  4. This is exactly what they told me, i've put this claim on the back burner for a while but i think now i'll start it up again, especially after seeing a few encouraging victories against egg. Not sure if anyone has got their payment protection back yet though Can anyone enlighten me??

    They seem to be asking people to clear their account in their counterclaims, after legal proceedings have begun, therefore it's upto the judge to order you to clear the account (which he\she probably won't). The account is in dispute, i know this means a bank cannot ask you to clear an overdraft, but it may be different to Credit Cards.

  8. Ollie, you should be receiving a cheque or and offer tomorrow ... if not, some time next week ... it may only be for half though, stick it out!

  11. Go for it, expecting a reply to my (second) LBA today ... long story, good luck! They've scared a few people off with this and other tactics, if we just bombard them with all the claims people are putting forward now (and be stubborn with them) we might get somewhere. There scare tactics have worked so far, it's time to show them we have the power!
  12. They responded to my prelim saying they were going to investigate (3 days after my deadline) and that i must send them £10 for my DSIR, which i'd already received and paid for. Stalling tactics as usual.
  13. They'll counter-claim after the MCOL bit (otherwise they'd have nothing to counter claim against). As for you're other questions, i'm not sure, sorry
  14. I think you can ask for more than 6 years back. The 6 years only applies to how long they have to hold information on you. Therefore, if you have your statements from 12 years ago you can claim back the charges
  15. Thanks Yasmin, thats a touch more complicated that mine ... I'm basically saying they are being fraudulent by supplying phoney or insufficient evidence As for precidents, they cannot be set in the small claims court. However, if one case of reclaiming PPI gets through then this will at least give people a template and inspiration to pursue whats theirs!
  16. I think once you've filed your moneyclaim they can't ask for your overdraft to be paid off as the account is in dispute (this maybe the even before moneyclaim). With that said i have NOT seen an example of Natwest asking for overdrafts to be repaid before a settlement.
  17. Cheddar, Thats right, 0.46p per day is from the date the claim is filed ... all other previous interest is covered by the £449.57 bit ... the rest of the claim all seems to be in order.
  18. Hi Yasmin, I read on another thread they dragged some dirt up on your ppi from your original application. What was this dirt? Were you claiming back PPI? Did they claim you'd requested it in your original application? I'm currently in this situation and i feel they've either fabricated evidence i requested PPI or they're telling white lies about how data gets from the on-line application to their account management system. I'm determined to win this but your case did seem a little daunting! Cheers

Chris, have a look on my thread, LAFFAR v's NATWEST, i sent them the account number and the list of charges (again) "for clarity" but refused to answer the complicated law type bit because "i envisage this claim being allocated to the small claims track". There's a template on there for your cannibalisation!
  20. Hi Scotia, What happened with this? Has it been settled? I'm at the same stage as you were on 7th May. Just sent off the LBA. Have already been successful with Natwest, but this seems a different kettle of fish (different laws etc). And it seems a little more daunting as there are a lack of templates here for this kind of thing Cheers
  21. I don't know if any of you are persuing this but the other day i got a very lame attempt at providing "proof" that i requested it. Basically Egg sent me a screen shot with a field entitled "Payment Protection" this field was populated with "Accident, Sickness, Unemployment and Life" and it looks like an editable field. Along with this screen shot was an explaination saying "this was populated by a feed from your on-line application where you requested it, this payment protection cannot be editted manually" However, my Data Protection Act pack didn't contain such a screen shot, it contains others and one that shares data fields with the "proof" one ... so why?? Do you think they may have fabricated this screen, it wouldn't be hard to knock up a Visual Basic prototype to mimic this screen, maybe 10 minutes work.. They're not detering me!!
