      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi

wonder if this is a normal abbey tactic!!!!

called the court to see if abbey returned their AQ which should of been by 4pm on monday 23rd october.

today being the 27th the court said that they have not received it and it will go for the judge to decide.

 

do abbey normally do this and what should i now expect?

really fed up now.

called the court yesterday for any latest news and was told that the court accepted abbey's AQ over 1 week late. when i asked why she could not give me an answer.

anybody know why the court has given them so much slack and what is the point of keeping to the courts dates if they accept things late.

what can i expect next?

 

sorry for being negative but i am really p****d off with them.

hi

recieved a letter from the courts today saying that i have a "small claims track" hearing at court on 9th February 2007 at 11.30am.

after reading other threads i noticed that both parties have to file their documents etc 14 days before the hearing but mine have to be in by 15th December, thats almost 2 months before. is this normal?

 

Also, except for the few letters they sent to me plus my statements what else can i use as evidence and is there any threads which can help for this.

court letter said we should try to settle the case and we should contact each other. does anyone have the phone numbers for the people now acting for abbey.

 

please help

please if someone knows who is dealing for abbey now could they please let me know as i would like to atleast give them a chance of offering me a 100% settlement. after all the judge did say we ought to try

Dont hold your breath. I think Christine has a very long list of people to get back to and personally I think it depends on your court date as to when she gets back to you. From what I have read and my own experience she wont get back to you until very near to your court date. I may be wrong and its worth a try anyway.

phoned abbey last friday to discuss my case as the judge recommended. at least if it goes to court then i can say i tried to talk to them.

spoke to woman there and basically she asked if i was open to offers.

i said it depends what the offer was.

she said she would get back to me about it (still waiting) but i said that as court details have to be in by december 15th i will give them until december 1st to make an acceptable offer.

thanks for that.

not started my court bundle yet cause waiting for abbey to respond but as i said they have until 1st december then i start getting things together. dont know what i need yet but will have to ask these great guys here for help on this one.

i'm at similar stage my court date is 18th dec so i really need to get started on my court bundle. Think there is a thread listing some of what you need- i will look for it. Its harder to do this bit, dont you agree. Its all starting to seem too real. i really hope i dont have to go the court but as christine hasnt called me back and now the phone goes straight to answerphone i think i need to prepare for the worst. will keep you posted and good luck.

GUESS WHAT. THEY HAVE NOT DONE IT.

what happens now?

i assume they will rely purely on their 2 page defence they sent to me about 3 months ago..

anybody have any ideas

as abbey failed to send their bundles in on time i decided to call christine and remind them.

seems a nice person and we are in discussion for a settlement --- i hope.

if it all comes off i was thinking of doing birmingham midshires for charges on my mortgage. anyone know if that is possible

letter from courts saying that abbey have just 2 weeks to comply with sending court documents or else case will be awarded to me.

phoned abbey 4 times in last week to settle but they say will ring back.

told them today that if they dont call me today then i will see them in court on feb 7

just had a nice long discussion with abbey and they have SETTLED ON 95%. I WONNNNNNNN.
