    • Hello, Firstly, and most importantly I am sorry for your loss. I would go back to the bank with the death certificate and ask them to step in. Remind them firmly but politely that there is no limit for DD claims   Please let us know how you get on.
    • My wife is the named person to his bank account with him having Dementia being his daughter (I say named person she still is but he recently passed away and the deputyship application has now being stopped by the solicitor as it's no longer needed) We've only just got the Death Certificate so the bank will be the next step informing them. She went to the bank and explained the situation but even being his named person the bank said she didn't have the power to stop DD without any legal documents (virgin money) was the bank. She could have copies of bank statements that was about it.
    • I see you said you tried to stop the DD but it seems that didn't work. May I please ask why that didn't work? You should be asking your bank to cancel the DD and I don't see why they would have objected, hopefully you can clarify this. I agree that you should be making a claim here against your bank and ask them for a DD refund. There is no timeframes for this.
    • JK: Yeah That's correct. We left rent payment coming out of his bank account from January 2023 - August 2023 until we could find somewhere to sort out his belongings which was fine. I tried to give notice a few times from August 2023 asking for advice from Sanctuary housing how we went about this explaining his condition and that he was in a Nursing home from December 2022. I explained we don't have any legal powers to his account like POT but were in the process of going for Deputyship and that I was the named person to act on his behalf to speak with Santuary housing. I said we could provide details of his condition and proof he was now in a nursing home with date he moved in. This went ignored despite repeated attempts to contact them until a housing manager contacted us end of February 2024 and notice was finally accepted with his tenancy coming to an end March 22 2024. Although they have continued to take rental payments for the flat despite someone else living in it from the 1st April. I wasn't aware payments were still being taken till I checked his May banks statements. I had asked them to back date rental payments to August 2023 when I gave notice rather than just giving notice in March 2024 but they've ignored that bit. I don't see why they shouldn't give it back they've taken money they shouldn't have. Thanks DX, I wasn't aware we could do that for that length of time. I'll ask my wife to check with the bank this week

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Animal Lover,

 

Just been reading your thread and I have a similar situation.

 

I will be interested to know how you get on with CAB and to see if your agreement can be upheld. I bet it cant, they really are a bucketshop. I am convinced they ticked the insurance boxes after we signed as on my copy which is carbonated, the tick impressions are much harder than any other writing on the agreement including our signatures.

 

I wish you luck, keeping my fingers crossed for you that the agreement is in fact unenforcable and you can tell them to stick it where the sun doesnt shine!!

Hi,

 

I've just read the link and it sounds very interesting.

 

Do you think it could apply to my case/agreement? I didn't consent to the PPI or even know about it so nothing was ever mentioned to me about commision or anything. Maybe that's why they just add it so they can get the commission.

i would now be demanding what the true cost of the policy was and what commission was paid

 

they have been getting away with it for years

this will come back to bite them now

 

we need a paper trail to see if you do have official ppi, or welcomes ghost transactions

also the Insurance Premium Tax (IPT). Every single premium policy sold has this insurnace premium tax that the insurer has to pay the tax man.

 

We need to be asking how much of your premium was IPT and who paid the tax man his tax - Welcome or (apparently) the insurer?

 

If Welcome are selling single premium insurance premiums and no actual policies are being opened with Norwich - IS and HOW is the tax man getting his money? For Norwich to be paying the tax man - Welcome would have to pay Norwich for the policy first. Are Welcome are paying the taxman direct?

 

I really must update my Welcome thread - there has been so much to type, with so little time lol. They are idiots.

I'll post a letter to them asking all this but i doubt they'll give it me or maybe even have it as they have apparently sent me all info they have on me in my S.A.R.

 

Any advise on how best to write it would be appreciated i'm not very good at writing these kind of letters.

I have included this in my S.A.R - (Subject Access Request) to Welcome - so that if they cannot/will not provide the info the Information Commissioners Office can have a look see. If they have to admit to the Information Commissioners Office they do not have this info then we have proof certain transactions did not take place. ie opening an actual policy, paying the IPT on that policy premium etc.

Also i'm still getting letters from Global Debt Recovery asking for me to pay this account i've sent 1/2 Account in Dispute letters but they just seem to keep ignoring them.

 

Is there anything else i can do to get them to stop, I've put on the bottom that the ICO and the FOS are dealing with the account like Postggj suggested but still not taking any notice.

in your own words, tell global to bog off

if they carry on with harrasing you, you will send a complaint to the fos and ico

 

on the other hand, ignore global

this is just the threatomatic machine turning out garbage, dont worry about it

 

or send the letter of dispute, looks good for you if needed

I'll post another copy of the account in dispute letter to them if they ignorethis one then i'll ignore them and see what they do next.

 

Recieve letter from FOS saying they have recieved my complaint form and are now looking into it but i haven't heard anthing from the ICO do you think i should call them to see whats happening. I now they have recieved it as i sent it recorded delivey.

