Do lloyds need my signature for a SAR?

If you have been following my other thread you will know that Lloyds are stalling somewhat. I recieved this letter this morning:

 

Dear ccjjl82,

Thankyou for your letter dated *sometime*, making a Data Subject Access Request.

I can see that we do not hold an up to date signature for you. If you would like us to go ahead with this request please sign and date the enclosed slip. For your security staff at any branch of Lloyds TSB will be happy to take a signature from you for our records. Please call in with your passport or driving license as identification.

The Act allows us up to forty days from when we recieve all requirements to send you the information.

Then some blah about giving me a month to respond.

When I sent them a SAR and CCA request they requested my account numbers, card number and address to proceed. I sent them that, adding that I have sent all requested info, so any more requests will be taken as a stalling method and will be reported (see other thread) So why are they requesting my sig as well?

Does anyone know if they actually need my sig to proceed under the Data Protection?

Despite being a relative novice to all this myself, I think for a SAR a bank can ask for further proof of ID in the form of a signature etc. They asked us to fill out their specific 'DSAR' form, which asked for exact details of the information we required (despite us having already sent them a very specific list of requirements), as well as our signatures.

 

Unlike a CCA where it is advisable not to send a signature just in case;), with a SAR I believe they can insist. It does, however, seem very much like another delaying tactic, but one which I think is probably unavoidable!

 

It's quite likely that other more experienced Caggers would recommend the use of a slightly altered signature that you would recognise again - we however, knew that Lloyds already had plenty of copies of our sigs (despite their protestations to the contrary) so went along with their request.

Lloyds are the masters of procrastination and denial, they are quite happy to send personal documents,statements etc to your home address without hesitation or signature of receipt etc. Send them one of the excellent letters from this site, as to why you do not really need to send a specimen signature, ( We all know why they want one) IMHO.

 

You can play them at their own game, or to save time in either receiving your docs or moving the dispute along at your pace, within the time frames, send either an electronic/digital signature or a signature crossed or whatever security mark you can recognise if/when it could re-appear.

 

The decision is yours the sooner you receive your docs the sooner you can put it into dispute. Lloyds are still out of control and have not altered one iota in their attitude, or respect for their customers.

Often you will have no reason to doubt a person’s identity. For example, if a person with whom you have regular contact sends a letter from their known address it may be safe to assume that they are who they say they are.

 

Suffice to say that if the Information Commissioners Office are satisfied that if you have previously corresponded with me at this address then it is reasonable that I am the person I say I am, therefore there is no leglislation nor guidelines that you can hide behind in an attempt to avoid fullfilling my legal request,

thanks for this. I could just lie down and send it to them, but they have already asked for info and a sig wasnt part of their request! And since I told them that any further requests will be seen as a stalling method, this is taking the proverbial biscuit!

We know now that these are stalling tactics and to save the time with letters and them expecting them to ask for the signature ,my take on this is get some one to write a cheque and pay them the £10 that way you can trace if it has been cashed as postal orders are a pain to trace and set your self up with a digital signature from above,

Are you likely to send a CCA request to Lloyds? If not I don't see the problem with signing a SAR.

No prob Gary. I guess the OP may have good reason not to use his signature, but AFAIK it shouldn't be a problem unless there are circumstances as you suggested.:)

They already have sent a CCA request with the SAR.

 

When I sent them a SAR and CCA request they requested my account numbers, card number and address to proceed.
