    • I have recently found myself in financial difficulties and with the help of forum members in another thread regarding this, I think I can get myself sorted. My query here is how to deal with a Cifas marker that has been logged against me by one of my creditors for "evasion of payment". Admittedly yes I did get a £5000 loan with them and have not paid any payment but at the start of the year, which is when the loan landed, I realised I was going to be struggling to repay that and other debts and I contacted MCB to ask if there was any way I could extend the loan from 24 months to 36 months. I explained my situation and that I was going with a DMP and asked them if they could help me with this. They did not reply. I then emailed them again a month later explaining that my DMP was going ahead and could they confirm that the direct debit was indeed cancelled. Again, they did not reply. The DMP fell apart and so did everything else thereafter. My bank withdrew my overdraft and said I could not stay with them (I thought initially that it was because of the DMP) so I opened another account (Starling) and set up all my direct debits etc with the new bank. A month into being with the new bank, they contacted me and said they were closing my account in three months. So I started applying for other basic accounts and every single one of them either refused or revoked.  Through the help in the other thread, I requested a SAR from Cifas and discovered that I have this marker against my name for "evasion of payment". I have logged a complaint with MCB on the advice of other forum members, but my query really is do you think the marker is fair given that I did ask them for help and I did explain that I was going to be struggling financially to repay the loan over the original two years, and is there any way that I can get it removed? I fully admit that I have yet to make a payment to them and I suppose in my naivety and panic I thought if I emailed them early on they could extend the loan and help me out, but they didn't even reply  I did manage to open an account with Monzo before the marker was in place, but I am very concerned that if Monzo do what Starling did, I will have no bank account to pay my bills or get my wages paid into.  Realistically based on the information I have given here, what do you think my chances are of getting this marker removed? Any help/advice on this would be greatly appreciated x
    • Thank you dx, that is what I intend to do now. I have gone through all the SAR documents, a lot of which I am seeing for the first time! As per my previous post #116 letters and statements alleged to have been sent to me, as recorded on their system notes I have not received. Letters I have sent requesting information and account statements have not been recorded as being received by them, all were sent either by Recorded or Special Delivery. I have all the proof you menrtioned from my files for payments and from their SAR info for fees added. Thanks t
    • In my experience (not with car payments) but with many other things, my partner has been ill and signed off in the past and we have been unable to meet various commitments.  Naturally if you ring the call centre they are going to fob you off and tell you you must pay, that's why that never ever works. I would obtain a note from her GP listing all her health issues plus medications plus side effects, then write to the finance company with a copy of it, explaining the situation, as you have here, asking for a payment holiday. Perhaps mention that the car is very much needed for hospital appointments etc. It's likely the finance company would rather you pay till term end than, chase you for money they will never see, and sell the car at auction for a loss,  You can search some of my threads going back years, advising people to do this for Council Tax, Tax Credits, HMRC, Even a solicitors company and it always works, because contrary to popular belief people are reasonable.
    • Sorry, I haven't ever seen one of these agreements. Read it all and look out for anything that says when she can withdraw and when she is committed to go ahead. If it isn't clear she may need to call the housing provider and simply say what you posted here, she doesn't want to go ahead and how does she withdraw her swap application?
    • Thank you! Your head is like a power bank of knowledge.  Her health issues are short term, due to a relationship breakdown she took it pretty hard and has been signed off work on medication for 3 months. She only started her job in February 24 so does not qualify for any occupational sick benefits, which is where the ssp only comes in. (You will see me posting a few things over the coming days, whilst I try and sort some things for her)  I sat with her last night relaying all this back and she does want to work out a plan, she was ready to propose £100 for the next 3 months and then an additional £70 per month onto of her contractual to "catch up" but Money247 rejecting the payment holiday and demanding £200 thew her, which is why I came on here.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If you are going to claim under the financial hardship rules you need to complete an income /expenditure spreadsheet. This can be found in the

Banks Template Library together with the appropriate letter(6)

good luck fran1380, i had put a claim in for hardship and they only give me £50.00 as a goodwill, they will not refund me any of my money even that im in hardship, i have had to email the financial ombudsman to try and get my money back now. its a joke, i will never bank with them again.