Recieved a letter from FOS this morning.

 

They are now asking Welcome Finance for further information once they recieve that then there gonna pass it on to the adjudicators to try and sort out.

 

Fingers crossed it won't take long

its obviouse they dont want to tell you there under hand rip off insurances.

 

its up to you how you play this,

if i were in your position i would write to the dca with a list of the questions and demand an answer from welcome before you consider it.

 

i feel with the embarrasing questions, you have touched a raw nerve and have backed welcome into a corner.

 

think about it and wait for a reply from dipply.

Recieved letter this morning from ICO, I now have a case reference number and they will be passing my complaint to a casework team before it gets allocated to an officer.

 

I've just put on the letter to Global Debt Recovery that now i have confirmation from ICO and FOS that they are looking into the complaints i've raised that i will not consider any offers until both there investigations are complete.

 

Does that sound ok?

Hi animal lover, sorry for the absence, had some troubles, of the kind that even CAG could not help with unfortunately - but am back!

 

Ref the letter to Global, that sounds fine - short and to the point as that is really all they need to know - be sure to use the words 'in dispute'.

 

As for Welcome and this Insurance Premium Tax, I think it could be worth writing to their compliance dept and simply asking them for the following:

 

The name of the Insurance company the policy is held with

How much was paid in Insurance Premium Tax

Did Welcome pay this tax or the Insurer

As a member of the Finance and Leasing Assoc - who is your Code Compliance Officer

When was you last annual statement of compliance submitted to the FLA

 

These are all very specific, simple questions that they can either answer with a simple fact or they can't. I have the bare bones of a letter put together with all this in it and will finish it today and post it here.

 

I will start chipping away at them with this also. My complaint is in, which I will have to update my thread with at some point this century!

 

After the few weeks I've just had, I could chew Welcome out and spit them out - the big boots are back on and am ready for the fight ;).

You reading this welcome? I have fought bigger than you, and I am the original dog with a bone.

 

Apart from that, how are you getting on Animal Lover, things anymore settled?

I wondered where you were I thought you didn't love me anymore lol :D

but don't worry about it, I hope you've managed to sort everything out and i'm glad your back.

 

Ill send that off to Gobal tomorrow and see what they say and i'll put the questions in this letter aswell just incase Welcome decide not to answer.

 

Nothing much has changed on the health and "work" side of things except my healths going worse.

 

I've recieved most of my wageslips for my housing and incapacity claims but i'm still waiting for 3 of them and the SSP1 form which there in no hurry to send out plus i've got the baliffs at my door but all my claims are on hold till i can get the info.

 

I've not done anything further will my complaint as i've read about what i would have to do at the tribunal and i don't think i'd be able to cope with it plus they know i'm not going back as i never went in to sort out my wages and never contacted them.

 

I've sent them a letter asking them to send out the remaining wageslips, SSP1 form and a list of all my hours put though the system and that due to my current health situation i'm unable to come into store to resolve this issue and ask that it can be done though the post.

 

I think it's actually gone past the 3 months now since the problem happened that would of started off the Disability claim so i think it's too late to do anything about it anyway

 

Sorry if this doesn't make sense i've got a spitting Migraine at the minuate

Listen, as far as work goes, I totally understand. It cheeses you off no end but its being able to fight them just now. You have to do whatever is best for your health. If that means just closing the door on the whole episode and getting on with your life (I did it), then so be it.

 

I won't lie to you though - down the line when you feel stronger it will bug you no end that they got away with it all - but it's easy to get stroppy when you are fit enought to be stroppy lol

As for Welcome........I thought short and sweet. Point out the facts and ask for simple facts in return:

 

Dear Sir/Madam

 

I understand Welcome Finance is a member of the Finance and Leasing Association and you subscribe to their codes of practice which states:

3.2 Before you take out payment protection insurance,

or at the time you take it out, we will give you

the following information to help you to decide

if the policy is suitable for you.

The name of the insurer.

A summary of cover, which will explain what

the product is, the cost, and the key benefits,

exclusions and eligibility criteria (conditions).

The term of your insurance cover.

Any qualifying periods or excess payments or

periods needed before you can make a claim.

How to make a claim and who to contact if

you make a claim that is disputed.

If and when you may cancel your insurance

policy, and what action you need to take to

do this.

This information will help to explain if the policy

is suitable for you if you are self-employed, on

contract or part-time work, or if you have a medical

condition that you had been diagnosed with

before you took out this insurance.

Documentation

3.3 Once you have taken out insurance, we will give

you a copy of your policy or certificate of

insurance within 21 days, with a contact phone

number for any questions you may have.

Regarding the PPI policy you have advised you opened in my name for loan agreement number XXXXXXXX, there are a number of details which I have yet to be advised of, despite requesting this information several time. I would therefore be grateful if you could answer the following questions, with obvious regard to your membership listed above:
