombudsman either, i am at a loss they have told me they will charge me for any work they have done.. so i do not know what this will be, i dont mind paying a nominal charge but without knowing just dont no my legal standing on it

 

any input would be great because i really dont know what to do with this one.

i started the claim back in march 2008 and i have contacted them later on that year to see how it was going on, alway got fobbed of saying that the claim was still ongoing, now we were now to june 2009 i said to them i was not satisfied with what they have done and i wish to disperse with their services,I also wondered why they did not forward our claim onto the ombudsmen,[checked it they hav'nt] they told me they dont like to deal with them they would prefer to deal with a solicitors wrote them an email to state i do not wish them to act for me anymore and next thing we had a phone call to say they were engaging a solictors to act on our behalf we recieved all the details, by post it looks like the same forms we dealt with this company when we started and also stated if they have no response they will forward it to the ombudsman,,,so why did'nt they!!! so i think back to sqare one.... i am at a loss to why they did.nt and this company will be doing so, i would just like to get rid of them and try it myself, i have letters ready to do so but just dont know what to do at this minute,

 

any help would be gratefull

 

 

i think i was silly to go with them in the first place

It all sounds very suspicious.Can you give us the name of this Claims management company ?

You have every right to contact the FOS,and the procedure is very easy.

The FOS would want to see evidence that you had attempted to recover any PPI due from the original creditor/service provider.

 

Can you also give some info as to who you paid the PPI to ?

I am sure that we can help you to do this yourself.

 

Insofar as letting these people know that you no longer wish them to act on your behalf,it should be straightforward.

I suggest something on the following lines;

 

Dear Sir/Madam (or if you know the name)

 

I refer to my business with you ref XXXXXXX.

I give you notice herein,that I withdraw any further permission for your continued actions or interventions in this matter,and now seek my rights to undertake future actions myself.

I draw your attentions to guidance issued by the Ministry of Justice,and also that issued by the Financial Services Authority,in relation to claims management practices,in particular the Bulletin issued in July 2009.

 

I would appreciate it therefore,if you can return to me any documents that you have in relation to my claim,together with an undertaking that you understand this request and will comply.

 

Yours Faithfully/Sincerely

 

 

XXXXXX

 

 

Send recorded delivery and keep a copy.

 

 

 

Remember-as I said,the FOS will only take up your case,once you have exhausted efforts to have the PPI refunded,and either been refused,or given a final response inside of the 8 weeks complaints procedure allowed for dispute resolution.

First of all thanks

 

The company in question are called Ratio money,

The company I am reclaiming from is called The Bank of Scotland.

 

I will write that letter straightaway and send it of tommorrow.

 

When I receive all the paperwork back do I then contact the fos. i am a bit unsure of this. Ratio money have never contacted the ombudsmen, i have phoned them up, my name does not appear on their list, will i still have to write to them and explain what has been going on, also will i have to write to the bank of scotland to explain to them that i am dispersing of Ratio.

You have every right to process this claim yourself.

Had you found CAG in the first place,then I have no doubt you would have sought help from nowhere else.

There are 1000s of cases here which show people claiming back PPI.

Your first port of call is not with the FOS it is with RBS.

Do you know how much in PPI you wish to claim ?

Have you got all the docs and paperwork that you need ?

Before the FOS will take up your complaint,you have to show that RBS have refused to refund your PPI.

I have had a few claims with them myself and can point you in the right direction.

In my own opinion theres no reason why you cannot try to get this PPI back yourself.

Theres lots of people here to help you and show you how.

But send the letter off to Ratio Money.

I will look into whether they should be reported.

From what you say they dont appear to be a firm I would want to be dealing with.

Coronation St actor Mike Le Vell is a director & they charge £295 for any unenforceable or unfair credit agreement case and the client keeps 100 per cent of any settlement, which doesn't seem to be a great deal when you can do it yourself.

No wonder he has told Sally theyh are moving on to better things.....at £295 a shot its got to be easier money than servicing the taxis in Weatherfield;)

i gave ratio money all the documents i had, which where for two ppi's one was only for 100 the other to my knowledge is for around 1900, they were the original documents,

 

i will as i say send the letter of tommorrow and will let u know when i receive the reply hopefully documents will come back to me

i did'nt want to mention last night, but i have another two ppi's, just got the aggreement back today of the abbey, and the loan is still ongoing till august next year, upon looking at it, the ppi was for 1200.00 pounds and the interest is for £199.00 but as i have said still ongoing, i did not think it was for this much, i did agree to taking it, i remember but also i did not know that is was going to be an extra £20.00 a month i really thought is was £10.00 and also we are self employed and upon taking it out , i remember the girl saying nothing about anything else but unemployment at that time. i sent this of because i want to do this myself. also the next one is ford credit for a car, just found the agreement the other day, so i want to do this myself. so if you can provide me with what i have to do now with these i would be really really gratefull

We have a dedicated forum on CAG for PPI you can find it in the menu.

I understand that it may seem confusing for you now,but I think once you have a read about this in the PPI thread,you will have a better grasp of how to roll with it.

So do that and then come back here with any questions or tell that you are ready to go.

As with any reclaims,its important that you gain some understanding of whats involved and that is half of the battle.

As PF says-theres lots of help here to get you started and also help you through the whole process.

hi

 

i sent the letter of to ratio money, since then no reply apparently they have contacted my husband on his mobile and left a message to get in touch,i dont want to get in touch by phone, i would like them to reply to my letter. any ideas? also because i am dealing with it my husband will not have a clue.
