      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

What we did here to stop calls coming (mostly for a previous tenant) was to have a phone which doesn't ring, but we can make outgoing calls on. If anyone needs to contact me or my flatmate they have our mobile numbers. You can also get your phone provider to change your phone number due to harrassing calls, the first change is usually free of charge.

 

I know how you feel, the DCAs are like a dog with a bone, I have one in particular at the moment who have broken loads of rules but seem to get away with it - complaint letters going recorded delivery tomorrow yet again.

 

If necessary you can get the CAB involved, they will write to people and tell them to stop - although this only works for a limited time (usually three months) but it does give you a breathing space.

 

Posting on here should help too - quite a few of us have been through the extreme stress stage and can help out.

 

With sleeping there isn't a great deal you can do - the NHS supply Zopiclone which whilst making you sleep doesn't kick in the dream cycle which helps relieve stress. You need something like a milky drink with a bayleaf boiled in it, take the bayleaf out. It might taste a bit 'bitter' but you can add sugar and a yeast tablet and that will help you sleep. A high dose of Vitamin D also helps.

The other thing is, My fridge, freezer, TV, Hifi computer & parts of my laptop, are only borrowed, if they got a CCJ they could take them

They cannot take what isn't yours - you need to list what is borrowed and who owns it and keep it handy.

, & then I'd have a fair few angry family members wanting their stuff back, or me to pay them for it, as they are only on loan, even my cooker & washing machine is technically my mum's as she bought them for me on her catalogue & is still paying for them.

Anything on Hire Purchase CANNOT be seized by a bailiff

Everything else I have is all second hand. If they got a CCJ what can they take? Nothing is worth very much except the things that are borrowed, as everything I have is very old & second or third hand, including the bed. The only new things are the cats toys & litter tray. (They can't surely take those can they?)

They can't take animals, they will bluster that they can but they have to notify the RSPCA FIRST and then there will be trouble for them back at HQ.

 

Make an appointment for the local CAB and they should be able to help.

 

If a case has gone to the litigation department it is only the next desk (or next room along) until you get court papers DO NOT PAY A PENNY to them. Once you get court papers come back and we can help more.

 

Please please stop worrying so much about them, that is exactly what they want you to do - your no 1 priority is your own health and welfare - in your current state you are vulnerable and need outside organisations such as the CAB to help.
