    • Hi, I have found this group very helpful hence I am here seeking help and advice.   I got myself into a situation where I have now more than £50k in unsecured debts (personal loans & credit cards) and things are now getting out of control as I am struggling to make payments. This is purely my own created situation and I am taking 100% responsibility for it. I am keen to get out of this situation as soon as possible hence I would appreciate any help and advice in this process. I am employed at the moment and don’t want to risk going into IVA or bankruptcy as this would risk losing my job. Being sole bread earner of my family, I cannot afford to lose my job. I have been trying to keep up with the payments so far and had few missed payments instances until 3/4 months ago but got caught up with missed payments somehow using my savings. All my debts are still with original lenders. However I know I am getting into same situation again shortly and won’t be able to get out of it again. I have started exploring Debt Management Plan (DMP) option through StepChange but haven’t submitted it yet. Based on budgeting, I have around £820 available to make payments to all lenders after taking care of all other essential expenses. This is definitely lot more affordable than what I am currently paying to different lenders. 1. Is DMP right option for me in current situation? 2. what are the negative consequences of availing DMP? 3. is there something else that I can do to get out of this situation? I’m determined to clear out all my debts but need bit of breathing space and time. Let me know please if you need any additional information. Thanks in advance for all your help and guidance. MM

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, No I'm not in N.I. but having problems with them myself led me to read this thread, it left me totally gobsmacked at their blatant disregard for the law, and blatant breach of guidelines.

I guess I shouldn't be suprised as its this shower of eejuts.

Maybe all CQ victims should have a whip round and try to get them a new brain cell to go with the one they all share...as its obviously defective:)

 

Zimmie please start your own thread and we will be better able to help you so as your advice doesnt get mixed up.

No I didnt think you were hijacking the thread, I just thought that if you needed help dealing with Crapquest you need your own thread. All comments about these oxygen thieves are welcome

Mine too. He is assisting me with a claim at the moment and he is very helpful.

 

That's interesting and exciting to hear. Keep me informed how you get on with this. I'm still at the "sit back and have a quiet chuckle" stage of mine but I've no doubt capquest will turn ugly pretty quickly.

 

You could be right about the spelling of GAUNCHE but then again they could be GULPINS

 

You may be interested to hear that Homer Simpson (now theres a man that could get things done with the Debt Collection Industry) has called Bart a "gaunche" on at least one occasion. I think its a Spanish or Latino word for "debt collector".

I got a letter last week threatening legal action and that the bailiffs would come and take my stuff. As I live in Northern Ireland I know this won't happen. I really hope they get a judgement through an English court.

 

I still haven't acknowledged them incidentally. They rang one night last week and I decided to have a wee bit of fun with the caller. My 8 year old has the same name as me and I put him on the phone. The caller realised quite quickly it wasn't who he wanted to speak to. I went back on the phone and told him that it may be better if they didn't ring back as I may have to report them to ofcom for harassment. His reply was that they couldn't stop ringing as that was the contact number I had given them. I've never had any dealings with this shower so I don't know where he got this from.
