    • In my experience (not with car payments) but with many other things, my partner has been ill and signed off in the past and we have been unable to meet various commitments.  Naturally if you ring the call centre they are going to fob you off and tell you you must pay, that's why that never ever works. I would obtain a note from her GP listing all her health issues plus medications plus side effects, then write to the finance company with a copy of it, explaining the situation, as you have here, asking for a payment holiday. Perhaps mention that the car is very much needed for hospital appointments etc. It's likely the finance company would rather you pay till term end than, chase you for money they will never see, and sell the car at auction for a loss,  You can search some of my threads going back years, advising people to do this for Council Tax, Tax Credits, HMRC, Even a solicitors company and it always works, because contrary to popular belief people are reasonable.
    • Sorry, I haven't ever seen one of these agreements. Read it all and look out for anything that says when she can withdraw and when she is committed to go ahead. If it isn't clear she may need to call the housing provider and simply say what you posted here, she doesn't want to go ahead and how does she withdraw her swap application?

Your head is like a power bank of knowledge.  Her health issues are short term, due to a relationship breakdown she took it pretty hard and has been signed off work on medication for 3 months. She only started her job in February 24 so does not qualify for any occupational sick benefits, which is where the ssp only comes in. (You will see me posting a few things over the coming days, whilst I try and sort some things for her)  I sat with her last night relaying all this back and she does want to work out a plan, she was ready to propose £100 for the next 3 months and then an additional £70 per month onto of her contractual to "catch up" but Money247 rejecting the payment holiday and demanding £200 thew her, which is why I came on here.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Not yet- several claims are happening right now with one in particular scheduled for a hearing on the 9th, I believe, so we are all awaiting news of that case with baited breath!

 

Egg seems to be a tough cookie but they might just be good bluffers!

yes it did, but i've had to withdraw my claim. They have dragged up a bit of dirt on me going way back to my application and relating to the ppi. So it is just proving to be too stressfull. Also, as mine seemed to be the first case, I felt it was very important that it was straightforward, lol, or as it can be! as it will set a precedentThey have still got this counter claim, so it has gone up to the judge for an urgent decision. I wish everyone else the best of luck and as they have posted me a package of docs. they will rely on in court, I have told Tobes, as his case is probably imminent, that I will let him have these. Just got to wait for the judges decision.

Oh Yasmin, that's such a shame. I'm too scared now to go ahead and claim - I've sent them my prelim though!

What really worries me is Egg. Basically, what i am saying (and i am sure you have all thought this yourselves!), is that if the first few cases go in Egg's favour, then that could set a precedence so the other institutions decide that they too will defend every claim through the courts.

 

On the other hand of course, if Egg lose then that would be a MASSIVE boost to everybody who has ever been charged fees over the last 6 years, from all over the UK!

I think it depends what credit card I had a credit card with MBNA and I got all my money back.

 

What you need to remember is that if egg go to court they have to explain how it cost them £30 to send out a letter or reject a direct debit etc.

 

I know, you're right - that's why the banks have collectedly paid out voer 20 million so far.

 

It does worry/upset me though that the court system allows Egg to drag all our claims out as much as they have. I mean, if they don't enter the paperwork etc then why should they keep getting an extension etc?

 

It worries me how no one has won yet against Egg, their stalling tactics must be good!

I could be wrong, but I was under the impression no precedents can be set in the small claims court? Just an observation.

For Egg we need a trail-blazer, a battering ram, the sharpest tip of the strongest spear. In other words a model citizen who cannot be intimidated and blackmailed by Egg in any way, i.e. no current arrears, just punitive charges in the past to be reclaimed in the present. Unfortunately I myself am not in that strong position.

 

Our winning that test case will demoralise Egg and encourage all other claimants who can quote the precedent.

Hiya,

 

I had 2 egg cards which I got into arrears with on and off last year. I explained that I was on maternity leave and was waiting money coming in. I paid them off at the start of the year but they reveiwed my accts and due to my work status, closed them down after. One is actually still open cos it is 2.36 or similar in credit although I dont think I am allowed to use it! I also have a loan with them which had the same problems but all sorted and no arrears. I am going to request statements on all 3 once I find the closed credit card acct number - bit difficult as dont seem to have any statements and my online info doesnt mention the acct anymore.

If you think I may be suitable then I will try to press ahead with this earlier - I have others I have sent SAR's for but as I dont think Egg owe me too much and I still need the acct number I havent sent off one to them yet. I will do it though if you think it may help other cases. Just not sure if my scenario would make me suitable? Also worried, can they then go and close my loan down? I agreed with them at the start of the year to increase the term of the loan due to a change in circumstances, could they then go and put back to original length or call it in if I try to claim?

Nikki,

 

I have an Egg Loan account open, with Egg card balance transferred thereto then closed a year ago. I had no difficulty obtaining the card number from Egg, they are legally obliged to retain historical info for a number of years. Egg card is always paid by DD, do you have online access to your bank account or back statements which mention Egg number on DD instruction.

 

As for Egg retaliating by closing your Egg loan, unless your loan repayment is seriously behind, I cannot see any justification. The agreement signed was for a fixed term loan, not like a bank overdraft liable to be called in. Would have to read Egg's fine print online which is notoriouslly difficult. Perhaps legal eagles and card employees can shed light on this?

 

A clean candidate to debunk Egg would be a dream. Any victimisation can be reported to OFT CEO. Egg has already pushed its luck with the OFT, time they come a cropper.

I have just sent my prelim to Egg. I had a few probs about a year ago in terms of going overlimit and late payments. No probs since and they have actually increased my limit.

 

I will take this all the way I can - if they try to close, I will report them to banking code, ombusman and quote the unfair terms of contract Act (i thinks that's the act that covers it).

 

Keep an eye on my thread below and see how I get on - any advice etc at anytime is greatly appreciated!

Hi All

I'm in the fortunate position of having just paid off the balance on my Egg card.

They owe me £200 in charges for the usual late payment, over limit etc.

They've got nothing on me, nothing to use against me and I really hate their arrogance, so happy to oblige.

I've just had my (unusually polite) RFP turned down so LBA being prepared now.

I'm paying mine off too, takes away their counterclaim and there's no pressure then about paying it back!!

 

The Banking Code said they can do it! (close accounts) as did the FSA!
