So after a 14 day investigation with p2g i had a live chat with them yesterday ( 8th June) who said they didnt know where the parcel was but closed the case as i didnt take out their protectiove insurance.  So now at 07.33 on the 9th of june i was repling to this thread with all the relivent information to start a claim and i check the tracking of the 'Lost' parcel for specific dates to find the tracking has updated and the parcel is now at the recipients local depot  ? which is annoying because ive already refunded the buyer as i didnt want any negative feedback as it was an ebay listing and id want a refund if i was in his postion. So i posted the parcel with Evri on the 20/5/24  The delivery date was missed due to it being sent to the wrong depot and a case was opened on the 25/5/24 14 Investigation failed to locate the item in Evri's system and case closed on the 8/6/24 and now the tracking has updated on the 8th saying its at the recipients depot so is likey to receive it in the next few days .... Typical.  Oh well nevermind , thanks everyone

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all!

 

Am currently looking for advice re Abbey - having a nightmare with them! My OH has an current account with them - no overdraft just simple debit card etc. They are looking to charge OH in excess of 200 quid this month alone (bounced DD's etc), mainly 35 quid a time, some at 25 and some at 5.00. EH? Why all different? Am planning on trying to get charges refunded - will do some research first though.

 

But before we start the big one, have a small issue currently to deal with that I don't understand. They have charged OH £35 for a returned DD of approx £40. this is despite - according to the latest statement - having cleared funds of more than twice that in the account. (a cheque had been paid in 2 days previously, but despite taking that away, I still get cleared funds showing when subtract all transactions from the amount in his account!) Why else would they return a DD? Can I just go steaming in and demand answers on this one?

 

All advice v gratefully received!

But even if I ignore the cheque, pretend that was never paid in, there were still cleared funds in there! They surely can't bounce a DD and charge for it if the money is in the account, clear and ready to use, just cos they feel like it!!! That seems a little harsh (even for Abbey!)

Bursts out laughin - :D:D:D - shabbey once send my wages back because they said I had too much in my basic account, and of course they did not bother to tell me, and they charged me for the priviledge.

 

Needless to say my dealings with this idiot bank was short lived, I now have an account with 90p in and make them send me a statement every month at their expense - petty and a waste of trees but I really dont care:)

Ah! That good a bank! Forgive my naivety.... Will shortly be doing the same with them - OH opening other bank account today so will be free from Abbey... Of course, will be stuck with someone else but we know more now and hopefully won't get taken for a ride too often with new bank! bring back a barter society...!;)

If you bothered to read your terms and conditions leaflet you would discover why the charges are different amounts. Perhaps you will manage your new account better in future although somehow i very much doubt it.

 

How dare you judge people like that.:-x

 

The poster has stated that there WAS enough money in the account - it would appear to be an error by the bank.

 

This site is here to help people, no matter what their circumstances.

 

So you can take your holier-than-thou attitude elsewhere thanks.

Only just joined this forum as im getting really fed up with where i work. Abbey cashiers or CSA's as they are known do indeed have targets. Each day they must make a minimum of 4 referals. That means either booking an appointment or the customer sees someone on the spot. Failure to continually meet these targets will lead to you being 'performance managed'. Their bonus scheme is linked to their referals and % over target. They also are required to fill out various questionnaires while you are at the counter. These will cover savings, mortgages etc. On some days they will have a 'race day' and gain prizes for doing the most.

I work for Abbey. Im not surprised at the trouble you are having. Myself and my colleagues are at our wits end with the way we have to do things. The Indian call centre contract was supposed to have ended in May and we were told that it was being moved back to the UK.

 

Im not sure if this right section to vent my anger as an employee but there are so many things that are wrong and they prevent us from doing a proper job. As a member of staff im disgusted with the way the customer is treated and that there is little we can do. It is not the staffs fault that we cant serve the customer in the manner they deserve as we are not given the right tools to do the job.

 

 

So given your insider knowledge, how about you telling us how easy it is to run up unlawful penalty charges?

Yes absolutely right.

"People are unable to control their own money"

 

Because banks take it routinely in charges that are not in proportion to default costs.

But lets just remind you where you are-The Consumer Action Group website........where there are upwards of 200,000k others who "are unable to control their own money"

 

If Abbey are worth defending with the gusto that you continually show-maybe it would be a reminder for you to go and look at your first posts on joining.

 

Seems you have problems with your memory-but obviously not with loyalties.
