Hi all, just got to say i have had a smile on my face ever since a friend put me on to this site and it gives me great pleasure doing the same!!

My story so far- sent Data Protection Act letter for my BOS student, classic CC and current acounts with £10 to-

BANK OF SCOTLAND

THE MOUND

EDINBURGH

EH1 1YZ

on 20 june 06 and on the 6th july 06 i was very happy and suprised to find a thick brown envelope from BOS containing my account history for my student and current acounts, but on both acounts the history sent ended may 2004?

Q: is this normal and should i expect the bank to send out the rest of my history separately or should i contact them?

welcome,

if the account is still open and it only goes from 2000 til 2004 (4 years in total) or dates back from 2006 til 2004 (2 years in total) then i would send the dpa non compliance letter in the template letter library.

Hope this was of some help?

this is what I received

dear xxxxxx

I refer to the above account and your request for bank account information.

Please find enclosed account reports which give all the information we hold for your account. Theses reports are from 17th April 2004 as this is the date the account transferred onto the Halifax Bank of Scotland computer system.

I have requested account information prior to this date from the Bank of Scotland Head office and this should be forwarded to you in the next 10 working days.

these reports where inthe form of computer print-outs, but once perused handily had al the charges collected in the same lace for each month. The earlier records arrived as copies of statements I already had.

2004 is obviously when the changeover/takeover/merger/whatever it was that happened between Halifax and BoS and very obviously when, for me, the downward spiral of charges began.....

Bank of Scotland round 1: £740 + costs settled, still sore over the 8% grrr

Bank of Scotland round 2: £629 +101.15 interest +£39 costs settled.

Letters recieved this morning, seven of them containing the rest of my history from 2004-2006 for both accounts (a fast responce of 18days) and what must be there standard letter at this stage with the heading-

Completion of request for a list of transactions and charges

Also saying with regard to manual intervention they are under NO statutory obligation to record this information and therefore, are unable to assist further +

details on how they use and where to find my data.

Thanks for the advice Solowka and Fruitycar, 2000-2004 computer prints and 2004-2006 account statement copy's.

I am off to invest in a highlighter pen.

Good news, another thick brown envelope from the BOS containing my BOS CC history. Thats all three of my acounts information deliverd with one letter to the above address with the one £10.

I have come across several charges on my student account from 2003 that come under the heading of- ACCOUNT MAINTENACE CHARGE £8.50-

Q: can i claim these back?

The Maintanence Charge is a curious one - if it's a charge for actually providing a service, such as a special rate on your overdraft of something like that, then No, you can't reclaim that.

Only PENALTY Charges can be reclaimed

** I AM NOT A LAWYER, PLEASE CONSULT A QUALIFIED PROFESSIONAL IF YOU ARE IN ANY DOUBT **

I have successfully claimed against: "MBNA, Capital One, Bank of Scotland & Clydesdale Bank"

Hi JMio, Ive had a closer look at these Maintenance Charges of £8.50 on the student account and they only seem to have be applyed on months when ive gone over my overdraft, this is how they are printed-

CHARGES FOR THE PERIOD 5JUL02 TO 2AUG02 ARE AS FOLLOWS

ACCOUNT MAINTENANCE CHARGE £8.50

TOTAL CHARGE £8.50

THE ABOVE CHARGE WILL BE DEBTITED TO YOU ACCOUNT NO xxxxx ONxxxxx

In all casses i had gone over my OD limit-

have to be PENALTYS.

This is probably a silly question (brain is on over load looking through all these bank statements), when in an arranged OD and charges are debited, even tho they dont put the account over the OD limit, do i still claim the 8% interest?
