Moved case forward to 24/05.   He said there was no signed agreement and after a bit of “erm, erm, yeah but, erm” when he asked them, he allowed time for sol to contact claimant.  what is the next step now? thank you UCM  
    • I've had a quick (well, quick for a thread of this length),  read of this thread and to be honest I'm struggling to make heads nor tails of the actual crux of the issue here. You seem awfully convinced that whatever is going on is worth the fight and the odds are in your favour but with how the thread has gone it seems that one trail goes cold so you simply move on to another in an attempt to delay the inevitable. All it does is end up digging holes and confusing others and yourself which means any advice given to you is completely pointless. I note that for the life of this thread there has not been any documentation or correspondence uploaded for people to have a look. Have you got any that you'd be willing to redact and upload for members to assist you? Right now, it seems people are shooting out advice while being in the dark because it's starting to become very difficult for people who weren't here at the start of this (including myself) to follow along. Right now, this whole thread is just hypothetical "He said, she said" and is going nowhere fast. Nothing more than basic advice can be given which, as you've sought out some legal advice, is likely not sufficient to actually come to any sort of conclusion. I, personally, am starting to agree with others that it may be best to consider bankruptcy and put the matter behind you.  
    • Thanks for coming back to us. There are no guarantees - but remember that so far MET have not had the guts to put even a single case before a judge.  Not once. Yours is one of seven court cases. Three ongoing like yours. In two MET bottled it as Witness Statement stage approached. In one the allocating judge decided their Particulars of Claim were rubbish and threw the case in the bin. Just the one victory by MET by default when the motorist stupidly didn't file a defence. So there is every chance that MET will throw in the towel in your case too if you stand firm. Please keep us informed of what is happening. Regarding being abroad, that is no reason for things going wrong, you can request an on-line hearing and we've had several cases where the PPC gave up when the motorist moved abroad. But please keep us in the loop.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My bank has replaced the money fraudulently taken from my debit card a/c by rewardsnow. From what you say, it would appear that the OFT were unable to close them down (or couldn't be bothered to do so!). Stay cool :cool:.

Hi there, we recently found out that we have been getting deductions of just under 16 quid for the past 3 months from highcreditco, we checked everything (even had the IT dept check all our past junk and deleted items over past 6 months)and chased them on it, eventually threatened with the fraud dept of our CC company (which we would happily follow through on principle) and they responded within 48hrs guaranteeing that they will refund all the monies they had taken to-date... waiting now! So, the point is, you like us have been swindled, at no point did we provide our CC details and they have a very illegal and unethical manner of making coin... fight it, together we will all win!

billea, while I have already posted on another thread about the highly dubious business practices of this company - and I cancelled immediately I realised how appalling the service was in my case - it's pretty unlikley that they would act so fraudulently - in the very legal, we're going to prison, sense - as to STEAL your details when they are making money hand over fist from the rest of us by - just about - staying within the law.

 

Possibly what happened is that someone else used your details, by mistyping and getting lucky with the card number/expiry date/CVV (millions to one odds), or delibertaely (but who'd do steal someone else's details with own their credit file!?!?! - unless they knew everything and were actually pretending to be you??????) - or you did indeed sign up but have forgotten you did so (which you seem pretty clear didn't happen).

 

perhaps to be on the safe side you might want to check if your credit file is in order using exp/equ CRAs, just in case someone has applied for credit in your name following identity theft?

avatari, you must work for them as this is the worsted company I have ever known, that it from me I have had 7 payments taken and NEVER and I repeat for you NEVER had any authorisation from me to take the funds.

Also you NEVER get any details of the credit check as well.

Try calling them and then come back!

ISITME, you are welcome to your opinions but suggesting I work for them is both ridiculous and insulting - if you re-read my negative comments about the company regarding my own experience, does it really seem likely I work for them?

 

I tried offering practical advice to another cagger about checking for identity theft given the unlikely probablility of this company actually stealing credit card details to use on their own products (it would be pretty stupid of them to leave such an obvious fraud trail): I don't expect barely literate personal comments from a cagger to the effect that I am a troll/spy. While I accept you are angry with how they have taken money, directing that at me is a little unfair. Let's leave the personal comments out of this, please?

