It usually only takes a couple of days for the courts to send letters but you could always try calling them and asking under the claim number for anything they have logged on the computer. The sooner you know the better as it gives either more time to prepare for the next step or a bit of relief in not having to fear the postman.

Hello everybody - thought id give a little update and yet another request for help! I spoke to the court yesterday and the judge granted the suspended repo order as everything looks fine on paper regarding our finances - even though eversheds tried their best to get the house! However, although I havent recieved the papers yet through the post its a good job i called them as the order is stating that I have to make my monthly payment + £100 pcm towards the arrears (all good and fine) but the first payment has to be by the 1st of July!!! so next week! if I hadden't called the court the paperwork would have come to me after this day -(court admin telling me theres a 2 week backlog on the doc's being sent out) I did tell Northern Rock that I get paid every 4 weeks so my next pay day isnt until the 14th of July - this means that they would acctually get 13 payments a yr instead of 12 - the question I have is . . .

 

because I cant make the first payment until the 14th of July does that mean that Im still going to loose my home just because of the way I get paid (partner in new job not paid until the week after me) or is it like any normal payment I would make (Northern Rock only collect DD payments 1st month so alot of people pay by standing order or manually because of this) - as long as its paid within the calander month? Also if I do have to make the payment by the 1st of July does anyone have any ideas where I can get seriously low cerdit score finance for £700 so I can make the payment - I could borrow off a family member until payday however the same problem will occur next month as I wont be paid until the 12th of Aug and they will want money on the 1st of Aug.

It's a shame we didn't know that at the time of submitting your statement to court - we could have asked them to change the payment date in line with the government recommendations for lenders to assist (changing the payment date is one of the recommendations in the Civil Justice Council protocols). Also, if you had been able to get to court you could have told the judge about it. Never mind, nothing we can do about that now.

 

I think all you can do is write to the lender telling them that as you are paid 4 weekly and your hubby has judt started a new job you can't pay till 12th July - you could also give them the pay dates going forward and let them know they will be getting 13 payments a year instead of 12 which will significantly reduce the arrears. Hello Ell-enn, just so you know I had discussed with in length with NR before it went to court and they sounded happy with the payments being made every month as long as it didn't go past a month without a payment (if that makes sence) I was just shocked that exact date of the 1st of July was used - im assuming it was eversheds idea during the hearing as nothing was mentioned in the paper work i got from them.

 

I think I will phone and speak to NR as writing to them is a) normally a waste of paper and b) even if they do read and reply to my letter it will be past the 1st of july by the time they get back to me.

Oh, before I forget - am I right in thinking that if the payment isnt made on the 1st of July then they just get the house - no questions asked - of course via a judge again but you know what I mean, no chance to ask for 2 weeks grace etc?

If you haven't got the paperwork from the court, then NR won't have it either, so they won't know yet that payment to be made on 1st July, buy the time they realise it will be 12th anyway.

 

No, they don't get the house straight away if you don't pay on 1st July - they would still need to apply for a warrant and you have chance to defend again via N244 form. If that happens you will definitely have to attend court.

I think that the best way forward is going to be asking them to wait until the 12th then take the 13 payments p.a - if that fails then i need to borrow the money - i do however want to stress that they still owe me money from fees that they added incorrectly to my mortgage (I have paperwork from them stating no fees are applicable for a previous mortgage product i took but they added them anyway) and also a years worth of insurance premiums they took but didnt acctually give me the insurance cover (B&C) also interest charges on these fees so my balance is all wrong and my payments set a little to high because of that, but do you think they reply quickly? no 2 years later and still waiting for them to pay those back - even though they admit the errors on the accountin writing. So Sat morning is my next day off and I will prob' end up on the phone to them trying to resolve this and I will post an update once I get any more info.
