      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

:confused:help i am new and just started to make a claim against abbey. i have sent the initial letter and they sent the normale response stating i woul dhave to pay more for what i want. i then sent them the second recorded delivery letter asking for a proper response and i am still waiting.What do i do next as now they are getting nasty !!! They have found a 9 year old closed account where i made many attempts to pay but no one could give me a suitbale answer of how to arrange this, and sent it to a collection department demanding all monies in a week or ccj ?? They have put a stop on me transfering monies between my abbey account without me going into the bank and not over phone as i have done so many times before the letters:-x

Finally they are putting a block on my account if they have to return a direct debit!!!

please help what do i do after the second data protection request letter

Hi georgie and welcome to the site,

 

Read as many posts as you can on this site as it will give you lots of answers as well as questions. I have just sent my second DPA letter and will now take action against them in the small claims court if they do not comply. Don't worry it is just shabby putting pressure on you, pretty sure as soon as you put in a DPA request to them now, they know you are after your charges back. Stick at it and good luck.

yes this was a bank account that was agreed to be closed to allow me time to pay the charges on it as i was overdraw over my overdraft and with problems at work and money being cut i could not afford to pay charges, so the citizen advice bureau agreed with abbey to allow me to have an instant plus account.i contacted them and was making payment of £50 manually over the phone each month, however each month it would be moved from department and get harder and harder for someone to take this from me. i contacted the collection group working on behalf of abbey and they were given the account 63days ago. Abbey stated they could not find me even tho i have 2 other account registered to my address ??Now abbey want the outstandgin amount in full or baliffs visit ???i have haad no previous letters from abbey, i moved address 4 yrs ago and abbey were infmd and no other contact re this old 9yr account.general amount is £1200 as no contact was made from them at all re this.it was not an instant plus account.

hi

me again i have recieved a letter from abbey stating somehting about micrfishe and not being able to provide ne with the information i require as it is not covered by the DPA. howevre they are making arrangment. i have caculated my amount so far and it is £3,700 without calculating the 8%.how do i do that and should i wait for them to c0pkly which may be in due course.although no date mentioned ???

I know this will sound harsh but go read the FAQs which tells you more or less the process for making a claim, what happens when they send a microfiche leter etc.

 

Im new too but with an evening or twos reading and research you will be much more confident and have a good idea of the porcess, what the banks do to try to cause you greif, in fact the whole 9 yards.

 

When youve done that come back and ask for the details which arent filled in.

1st credit are asking for it on behalf of abbey.i have tried to speak to abbey to discuss what letters they have sent to my previous address and no one can help me ? when i move in 2002 i did have all my post redirected for over a year and no post was recieved ? what do i do with the DCA now ??

they have sent me a letter and in my panic i rang them and the stated they would accept a smaller amount in 28 days to clear the account.they did state baliffs and ccj. the correct amount is £1,300 however they will accept £850 ??

hi

i have just discovered the letter regarding the microfische fob off! should i send this letter or just go for it and fill out the n1 form?? Other than the amount how do i claim the 8% and the extre £10 is it quite self explanitory ??

the amount of £3,700 go back 6 year , i have searched high and low for anyhting that resembles a statement and have been impressed i kept so many. this ia waht i have calculated, however there are gaps?

You need to do a request under the 1974 consumer credit act for the info they have.

 

Copy agreement of original creditor

 

Deed of assignment

 

Default notice

 

They are obliged to send these within 30 days.

I would also send a request for deed of assignment and default notice to the original creditor.

 

At all times do not acknowledge you agree with the debt....you are questioning it.

Help i have been away and forgotten what to do next.i have calculated what abbey owes me but what letter to use? the interest amount seems very low as i did not have an authorised over draft.it seemed only a few pence each month! is it worth calculating these

Ditto.........whilst you may have been away and forgotten what to do......the banks unfortunately remain on the ball in looking for good excuses to stall.

 

Their efforts to do this can be lessened by a claimant who knows what they are doing..........dont give them reasons to choose you !!

please help i have had letter offering me gesture of goowill and the money has been paid into my account without me agreeing. How do i stand ? i want to pursue my action but they have paid me the money i did not agree to !!!

Ok dont panic.......work out what they have paid and adjust this on your claim.

carry on for the rest.

 

so say the claim was for 760 and they have paid 200 then you are still claiming 560

 

 

carry on as schedule and just adjust the figures

Are their willing to pay the full amount?And you are still to send the LBA letter,..Are shabbey changing tactics,..

Yes i am still sending the LBA letter and have stated they are not paying the full amount.i was thrown but this tactic ! I have read they are starting to do this to put people off but the still owe me over £3000 .:mad:
