OK, the application went in fine and now I have a hearing date - which is a good start I suppose.

 

Presumably the date of the hearing will have been sent to 1st crud as well - will they now have to decide if they attend or not?

 

Still no CCA so far either.

 

What do I do now?

Is it now appropriate to update this to a won?

 

Got a letter from the in-house slicitors saying that since they can't find the paperwork they won't be opposing the set aside.

 

They have also noted the comments on the set aside application and agree that the appropriate place to resolve disputed debts is the County Court system.

 

Also, they don't want costs awarded against them and don't want to waste the courts time!!! Why issue it then.

 

Can I still go for costs? How do I now do this? Can I turn up to the hearing and claim them? How much?

PS: Please write the documents in YOUR OWN STYLE and do not lift straight from the site, however tempting. If they see that it is a direct lift then they'll probably attend.

Can someone help with a 'formula' for litigant in person costs for this type of matter? Or a link to an informative thread?

 

I intend to fax the court the day before with my costs application/breakdown.

I found an N260 form on the Court website, you can fill it online and print it out./HMCSCourtFinder/tiles/Her Majesty's Courts Service -Forms and Guidance

I asked for £9.25ph as Litigant in Person;under the fee earners column,

Work done on document column, put the total number of hours @9.25,

Attendance at hearing column; I put 0.50,

Hours travelling & waiting 2.50,

Other expenses; I included; loss of wages, fuel, parking & photocopying.

Dibs.
