      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I might ring Trading Standards and see if I should be allowed to get store credit. As you say, not happy about just sitting on a faulty printer for PC World to change their minds and end up with me getting a bum deal.

 

Quite happy to do business with PC World, and the printer was a gift so I'm not complaining. Store credit is fine, I just don't see why they wouldn't offer it.

Well, you are not exactlly entitled to the credit. the law provides repair, replacement or (partial) refund. They COULD offer you credit if they so wished, but need not do so.

 

You will be much better off contacting the store and asking if they would provide credit to you (or at least a written guarantee that they will exchange it next time you come in). My only reason for stating this was to make things less complicated. It seems I have achieved completely the opposite.

I know - but this is what happens when corporations run wild.

 

All I know is that I once was in a similar situation (another store), and when I went back a couple of weeks later I had to fight for the exchange. I was merley trying prevent that path being trodden again.

 

Now for some editing of posts and much due and needed grovelling.....

I'm back.

 

My PC World in Harrogate has nothing I want, and quite keen to get it sorted as don't want to miss out.

 

I have a sneaky idea, and want to know your stance on this. If I get a replacement printer from the Harrogate store, then take said printer to a Leeds store and ask for store credit/ refund (which ever they offer) will I be able to do that? Seeing as the printer will be completely unopened and will be new, will I have any problems? I'm more than happy to get store credit, so I should be ok right?

To do that you will have to rely on whatever exchange policy they have. they may not take multiple exchanges. Why not just ask for the credit note/vouchers in your local store and use them in a diferent store? Seems a lot easier to me

They won't give me credit for some daft reason. Hoping that they will just give me a new receipt for the new printer with no telltale signs of an exchange, but they can be crafty buggers I think!

 

Going to go for it and see what happens, at worst I will loose out on some of the value of my original printer. At best, I will have £100+ store credit, or a new non canon printer.

My printer was £109.99, and struggled to find a printer for the same price. They said I could have one that's cheaper, but I wouldn't be reimbursed the difference, effectively loosing out on money. Which is why I want store credit.

Hi Jurassicjim,

If I was in your shoes I would phone the Leeds branch of PCW and give them a brief overview of what has transpired. Then ask them if you can come to that branch for an exchange of printers/goods or the preferred store credit/vouchers.

I understand that you don’t want to loose any money or end up with a cheaper printer.

I'm not going to open it, so all the security seals are still on it and is in totally spanking new condition.

 

They can't say no to that can they?! What do you think my chances are of coming away happy?

Hi there.

 

Personally I think PC World have played very fair throughout all of this. They have MORE than complied with the SOGA.

 

The SOGA act is there to protect customers AND retailers. It's not there just to be exploited.

 

I think you should be telling people how well you've been treated by PC World, and not looking to get out of the contract YOU instigated with them.

Doesnt it mean the OP is entitled to a repair replacement or partial refund based on the blance of which is least inconvenient to OP and least costly to shop?

 

So if it costs £70 for a replacement printer that does the exact tasks the £110 did and this is cheaper for the shop then to repair old one. then isnt this a remedy the OP has to accept.

 

or isnt the other option where the shop can find out the lifecycle of the printer. do a calculation from the life cycle against the time OP used it and refund him the difference

 

lets say life cycle 3 years £110 divided by 3 years is £3.05 a month

he had it for 5 months and one of those months was unsatisfactory so thats 4 months happy usage = (£12.20) so the refund would be £97.80, kinda.

 

so again wouldnt it be a legal remedy which covers all bases to accept the exchanged item as long as it meets all tasks required. as its the cheapest and least inconvenient solution.

 

Also wasnt the original contract for a printer that does blah blah blah in exchange for £110. Wouldn't asking for a printer that does blah blah blah and GTA IV void the SOGA rights against the consumer. as its no longer the exact same items or uses of the contract.. i mean gaming is not a printer function

It depends on what was asked for. The contract is not just for functions - it could be that the colour of the printer matches the room or compatability or whatever. In essence, the contract was for X. Offering Y as an alternative may be viable, but I don't think there is a legal requirement to accept a different product or brand even if it does everything the other does.

 

Asides, as this was over a month ago it has hopefuly been resolved. We shall just have to wait for the OP to update us.
