      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Surely the N244 route is only viable if you have not claimed the full 6 years !!!!!!

 

As i have claimed 6 years to the day, I have no chance in adding more charges to the claim.

 

So do I start a totaly new claim after the current one is finished ???

I spoke to the nice lady at the Court about that one, I'm guessing that you can add anything since the claim as it is on going? Ask the Court or check with a Mod. I would play the ongoing claim routine. I plan to write to Cobblers in a 'without prejudice' letter informing them of my intention (well, I might actually phone them first) to put in an N244, but I need to time it right so that they pay up before I get any more charges:evil: !

can't decide if it's worth me going that far back, now if I could go back to my student daze......Think I've been a good boy-ish since I left Uni in 94, but I would be interested to see...do you know how far back the RBS keep their records?

I spoke to Ms B yesterday to get clarification that she had rec my further info I faxed.

She appeared very calm and composed........not a hint of pressure at all which is amazing considering what her workload must be not only with Rbs cases but Natwest as well

I'm just musing over sending Ms B an email informing her of my intention to raise an N244 for further charges incurred during this faff. Is that a good idea or do you think I should give her a call or just complete the N244 and let the Court decide?

Just been reading your post to get as much info as poss. I calculated the intrest wrong when I put in the claim. I calculated £40 and have now discovered it is more that £600!!! I will ask the court to consider adjusting the claim to show this. What do you think my chances are?!?!?

The N244 is on the HMCS website as well, easiest way to find it is search for N244 and it comes up with the adobe file, download it, save it and apply at your leisure!!

just got letter from the court.... after being told it was £35 to ammend the claim, they've now told me it will cost another £30... dunno if thats because ive got a hearing booked already or what?

I spoke to the Court and they are very helpful, not sure what the extra £30 is for. When I asked about the N244, I was told that the Judge would consider it on the day of the hearing!! Got my court date and we've been allocated a WHOLE 15 minutes!!

stacey, yeah, but unfortuanatley its less than what im getting charged on my credit card!... ive moved from manc to london since my claim started, think they think i wont want to turn up or something....wrong!... think itll be worth a holiday day off work and a virgin value return from london!.....just in process of writing my witness statement, my step mum, who's a county court judge is gonna hav a look at it for me....

 

well cant make me wait much longer, my court dates the 11th of Nov...cant remember whos thread it was but sum1 had court date, and sum1 from cobbetts or rbs offered a settlement outside the court room... surely the courts and judges etc must start getting pi**ed off with Cobbetts wasting their time and resources!
