What is less superb is the way you jump from one to the other and back again, so I haven't changed your words, but I have moved the paragraphs around and given each section a heading. New bits are shown in red. Crossed out crossed out in black is something you've quoted from the government Code of Practice, but that has since been withdrawn so unfortunately that argument has to go. Your paras 7 & 8 don't harm your case but to me are waffle and can go.  Keeping the arguments clear & concise will always impress a judge.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

HI,

Does anyone know how I can get the actual OFT report on the "Unlawful charges" (5th april 2006),made by banks in general,( the Nat west in particular).I have sent 2 letters up to now for a claim on 3 accounts amounting to approx £7,000.00.

I received statement from the year 2002 only,they say it is difficult get the statements from before that, I wrote back insisting I receive all the required statements.But the nat west is Still charging these unlawful charges as I write this.

I`ve got a copy of it, my MP sent me it after he wrote (on my behalf) to the head of the OFT.

It`s not about the banks (although it does refer to them), it`s mainly about credit cards, the bank report will be strarting in a week or so apparently.

Yes the london address in Bishopsgate is the correct one to use as this is the head office address. Good Luck, hope it all goes well.

Wasn't expecting it to be so much, had to suck up to my boyfriend for the money cos I'm REALLY skint (wonder why??)

You can pay via credit or debit card, and can use someone elses card if needs be.

if they've only specified serving proceedings on the head office then send all regular correspondence to the usual address and only serve court proceedings at head office. head office will not be instructed to deal with your claim until proceedings are issued normally.

 

im glad they're responding to you - i've heard nothing, not even received statements!

 

can i have the address for their head office where they accept service of proceedings as i will soon have to serve upon them myself.

i would think it does. lucky you, they haven't replied yet to me! they have until today to reply and if not, i am claiming - have done it all online ready!! (£120 it's going to cost!! ARGH)

 

So, what happens for you now? do they have 28days to enter a defence and if they don't then it should get judged to you on 30th august and they have 14day to pay? is that right??

 

So when i send mine today they have 14days to acknowledge or else i get it judged (hopefully) in my favour??

From what I gather they do have 28 days to enter the defence... it is so much to take in:confused: :confused: :confused: very confusing, and I really hope they pay up cos I go to China on the 2nd September and I could do with my spend!!!:D

and yes, when you do your moneyclaim they have 14 days to acknowledge it otherwise you get the judgment!!

Let me know how you get on.

I've received a NOTICE OF ISSUE from Northampton CC which says:

 

Claim issued on 28th July

sent to defendant by first class post on 28th July

will be deemed to be served on 2nd August

defendant has until 16th August to reply.

Your dates will most probably be the same, but remember as soon as Cobbett's say they are going to defend, they get 28 days which will make it 30th August.

 

So I'm afraid you most probably won't get the money for China.

It started on the 28th July. I wouldn't count on getting the settlement in time for 2nd September. You still have a while to go yet ... mainly due to Natwest\Cobbetts dragging their feet. Expect them to Defend the claim on the very last day ... even the day after the last day (the courts are generally allowing this).
