The banks would say anything that relates to a charge is a fee for a service and our charges are clearly displayed in our leaflets. At least thats what abbey lloyds hsbc and northern rock are cean to point out.

the banks say they have a right under the terms and conditions you agreed to when you signed an aplication when you opened an account.

 

try asking them for a copy of the aplication form.

Firstly i'd like to say La illah illa-Allah

 

This judge has done a good thing by replying to every term which means each and every tocs hae to be commented on seperatley.

 

He answerd the issue of common law however it raises a question who is in breach us or them?

 

Them with there QC's? or us with our web interface? and N1 Forms

 

The judge has ruled yet there are asnwers I asked the test case did not cover.

Be warned banks are sending in solicitors on claims as low as £500 be warned.

My experince has been that the big company mentality is what I call a thin air markup policy.

 

If they think they will get away with it they will.

 

We consumers quite rightly like to hold these companies to a high customer service standard and moral standards.

 

Were all human but I do think the powers to be should make a more consumer ruling.

Cash plus have the right idea they have 2 tarrids.

 

One for those that have verry limited usuage they charge £0.96 per transaction or 4.95 a month.

 

There shouldnt be any need forn Direct Debit Charges or Overdraft Charges if you do it that way.

 

Then at least they make a bomb from every single account.

 

I seriously doubt A court would rule that th banks can not charge a single penny. As it will mean an end to banking as we no it and the economy wouldnt be bale to cope.

It's this system of ours innocent until proven guilty. Crime or no crime we need a government that can handle the pressure of governing.

 

Why pass responibility over to the courts? Oh its procedure.

Time for a change in powers me thinks its not working for us.

Well its the House of Lords. The powers in charge of this sharade.

 

We no and they no its down to the lettering of the law and if a judge interprets it against us then maybe this would spark a big OFT apeal.

 

But with the OFT streamlineing im not sure on which banks the OFT feel safe about taking on.

 

Think it may be time to hold a flame to the wax and change those laws again. Its the same old story (same old old) Labour cant get to the people what the people need. Democracy only works for them when it work for them not us.

 

The government have spoken there unfair.

 

We need a change in the system.

A one that will influence the judiciary and parliment.

A government that will do what it has been elected to do it should represent the people not just guide them along a line of national debt.

 

But my understanding is there argument is weather the tocs are clear and in plain inteligeable language not that they dont comply with the law.

 

A bit of a sneaky tactic if you ask me. Especially when there (the banks) are trying to recover from a hard scabed spot.

So to summarise again what did the ruling say on the 23rd june.

 

I was in court myself that day and missed the news.

 

Theres talk about the EU directives so dose that mean the Lords ruled there unlawful?

 

I just dont want to loose the will to live im already in a Mental Health Hospital.

To recap......if you've not learned patience in the 2.5 years this has been rumling through under a stay then there is no hope for you 8¬)

 

Sorry for dragging this thread a bit off topic but.

 

Patients is virtuous and I understand the frustration.

 

Try being locked away in a Mental Health Hospital 24-7 and you will soon understand patients. Hopefully the lot of you will not have to go through that but I do understand why people get shall we say heated.

 

There is a process and this process should be followed to the dots on the I's and the crosses on the T's. Otherwise things tend to get out of hand and we wont get anything done.

 

I agree The FSA waiver should be more detailed and should define exactly what hardship rules are.

 

And I understand that there are those that are not in difficulty any more but have thousands of pounds of charges on there accounts.

 

What I don't understand is why you have to take it out on here were all here to help one an other. There is an old saying Treat others as you expect others to treat yourselves.

My point was maybe there should be a part in the waiver that defines what Hardship is. It seems to be the banks that are defining what it is.

 

Why cant the authorities take control and stop the banks from dictating policy when there is a dispute. It seems to me there passing the buck and the job to the bank.

 

We voted them in for a reason what's the point now in going to the polls if you cant trust your electors to mediate in you're favour.

 

One dose not have to have done something wrong to be in a mental health hospital 24-7. You could be sectioned under the mental health act for up to 6 months at a time.

 

Think I might join you Thailand and try to use the excuse god told me to do it.

How can making thousands even millions of claimants wait for a lengthy court case be a fair trading practice?

It would seem that giving the banks power to keep on charging lubriciously high charges would be in breach of our human right equality under the law.

 

How can one party profit so highly and unfairly now that a governing body has virtually ruled they are unfair.

 

This is definitely a breach of our equality of opportunity as the legal case gives the banks virtual power not to deal with our complaints. No wonder they are appealing at every opportunity. If they don't like trading in this country maybe they should ship shape and get out.

 

An unfair term should be made powerless once it is in dispute empowering the consumer and putting our European Human Rights at the for front of the contract.

 

It is now pointless voting a government in since it is the courts that make the decision in the end of the day.
