First job - off to Botswana for a week to see the elephants.   Of course the paid volunteers going to Botswana are meaningless - Rwanda have REPEATEDLY said they wont take any forcibly trafficked people in breach of international law eh? Have the poops actually got any civil servants to agree to go yet - probably end up as more massive payments to VIPal contractors to go and sit there doing nowt shortly eh?    
    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

 

I am new here so hope i am doing all this correctly.

 

I like many other people have been silly and caught up in the payday loan trap. I have every intention of paying the money back but i am unable to afford to pay these back due to other debts that i am paying off monthly. I am unable to use the extension process either.

 

My loans are:

 

Poundstillpayday - £780

QuickQuid - £625

Payday UK - £425

 

Some come out via direct debit and some via my debit card. I wondered if i should cancel the direct debits via my bank and also cancel my debit card to ensure that they do not take payment?

 

I also wanted to know if anyone knew of a template letter i could send them stating i am unable to pay and can pay £100 a month from 27/02/2009 until all loans and interests are paid off.

 

Any help would be great as they are due this friday (30/01/2009) and i would like to cancel my debit card and get a new one by then so i can continue paying other debts on payday and do not miss any payments.

New to this too, but i too am in the exact same situation with about 1800 pounds of payday loans, spoke to a debt management company today for some advise and they advised me indirectly to lose my debit card and cancel direct debits and then call them putting in writing also to explain my proposal , at least you have made some sort of offer , they were really helpful they are called Relax Finance and offered some good advice, i know it can be a real nightmare , so this is what i have done cancelled my card and dd, and will call them tomorrow, keep me posted how you get on , and keep ure chin up

just cancel your deit card and the direcrt debits and send them what you can afford each month by cheque or postal order

I am just wondering how you got on?

 

I am in the same boat as you, have just posted my thread on probably the wrong page but am here now, so here goes.

 

I am disabled with MS. I have my disability benefits paid direct to my bank. Yesterday I realised that I would not have enought money this month to repay wonga. It was too late to do anything about it last night, so i thought i could sort it out today.

My benefits were paid to my bank account last night and before i had a chance to try to sort anything out, Wonga took every penny out of my bank account, even went in to my overdraft facility , which I never usualy use.

They even sent me an email to tell me that they would be attempting to take £95 plus £10 administration charge plus accruing interest on 1st Feb which is this sunday. They have also now left me in debt to my bank for £119, which just now makes the matter worse.

 

I do not get any more money now untill 28th Feb, so they have really left me high and dry.

I can only assume that when they could not get the £655 they should have got pais, they must have just kept trying different amounts untill they had obtained all that the bank would allow.

 

I am in a state now. good advise would be usefull.

Should I now say my debit card is lost to my bank to prevent them trying again and write to them to offer to pay the £95 next month. Does any one think this would be acceptable to them.

I am so sorry for everything you have had to go through with these payday companies.

 

I am not very good with things like this that is why i posted here - hopefully someone more experienced will come along to offer advice.

 

I cancelled my direct debits with the pay day companies and also 'lost' my debit card. I have written to all companies involved by recorded delivery baring pounds till payday who will not give an address and insist on email. I am waiting for them all to reply now and let me know if they will accept a monthly payement.

 

Let me know how you get on. I didnt think that payday companies could take your benifit money but other people will know more. Everyone is so helpful here!

Hi to all

I am further down the line than you guys. I came to the conclusion in November that I needed to short myself out for once and for all. I really thought about what I should do with all of my creditors and i got advice from some (free) debt organiasations. On their advice I stopped any cheques and I cancelled the direct debits. I told the bank my card was lost and they sent me a new one. I changed my home phone number (oh yes I did!). I then accessed the sites if I could and changed my phone numbers if i could deleteing work ones. I then e mailed the 4 companies and told them of my financial position, that I would like to go into a repayment scheme with them and that I would only deal with them by e mail or post. I asked them for bank details so I could set up a standing order and sent them a financial statement so they could see my problems.

The outcomes are as follows

A flurry of e mails and threats-attempted phone calls to any numbers they have including friends you may have used as reference (This is against code of practices). Constant mobile calls.

My answers were-continue to communicate with them by e mail

Send them the harrassment template letters and letters point out they are in breach of various guidelines.

Contine to offer to come to an agreement with them

Keep all records of e mails and correspondence-do not phone them or answer calls as you will have no records of what was said.

If they threaten you send them one of the template letters-threaten to report them to OFT etc

Some will insist they can't send you payment books or bank details hold your ground until they do. At some point they may pass your case to a DCA-if so ok-negotiate the payment with them and send a financial statement.

If they phone friends then just tell them the truth-remember they are your friends they will help-tell them if they phone again to ask them not to do so again. make a note of the time and date of the call.Then you send them a harrassment letter-the worst for this is PTP.

 

Progress so far-now in payment arrangements with 2 of them-still negotiating with other two-but at least I can pay my mortgage now.

My advice to all-it is time consuming, drastic and scary but be brave and download all of the relevant templates from this site. My phone calls have now stopped and I feel so relieved-I'm just sorry I didn't do it 6 months earlier as I wouldn't have owed them so much.

Hi,

 

I am all new to this but I am having countless problems with Pounds till pay day!

 

I am trying to work out a monthly payment plan with them but they keep threatening to pass my debt on to other company who will turn up to my work and demand money???

 

I have sent a few emails advising them of my situation and that it is a legal for someone to turn up to my work place demanding money but the only response I get is to speak to my account manager who is making the threats!!

 

Apart from sending emails and I will also write a letter how else can I stop them from making sure noone turns up at my work place???

 

The worst thing I did was get involved with Pounds till pay day!!

Hey guys. I've never posted on here but I want to give something back because I have had several CCA cases WON and I have had about 10K of debt drop off my credit file.

 

I used to have a pay day loan with pounds till pay day and I just simply ignored them. They did go away. If you have ever spoken to them on the phone you will realise they are not in this country which raises some legalities over the Credit Agreement.

My personal experience with quick quid, I had an loan of £375 with them which they allowed me to freeze and break down into smaller payments so that I could manage it.

 

As far as my Pounds till payday and payday express loans go I am still trying to get an agreement from them. So anyone who has had experience with them help would be appriciated.
