      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

UPDATE

 

I recieved another response to my PPI claim today pass as to what it was in response to though as since i handed it to the FOS ive not sent them anymore letters.

 

Anyway they have sent further copies of my agreements but in a previous letter from them they said they did not hold records on one of them so have only sent 8 agreements out.

 

Today i have 9 now in total which is all of them what the hell is going on there ?

 

So i will now add that to my claim and send a letter with a copy to the FOS.

UPDATE

 

Hiya All

 

I received a letter dated the 9th Jan on Friday stating among other things that all further collection activity will be suspended for the time being.

 

So i stupidly thought great but low and behold another threat letter arrives in the post today dated 16th Jan.

 

Too good to be true aye still at least i have now got it in writing.

their is no time limit on complaints handed to the FOS to investigate in fact their is a backlog of 6 to 9 mths

UPDATE

 

Today i received a very apologetic letter stating that they have received my letter on the 14th January 2009 ? what letter is this there new tactic reply to letters that have not been sent in the hope that it will show they are dealing with my complaint.

 

Goes on about timescales as laid down by the FSA LOL think they are well passed those.

UPDATE

 

Hiya All,

 

Well now is the time to get a solicitor on this claim because today i recieved 2 letters from the Co-operative Bank one was saying i have 7 days to pay off the overdraft or they will have no choice but to close my account.

 

The other letter goes on about court it was specifically aimed at my loan account as that was the number quoted.

 

Funny that because they got a letter from the FOS on the 15th Jan i know this because i phoned the FOS yesterday and they told me they requested information from them on the 14th January i also got a letter from the FOS on the 15th January telling me that they will now seek information from the Co-op.

 

Also since the 15th January letters and phone calls from the co-op have been arriving by the bucket load.

 

Anyway they now say that they are giving it serious consideration to take the matter to court i hope they do to be honest perhaps then the harrasment will stop and i can counter claim the judge will see clearly my medical condition and i have loads of evidance to produce in court.

 

So Co-op bring it on

Hiya All

 

I received a strange letter today from the Co-op referring to a claim i made on my PPI on the 04/12/08 What claim ? if i have been trying to get the 9 premiums refunded since 09/08 why would i be claiming on the insurance.

 

I tried to claim way back in 09/07 but was turned down due to previous medical conditions which is why im claiming the premiums back.

 

The letter is from head of debt management a Val McCarren ? what has she got to do with insurance claims ?

 

I smell a rat

 

Is this an attempt to veto my claim with the FOS ?

 

I think so

 

My patience with the co-op is wearing thin

 

Your thoughts on this are appreciated

Hiya All

 

I'm in the process of typing another letter to the FOS including all the latest letters I've had from the Co-op.

 

Now I've also noticed the default notice from them is duff it is dated the 4th December 2008 but gives a remedy date of the 18th December 2008 so again no time been given for service even if it arrived though my door the day after that would only give 13 days.

 

Im also not sure if they should of issued it being as this case is now with the FOS.

 

Do you think i should send a letter to the Co-op Bank pointing this error out to them and find out if a marker has been put on my file and if it has ask them to remove it and send me evidence that it has been done ?

Just checked my loan account online and they have credited my account with £914.20 ? now im guessing that this is PPI but the policy cost £1511.27 plus there are 12 mths of interest payments on this so i dont know where they got that figure from.

 

Also as my complaint is being handled by the FOS now im not sure they can do that anyway ?

 

Would of been nice of them to inform me of this too.

I write this letter about two very important issues which have come to light recently.

 

Firstly I refer to the default notice you sent to me in December 2008, this notice is erroneous as it is dated the 4th December 2008 and gives a date of the 18th December 2008 to remedy.

 

I’m sure that you are aware of the Consumer Credit (Enforcement, Default and Termination Notices) Regulations 1983 in which it states a period of not less than 14 days after service.

 

As the earliest this could of got to me and be served was the 5th December 2008 that would of left only 13 days so this default is clearly in breach of the above law as laid down by parliament.

 

Because of this error I expect any default you have placed on my credit reference files to be removed forthwith I also expect to see evidence that this has been done as failure will entitle me to report this to the ICO.

 

Secondly regarding the above account I have noticed that you have applied a credit of £914.20 I can only assume that this is a part PPI refund as you have not had the decency to inform me of this transaction.

 

As all my 9 PPI policies I’ve had over the last 10 years including this one is being handled by the FOS now due to you not being able to resolve the complaint I had with you I am baffled why you choose to now put a part refund on the account perhaps you would be kind enough to explain why.

 

I will of course inform the FOS that a part refund has been applied and inform them that as my complaint was to do with pre-existing medical conditions as well as other points that a part refund does not reflect what I paid and there is still a balance of £1237.61 to be paid this being the balance of £1511.27 which is £597.07 plus interest and payments made of £640.54.

I look forward to you reply explaining the actions you took.

Hiya all Re posts 167 and 168 ive just check my loan account online and the Co-op have now taken the part payment back and re-applied the PPI.

 

Which i do not mind at all as i can now carry on applying the interest :D and as the FOS are dealing with it now id much rather wait for there outcome.

but surely the FOS has to gather information and documents from both sides before they can make a ruling ? and knowing how long it took the co-op to supply docs to the fos in my case that would take longer than 4 weeks

i had before i refered the complaint to the FOS but now they say i can have the money by chq instead of reduce loan so no way jose this offer did not includemz first loan

This is my response letter to their half backed offer what you think, is it to hard hitting just im now getting really -issed -ff this complaint has been ongoing since last july and no ground has been made since october.

My Complaint Re The Co-operative Bank PLC

Dear Mr P Fleming,

I write further to your letter dated 7th May 2009.

I note that you say the offer made on the 27th October 2008 was fair in your view this I must add is not the case for the following reasons.

On the current loan they have credited to the account £914.20 on the 10th march 2009 so they have kept £597.07 of the PPI premium that is not being put back in the position I would have been had I not had the PPI also since taking out the loan a total of £387.65 in interest at their rate of 10.50% has been paid plus interest at 8% simple £131.12 comes to a grand total of £1116.65

Their offer on this loan only was £345.12.

Now as you can see their offer on this loan only was way out so one can only assume the others are too.

In the copies of letters I have sent to you I have requested information on what the loan and PPI settlement figures were to this date I still have not gained this information until I get this I will not accept any offers.

In their letter dated the 27th October they said and I quote, with the exception of the first loan 80. This is because we do not hold any records of payments etc for this loan as it was closed 8 years ago, Now if that was the case why did a copy of that agreement turn up in the post on the 9th January 2009 it appears to me that they do indeed still hold data on that loan and the agreement in question is more than ample to work out what I’ve paid after all I have worked it out.

The offer they gave me and the offer you say is fair does not include the first loan to which you have a copy off.

Furthermore I sent a subject access request with the £10 fee on the 11th July 2008 which complied with the Data Protection Act 1998, their response was to return the chq with a letter saying I have not sent an S.A.R letter this is untrue and is clearly a delaying tactic.

The S.A.R in question you have a copy off.

It is very clear in their offer what they are offering is the interest already paid at their APR’s applied at the time of loan plus interest at 8% nowhere in the offer does it include the single PPI premium that was front loaded onto the loan hence why I want the settlement figures.

I would also like to point out there offer was made on the 27th October 2008 so the 8% interest in that offer is 6 months out.

This complaint has been ongoing since last July and in that time no ground has been made since last October, What ever came across there minds thinking give them the same offer only in cash and he will go away.

I trust that you will get the settlement figures for me and fully investigate my complaint and not merely take what they are offering as gospel.
