Sorry for High jaking your thread guys!! BUT...

 

Last question I promise - they are asking something about 2human rights2 on form - do I tick the box or leave it (sorry for being dumb - but I am sitting waiting for midnight to ping the buttons!!)

Just got interst to double check now and it's done!! (so excited - can't wait for son to get his money back - file mine & hubby's MCOL next week with Halifax too - this is my dummy run for my son LOL :D )

I had the same issue at first and ticked it to say YES, then i thought "Bugger !!, They might reject my claim" but it still went through.

 

Maybe put NO to be on the safe side......

...but don't quote me on that;)

Leave it unticked - you do however need to tick the box that asks if you want to reserve the right to claim interest!

Cliare, you're dealing with HSBC, right? They entered a defence a defence with me, after the 14 days then sent me a full settlement offer.

Damnit, they entered a defence last thing yesterday!

 

Can anyone tell me about their experiences of what I can expect next plase?

 

 

Hi Clare,

 

They entered a defence at the last minute with my claim (last saturday).

And then today, i got a letter from DG requesting a breakdown of charges.

I'm tempted to call them tomorrow and/or send a letter along with my breakdown telling them that it's the 3rd time i've sent them a breakdown.

 

Oh well, the merry-go-round continues !!!

This is not really a repy so sorry, but I am really new at using forums and can't work out the best way to post. I have tried emailing tech support but get the message that the URL failed.....sor sorry about this but........

 

I have submitted a MOLC - which has been acknowledged - today got a letter in post from solicitor's offering a full and final settlement of charges plus interest but doesn't inc £120 court fees. From reading the step - by -Step process in FAQ's it looks like I should ignore this and wait for the defense to be submitted. But I am not sure. Can anyone help clarify?

 

Once again sorry for doing this in the wrong place - Can anyone tell me how to start a diary on here?

No problem twirly, you just need to click 'start new thread' at the top of the HSBC forum.

 

I would contact D&G and ask about the court fee though, if they have offered you everything else, they shouldn't be too difficult to convince on that.

 

No point waiting for a couple of weeks for them to file a defence when you could get all the money sooner.

 

Make sure when you call you sound confident, as if it is just an oversight on their part that they didn't include the court fee.

 

Should be fine, if they won't agree it, just say that you'll see them in court (that should make them agree pretty quickly)

If you don't feel confident speaking with them (Deb D'Aubney wasn't very nice to me so I have reported them to the Law Society) then just write thema letter, accepting the amount they have given you as part settlement and that you will keep the claim in until you get the rest!

2. Pursuant to the Defendant's terms and conditions the Defendant is entitled to make a charge for its services as set out in the Defendants price list.

3. It is denied that the fees charged for the services provided amount to a penalty or liquidated damages clause, The fees are an agreed price for a service provided by the Claimant.

 

OK, well spot the obvious mistake for one thing!

 

Is this similar to what others have received?

 

If this is the best they can do, they are in serious trouble!

Hogwash isn't it Claire? Like you say if it's the best they can do!! Mmmm!!!:D

 

I think I read somewhere someone had a similar response and they paid up within days - probably another scare tactic? :?

 

Be interesting to see what they do now? I'd start writing your shopping list if I were you - as that's no defence is it? :)

That's exactly what i got as a defence. It seems to be the standard "defence".

 

Get your breakdown ready to send off to them. You'll receive a letter from DG asking for it and you should hopefully get your offer for the FULL amount shortly after.

From what i've read of other's who have gone this far, that seem's to be what's happening.

They do this only to "buy them more time" in order to get the cheques etc issued.

 

Take a look at the way they handled my claim, and the law society's response from my complaint about them! (In my signature at the bottom of my posts!)

Claire, phone Alan and he will hurry the cheque along for you. I spoke to him and he was helpful. He made sure HSBC posted my cheque and I received it the next morning. He said they had to enter a defence as the cheque was taking longer thn he had expected and that was the only way he could ensure they were within the courts deadlines for action. He was very apologetic and the cheque was on the doormat next day. Good Luck!

 

I am going to be without internet connection for a few weeks now as I have switch provider and my blueyonder will be terminated at the end of today. The idiots who should be providing me with broadband have not been able to get me connected. Apparently the launch was delayed and I could be without it for weeks! Yes, I've complained and am awaiting a manager to call me back. Sometime within the next 48hrs I am told!

When I called and asked for a copy of the defence, Ms Daubney was really offhand and rude, if I spoke to the other side like that at work I would be sacked.

yea gonna leave mine till tues eve as I actually spoke to d&g today, and they confirmed they have recieved my breakdown of charges after I held them on the phone while faxing it.

They have no excuse now!

OK panic over.

 

I had a letter from DG Sols asking if my (soon to be ex) husbands bankruptcy trustees are aware of the claim. That arrived on Friday, and I worried about it all weekend.

 

I called the trustees this morning, who couldn't have been more pleasant and helpful, who confirmed that they have no interest in the claim, and will write to DG Solicitors to say so too.

 

Hopefully they will now make an offer in the next couple of days (before I have to shell out £100.00 for the allocation questionnaire).

 

Will keep you all posted.
