    • The Private Parking Code of Parking has been postponed as the poor dears are frightened that thew will all go out of business once it becomes Law. We all wish but nothing could be further from the truth so doubtless most of them will have to change their ways if they don't want to be removed as approved parking companies. Thank you for still retaining and producing the original PCN which, no surprise, fails to comply with the Protection of Freedoms Act 2012 Schedule 4. [It even states the vehicle "breeched" the terms  when it was the driver that allegedly breached the terms}. It fails to specify the Parking Period and whilst it does show the arrival and departure ANPR times on the photographs [that I cannot read] they do not include how long you actually parked nor was it specified on the Notice  [photos don't count]. So that means that you spent even less time parked though it would help had you not blocked out the dates and times, so good if you could please include them on your next  post. Pofa  asks the driver to pay the charge S( [2][b] which your PCN doesn't though they do ask the keeper to pay.and they have missed out theses words in parentheses S9[2][f] ii)  (ii)the creditor does not know both the name of the driver and a current address for service for the driver, the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid; All of those errors mean that the cannot transfer the charge from the driver to the keeper. Only the driver is now responsible . What a rubbish Claim Form -doesn't even give the date of the event which it should.  
    • it doesn't matter what you are being charged or if you missed the discount period. you ain't paying anyway..... if this ever gets before a judge. then the ins and out of POFA2012 or any IPC/BPA guidelines might come into play. until then i go get on with your life. you are spending far too much time on a speculative invoice scan scheme  its almost as if you believe these are fines and enforceable in a criminal court and you could have bailiffs at your door any minute.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Seeing as the courts lost my original warrant I thought I would try a different approach to get my money. E-mail sent to Brian and David today.

 

Dear Mr Smith,

I write with reference to the above claim which was heard in the Bristol County Court 22 May 2007. You will be aware, from your representative that attended the hearing that judgement was entered against CitiFinancial in my favour in the sum of £905.80.

Please note that to date I have not received this money, and if I do not receive this payment within 7 days you leave me with no alternative than to initiate enforcement proceedings.

That's about how long I waited for mine. Judgment 29th June, order typed up 12th July, received 14th July.

I waited over 28 days until I applied for 1st warrnat so they have CCj on record for 6 years ;)

Today I received at last a Court payment in cheque form with all the additional costs from Citi.

After issusing two Warrents against CitiCards their had to pay. Salford is the mainstay.

The second warrent did the works (issued to Salford address).

As the courts received payment on the 24th July,by bailiffs, the money was'nt released until the 7th August. Its only now that I have the cheque.

The process is so slow?

Don't lose any sleep over it! Just attack SALFORD OFFICE with Brian in mind.

I phoned the court today asking about where the judgement order was.

It was sent out yesterday 15th August. The lady said "you have been caught in our queue". On 26th July I got judgement, giving Citi til 9th August to pay. The order letter went out yesterday 15th !!!!!! 3 weeks to send out a very standard letter.

Citi will only pay when they get the order.

Imagine you had a shop.... customer asks for you most popular/ordinary product... a loaf of bread... "you can have it in 14 days, but I might not bake it for 3 weeks, and then you may not get it for 5 or 6 weeks". The shop wouldn't last a week. Somebody else would figure out how to get up at 4.00 and bake enough bread for the people likely to want it today. BINGO.

The courts are in a dreadful mess. "But we are selling lots of loaves". Well buy a bigger oven or get up earlier. The whole process is comical, because Northampton are processing new MCOL claims overnight, but they will hang around in the courts now for years. Northampton is collecting lots of £80 and £120 fees for the government

AFAIK and confirmed by Ice below the warrant should be for the Salford address. The offices they have are not part of Citicard, they are citifinance the loans bit, but if you are in scotland they may be different.

I originally started sueing CITI's Sunderland office as that was where I had been sending my payments. After the whole hassle of CITI losing by default and sending the Extract for payment to Sunderland and nothing happening. The Scottish sheriff officers told me they had no jurisdiction South of the Border. Someone suggested I sue the Dundee office, which I did then action happen ed. The court received a letter stating CITI had never received any paperwork ( regardless of all the signed receipts I had frpom rec.dely.) The court out of the goodness of their heart allowed another case. Again after all kinds not turning up at court. They lost by default.So now we are at the bailiff stage unfortunately they have closed the DUNdee office so that is why we are going after the Falkirk office.

Shortly I am off to court again this time it is not a bank but BT who let me go for 8 weeks without a telephone line owing to their incompetence and as it was a business line decided to give me £ 33 compnsation. Tha is another long story. This time I used a London firm of officers to serve the notice this cost me £ 80 plus VAT =£ 94 when the Scottish sheriff officers oly cost £ 34.37 So that is my story up to date.

Gizmo111 Well just back from court in my case against BT have to go back again on14th. Sept for the full hearing bloody annoying. Good luck with the warrent and the bailiffs on your CITI suit. Have not heard yet when the bailiffs are going on my case.

And finally 15 months after the prelim request, 2 court hearings and one baliff being sent in I today received my chq, which had been sent to the court 2 weeks ago.

Looks like we've all had a successful week, as Citi say they have settled mine as well.

 

Waiting for statements to come through to confirm they have deducted the amount from my ever diminishing balance.

 

I'm so happy I feel like sending Brian a Christmas card, or would that be taking the pee too much.

Advice offered by ENRON is without prejudice and is for your judgement as to whether to take it. You should seek the assistance or hire of a solicitor or other paid professional if in doubt.