Keep plugging in there Fran - AL has stumped up £565 to my account due to financial hardship, but it took two letters and a bit of determination. they say it's a refund of all fees since my change in circumstances. I'm now looking for a letter to reply that I will still be challenging the rest of my claim.

can i just ask what other letter did you send them as i have sent them 2, one asking for my fees as we are in hardship and the other was a income and expenditure letter. thanks.

 

Probably should have explained better Heidi. AL were being awkward and said they needed more evidence of hardship - i.e when partner gave up trading and other bits all of which were in original income and exp. letter. so I sent of required 'evidence' along with a letter stating they already had the information and reminded them that interest was still being incurred on my claim that had been stayed and I would persue.

thank you for explaining, i dont think there is anything else that i can do apart from waiting till the ombudsman sorts it out for me. :( i have even been thinking of making a complaint.

 

Heidi, don't give up hope. The bank will have to assess you for Financial Hardship(it is all in the waiver), some people have had some success from what is called the HASSLE THEM approach, ie ring em and hassle em. Keep the chin up.

thank you, as we are skint i could of done with the money from the bank to pay for my bk, i might try and ring them tomorrow, i just feel everything i keep doing is not getting us any where, but it is keeping my mind off other things. x

I havent heard back yet (i was delayed in sending letter anyway) but i doubt i will get anywhere either. Even though the "hardship" criteria i definatley qualify for. I wish this was all over and we could just get our money back!!

 

I hate A & L i cant believe i ever went near someone that charged £5 per day for being over overdraft.arghhhh!! Now to find another account :-(

i had a letter on saturday, saying thank you for your letter please could i send in photo copys of wage slips for 2009, also how much benefit we are receiving. but i have also complained to the ombudsman for them to sort it out for me. as alliance did not want to no but now they do. if you have bad credit its hard to get a bank account as i have already tryed. the only bank account i can have is think banking but they charge you £12.00 a month, but i have no choice i have got to go with them.

Have you replied to A&L? If they had not issued a final response or had not replied and it was within 8 weeks then FOS will send your complaint to A&L. Might be worth seeing if you can get hold of a fax number for them if they accept faxed information perhaps.

hi thanks for the message,

i had a letter on the 12 march saying = thank you for your query fees raised on your account.

we have reviewed the circumstances in which these fees were charged and confirm they are in line with our fee structure.

Although the fees are correct, we have taken account of your situation and are pleased to advised that on this occasion we have refunded £50.00 as a gesture of goodwill. however, any future fees charged correctly will remain. then just says how to avoid fees.

 

the other letter i had was 25 march what came saturday saying=

thank you for returning your income and expenditure details.

please provide copies of documentation confirming your household recent income. this may be in the form of salary or wages, the last certified accounts or tax return if self employed, benefits agency, student grant or pension payments. alternatively you can send us copy of the hm revenue and customs assessment for tax credit awards.

it will help if we explain that in these circumstances we have a filtering process to assess applications for a refund of bank fees due to change in personal circumstances. what we are looking for is information and documentation to support that our fees have been raised due to conditions beyond the control of our customer.

when your claim has been assessed, for your security and confidentiality all documentation you send will be destroyed. please ensure that your account number is clearly written on any documents you send.

 

i had sent them the income and expenditure on the 23/2/09 but forgot to send it recorded delivery, so they said they had not received it. so i had to send them another one on the 11/3/09 recorded delivery.

but when i received the letter on the 12 march i reported it to the ombudsman and sent them all photo copys of the letters alliance had sent me. i have now photo copyed all information they require, and i will be sending them by recorded delivery tomorrow morning.

they just seam to be taking there time to sort this out.

Heidi, the good news is that some banks are starting to payout and while the £50 is quite frankly nonsense if it doesn't alleviate your hardship, at least things are starting to move forwards.
