    • Hopefully by mid July my credit file should be cleansed. They have said it takes 56 days or they have 56 days. That should be the end of it. I asked if I could have an apology and be compensated. I got a 'we are sorry for the inconvenience' and all we can offer is a £20 voucher to use on studio. I said thanks but I'd rather boil my eyes in acid than shop with you. I wasn't expecting them to compensate anyway, I just thought I'd ask. I just want my credit file sorted, my account closed so I can put this mess to bed. Thanks for the help, hand hold and encouragement, it has been very much appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

And so begins another fight with another DCA, this time regarding a debt with T-Mobile. I did have a contract with them back in April 2004, and got a bit silly and ran up a bill of £730 which my parents bailed me out. Now Lowell's have been sending their usual threat-o-gram letters saying I owe them £100, now I know fine well the bill was settled and having checked my credit report, there is NO information from T-Mobile, other than my current contract which is up to date and in the green. Now if there was any outstanding debt, surely T-Mobile wouldn't give me another contract?

I've gone one better and went straight to the source, unfortunately I've forgotten the password on the account and have to have reset before they can look into it. Incidently, this turned up this morning:

Lol, thanks Sam, if I do indeed owe T-Mobile any money (even though I know I don't) I'll happily stump up the 100 quid and pay them directly, no DCA on this planet is getting money from me :D

Letter's in the process of being delivered according to Track & Trace, I'd of rather gave them a nice wake up call yesterday with it being a Monday, but never mind, I eagerly await their response, if any.

I was thinking along the lines of "Please don't threaten me with doorstep calls, as you and I both know that you have no legal powers to do so, and I don't think the OFT or TS would be too happy if you were caught". Might write it in crayon :D

T-Mobile rang me yesterday afternoon, and having checked the old account there is indeed an O/S balance on the account, so looks like I'm gonna have to cough up. Asked the bloke if I could pay T-Mobile directly, but alas as it's been passed on to the leeches, I have to speak to them. Damn, I was really hoping to win this one, but never mind.

Hi JF4L,

 

If your parents paid off the balance in full then how can you still have £100 outstanding? I would SAR T-Mobile like BankFodder says and see why the money is owed if at all.

I only assumed the balance was paid off as I heard nothing from T-Mobile or indeed any DCA til 3 weeks ago. If I owe them money then I'm quite happy to pay it.

IF you have to pay the losers,hold off for as long as you can,and get it reduced.the bar stools prob brought it for a tenner:mad:make them waste at least that amount on postage:rolleyes:

 

do agree though.why would they give you a new contract IF you had a outstanding balance,and remind them that you did not get noa;)

This is the first I've heard of this, I'm gonna CCA them, but I also want to make it clear that their threats mean nothing. Any ideas for a strongly worded letter?

ask then to take you to court,ask them how much it will cost them and offer that amount,as its not going to happen.

address cca request to samantha swallow.so she can confirm quicker that they have not got a hope in hell of producing one.

tell her to inform hamptons desk and red desk that you are waiting for your cca.so dont bother sending more threats from table 2 and 3.

Dear Sir/Madam

 

I am writing regarding the letter you sent me on 15/03/2009 about a debt I allegedly owe to Capital One. I hereby state that I do not acknowledge this debt, as this is the first time you have contacted me about it, and until you can supply me with adequate proof that the debt is mine, you cannot legally enforce it. I require A TRUE SIGNED COPY of the original Consumer Credit Agreement, as outlined in the CCA 1974, and not some crappy photocopy of an application form, along with a Notice of Assignment which I have failed to receive. I would also like to draw to your attention the “threats” you outlined in your previous letter:-

 

1. Instructing a bailiff/sheriff to remove goods from your premises (The house I reside in doesn’t belong to me, nor does anything contained within it)

2. Obtain a charge against your property (Again, the house isn’t mine so I fail to see how this will be done)

3. Deduct payments from your salary (I’m not working, so you won’t be doing that)

4. Obtain payments through your bank account (See point 3)

5. Request your attendance in court (Please do, because I know without a valid CCA, you haven’t got a leg to stand on)

 

As you can probably tell, I don’t take your empty threats seriously, given the fact YOU HAVE NO LEGAL POWERS WHATSOEVER. I will be instructing my solicitor to act on my behalf on this matter.