 

Oh, and I DID call them - months ago, so I am well aware of the problems, and thank you for your patronising comments. Am I welcome back? :rolleyes:

I signed up today,

nowhere did it state a fee, i have cancelled it now but i think il have to stop my cc and my bank card. They can access your details cos i got my credit score from them. Avatari did you cancel using the link and were you charged??

HFC (Beneficial Finance) - DCA letter recieved 3/4/09 after 17 months of silence and being told account was paidoff Dec 07!!!. 1 phonecall and i recieved and offer of double what my claim was, waiting for cheque as of 16-4-09

hi flopper, no i wasn't charged, I tried to cancel via site mail but got no reply so rang them and put it all in a follow up email confirming the conversation and the person i spoke to.

 

my problem with them was that after signing up techincal problems meant i couldn't access my file. i also felt that the site design once in was so amateurish and unnavigable that i didn't want anything to do with a comany like this, the fact they were so hard to contact was the final nail.

 

seemed like an incredibly poor outfit designed to make it really really hard to a) actually use the service, b) get your money back. my experience seems to be typical of most caggers by the looks of this thread.

 

flopper, they CAN'T access your credit card AND debit card details simply because they can access your credit file for you. CRAs don't have access to your payment details EXCEPT to the one card you used to pay for the service. if they have confirmed cancelled, this should be enough - as i said, this is terrible, amateurish company but not actually a [problem] site. And, if you paid by visa debit, or by any credit card, you can get the transaction reversed if they do take it as the bank is jointly liable for any losses you incur through no fault of your own (i.e. having already cancelled according to site t and cs.

Might have something to do with the news story that the company behind Highcreditscore.co.uk and and rewardsnow.co.uk, Adaptive Affinity of Edgware seem to be threatening sites that discuss customer's problems in any kind of negative way.

 

I won't post the web address of the story here (just in case!!!), but if you're interested, do a Google for "Adaptive Affinity threatening to sue me over a blog post"

Hi there

Got my bank statement today and was browsing it and saw two payments had been taken and at the same time. Quickcreditscore £19.95 and Rewardsnow £19.95. I couldn'y understand where they came from and thought I'd better check my previous statements. I was amazed to see that these exact payments had been taken every single month from February totalling about £200. I cannot ever remember having any contact from this company and feel duped. I've searched my in and outbox on e-mail to see if I'd registered for anything (even my [problem],phish, and junk mail/deleted mail) nothing at all. I really think that the BBC and OFT should be looking into this [problem] artist and shutting them down and prosecuting. It's a clearly fraudulent operation in my opinion.

 

I'm contacting my bank now and getting this debit stopped and then I'm going to pursue the bank and companies for a refund of the payments, but I don't hol out much hope.

Has this been taken a a DD or a revolving card payment, if it is on a card credit or debit you may have to get the

cards replaced to stop the debits.

Hi

The payments were taken directly from my bank account using my Visa Debit card. If I have to change the card it'll mean changing my current account also. I've never fallen foul of any scams before so I can only imaging how many unsuspecting people have fallen for this trick. With the amounts of complaints about this company on this site and on the Compliantsboard and others, I just cannot understand why the authorities haven't yet done anything about them. Their methods are so blatently f r a u d u l e n t and underhand that any where else in europe they'd be in the dock by now and doing porridge.

All you need to do is tell the bank that your card has been compromised and they will replace it, the withdrawals are

made using the 16b digit card no. and the last 3 digits of the signature panel security code, so you won't need to change

your current account,

looks like its still going on with this company...ive had money taken out of my account by rewardsnow whom ive never heard of,when i called them they said i registered with Quickscore of something,another site ive never heard of..after a load of phone calls etc im getting a refund,there is defo a [problem] going on somewhere,they seem to be telling everyone the same story about registering and then cancelling...when i told rewardsnow i was taking it further the cheeky bitch on the other end blatantly told me if i took it further then i wouldnt get my refund!!!! I have never put my bank details into the computor so id like to know how they got my details...theres something going on somewhere and loads of people are being scammed by them...i didnt even have a direct debit set up for them so how could they take money from my account without my permission? Something needs to be done about these [causing problems] companies as they seem to be getting away with it.And if you get the cheeky bitch i got then be prepared to be spoke to as if your stupid,hope she can sleep at night knowing shes working for a company that robs people.
