      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sent off prelim letter to woolwich (for £1720.64) but just starting to think if i should try and set up another account somewhere else in case the Woolwich get a face on ??...any thoughts anyone and if so any bank anyone can recommend (!) .. (was discharged bankrupt in 03 and no real probs since but guess credit history is still a bit iffy)

cheers jonni2bad.thanks for the info - had already looked there but as daft as it may sound I am actually happy to stay with the Woolwich for another couple of years (my discharged bankruptcy can be removed from my credit file then and i may get a 1/2 decent account) but i just want them to be reasonable with me - as do all other woolwich customers!! and not rip me off every time a dd or cheque returns! (Which it wouldnt do if they did not charge £35 each time!!

What is niggling me (other than the thought of going to court!) is that they may get assy and close my account at short notice - has anyone had this happen ???

It has happened, but not on a large scale. We are now advising anyone who receives a threat of account closure whilst making their claim, to include an injunction so that the court orders the bank NOT to close it.

Not surprised but it was worth a try though!!and it will help to show the court that I have made every attempt to avoid proceedings.

I got the same % offer from Woolwich just by sending my 1st letter

I had not even sent my LBA.

I tried to play it nice with them and offered to settle but not at their amount.I told them the amount I wanted (85%) of my claim but have not had a reply so have posted off my LBA yesterday for the full amount.

I have reiterated to them in this letter that I would still be willing to settle at my 85% figure so will see if they are prepared to deal !!

If not then I will file with Moneyclaim.

In your case I would now write back to them and say that you are prepared to accept the amount as a part settlement but that you will be pursuing for the rest in court.There is a template available.

Give them the 14 days to respond and then file I have filed at Moneyclaim for my NatWest account and it is pretty simple.

If I can help any more please do comeback to me

Lets hope they forget to acknowledge and you win by default but more likely they will acknowledge and gain themselves an extra 14 days to defend

I don't want to be a dark cloud over proceedings but they WILL acknowledge (probably in the last two days) and they will defend!

 

I am having a right ding-dong with the Woolwich and have just received a stay ordered on my account :mad:

Ok guys here we go !!

 

Received defence filed by Barclays today with AQ as expected

Will return AQ with my £100 asap before 23rd Dec (someone may miss out on a Xmas present!)

But now is the time I will might need some help please!!

Have downloaded the Court Bundle Zip and guess I need to start preparing

Concentrate on the AQ first - you don't need to prepare a bundle just yet (although nothing stopping you) as this would normally be done once the court has allocated track and a hearing date etc.

My Allocation Questionaire was completed and returned with payment before deadline.

Just rung court and they have not received Woolwich AQ.

Not quite sure what happens now???

Could Woolwich defence be struck out ?? I presume that it is up to the judge but dont know for sure??

Guy at the court told me just to wait now.

Any thoughts anyone??!!! :?

My thoughts are that the Court will set a hearing date once the Woolwich/Barclays AQ is filed....they filed their AQ some 2 weeks after the deadline in my case.

Preliminary Letter sent to Woolwich 05/06

LBA sent 19/06

Court claim filed 04/07 : Total £824.75

Acknowledgement of Service 27/07

Defence received 08/08

AQ filed 11/08

Barclays AQ filed 05/09

Hearing date 20/12

SETTLED IN FULL £840.49: 14/12/06

Maybe I am just hoping too much that little cheque will come bouncing through my door sooner rather than later!!

I have gone this far now so a few more weeks (if necessary) wont hurt!!

Think its now just up to the judge so will just sit and wait and hope !!

Court administrator said "Awaiting directions from judge now as none if these have gone to court"

Think I will make a phone call in a week or so to Barclays to see if they want to coff up before court.

Will start to get bundle together though !!

Dont start getting your bundle together just yet no point in being out the expense and effort to have it all wasted ring Barclays you know and i know they are going to settle they dont want to go to court dont waste the moment phone them now you have read the threads we have all phoned them i personally think they expect us to ring them now so come on phone them they are really nice to deal with no ackward question just have your name claim number and total amount being amount of claim plus interest plus costs in front of you just ask for legal clerk dealing with your claim if its to soon they will tell you you will be receiving a letter in so many days so go on ring them heres the number 02071164523
