Hi all

 

I have decided to try get some of the extortionate charges back from this unscrupulous company. They were like predators to prey, talk about kicking a person whislt they down :-x

 

Anyway DPA / SAR letter to bo posted tommorow (17/07/06) and even if i get not a penny back it will be worth letting them squirm for a while like they made us :lol:

yep me too! im after swift advances but prior to seeing this thread i have recently (saturday) posted my S.A.R. to the 'old address in Hornchurch?

 

Shall i see if the post office can check to see if it has been cashed?

If they have only just moved then is it possible they have mail still being forwarded?

Hi feeling fine

I would send your sar to there new address becouse I sent my original one to the old address and was informed they had moved by the postoffice that is why I sent another send it recorded delivery mine was deemed served on them on the 31st July.

HI oh well after what seemed like an eternity (probably cos i sent the letter without the cheque at first , how dumb lol) i have finally got the statement and oh my lordy what a load of squibble. Codes that are not identified, every convo we had reduced down to txt tlk lol

 

Anyway i will spend next day going over it but one question....is it normal to pay 1,044.00 pounds for a default charge? Also there are 2 collection charges one 1,100.00 and one 1,374.78. Are these because it was redeemed early? If so why would there be 2?

No!

 

Do they actually refer to this as a default charge? .... if so makes things much easier for you as they admit the the charge is related to a breach! Silly fools lol

 

Not had any dealings with Swift and not heard of Colections charges but sound pretty sus to me. If you can relate them to a breach of contract then the bank have to demonstrate they were a genuine pre-estimate of their loss.

Yeah we were 2 months in arrears, we made an agreement that we could side step the mortgage payments in order to pay new mortgage fees etc for 2 months as long as we either redeemed or payed arears in full if no redemption went thru

I have just been told on good authority that these are not a collection charge ,

What they are is a penalty charge for being in arreas so much per month multiplied by the months you are in arreas (if youve still got your original contract you will find that it is mentioned).

However just like they have tried to call your redemption charge interest they have invented a new name for this charge because they know they are in the wrong.

 

If it walks like a duck quacks like a duck and looks like a duck its a duck calling it a giraffe wont make any difference.

 

 

I have been told on good authority that a lot of Mortgage companies are trying to

disguise there penalty charges by calling them something else.

thanks for that Paul, so where do we stand on claiming it back then....they have recieved my "can i have my money back plase letter" yesterday and i have included them charges in the total.

Having had a nice letter apologising for my complaint, they have given me....yes they given me till 21 sept till the answer lol

 

Took no notice (as they took none from me when i was drowning) and have continued with my process and timings as stated in letter asking for payment. They now have till 18sept to pay up or go court!
