    • In my experience (not with car payments) but with many other things, my partner has been ill and signed off in the past and we have been unable to meet various commitments.  Naturally if you ring the call centre they are going to fob you off and tell you you must pay, that's why that never ever works. I would obtain a note from her GP listing all her health issues plus medications plus side effects, then write to the finance company with a copy of it, explaining the situation, as you have here, asking for a payment holiday. Perhaps mention that the car is very much needed for hospital appointments etc. It's likely the finance company would rather you pay till term end than, chase you for money they will never see, and sell the car at auction for a loss,  You can search some of my threads going back years, advising people to do this for Council Tax, Tax Credits, HMRC, Even a solicitors company and it always works, because contrary to popular belief people are reasonable.
    • Sorry, I haven't ever seen one of these agreements. Read it all and look out for anything that says when she can withdraw and when she is committed to go ahead. If it isn't clear she may need to call the housing provider and simply say what you posted here, she doesn't want to go ahead and how does she withdraw her swap application?

Your head is like a power bank of knowledge.  Her health issues are short term, due to a relationship breakdown she took it pretty hard and has been signed off work on medication for 3 months. She only started her job in February 24 so does not qualify for any occupational sick benefits, which is where the ssp only comes in. (You will see me posting a few things over the coming days, whilst I try and sort some things for her)  I sat with her last night relaying all this back and she does want to work out a plan, she was ready to propose £100 for the next 3 months and then an additional £70 per month onto of her contractual to "catch up" but Money247 rejecting the payment holiday and demanding £200 thew her, which is why I came on here.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

Can anyone let me know if MCOL allows/uses visa electron for payments? I know a lot of places never used to, but more and more are accepting this now.

 

I've tried looking on the website, but can't find it anywhere.

I believe Solo and Electron are accepted in the payment section which is right at the end of the claim, however don't worry if it is not there as you can save you claim at various stages.

Thanks for that. Great to know! Apparently it's a lot quicker to use MCOL than the 'standard' courts service. I've just opened a Co-op account as a parachute, which comes with an electron card:D so I can use that to pay the fees.

Sorry me again with another quickie. Do Nationwide usually reply to the LBA letter? The one I've sent - the 14 days are up on Tuesday and I've had nothing at all back from them. Is this usually the case?

 

Also do I have to wait to file with MCOL? Or can I do it as soon as the 14 days are up?

Is this the standard reply from the LBA letter? Should I have left some time between receiving their first 'standard bog off' letter and sending the LBA?

 

What's the next course of action? I take it I wait for the rest of the 14 days and then file with MCOL?

 

I won't be able to file with them until the end of next week anyway, either thurs or friday as will not have the money till then.

 

It's just thrown me as she has 'apologised that this has not been received'. I've just looked at my LBA letter and the first line says that 'I am very disappointed that you have failed to respond to my letter of the 03 July 2006' Should i have amended this to read something along the lines of 'Thank you for your letter of 11 July 2006'?

I really hope I've not mucked it all up, by failing to include this line :Cry: Please say it's not all gone to pot now!

Thanks for that Dolly. I wont have the money to actually file the claim till the end of next week anyway, so it gives them a bit more time - no one can say I'm being unreasonable ;o)

 

I've started filling in the MCOL form now, as I understand that it can be saved at any point - at least if I get it all ready now, then as soon as i get some money in I can process it straight away.

 

I'm sure it's been asked before, but I did a quick search and can't find the answer. Which address do I use for the claim form?

Use the Pipers Way, Swindon one without the Legal Compliance bit. Just address it to Nationwide Bldg Soc....gets to Mr Bacon quicker then :)

 

You can save the moneyclaim at any point so get it all prepared and as soon as you have the money you can make payment and it is gone. You'll be fine with it as well, have your money back in no time!

HELP!!!!

 

I'm stuck on a few things on the MCOL site!

 

 

Particulars of claim:

 

You have a contract with the defendant bank

dated April 2005 and which is conducted on

their standard terms and conditions. You

are claiming the return of money taken by

the defendant in the way of charges over

the last 1 year plus the interest they have

levied on those charges. The bank's charges

are a disproportionate penalty and

therefore unenforceable as they are

contrary to common law. Further, as a

disproportionate penalty they are invalid

under the Unfair (Contracts) Terms Act 1977

s.4 and under the Unfair Terms in Consumer

Contracts Regulations 1999. Para.8 and sch.2

(1)(e). In the event that the charges are

not a penalty then they are unreasonable

within the meaning of the Supply of Goods

and Services Act 1982 s.15. You have

repeatedly asked the bank to justify their

charges but they have declined to do so.

The claimant claims interest under section

69 of the County Courts Act 1984 at the

rate of 8% a year from 27/09/2005{date when

the money became owed to you} to 28/07/2006

of £47.70? and also interest at the same

rate up to the date of judgment or earlier

payment at a daily rate of {enter the daily

rate of interest}.

Date when money became owed to me - I've put the very first time I got charged - is this correct?

 

Interest calculations - I've worked it out with the 8% spreadsheet from here and I have 4 TOTAL figures:-

 

1 Penalty charged - £745.50

2 8% on penalties - £47.66

3 Interest on penalties - £0.74

4 8% interest on penalties - £0.04

 

The amount in red is £47.70 which is made up of the totals of 2+4, is this correct?

 

The daily rate of interest - what is it?

 

The human rights act - NO

claim interest - YES

 

Are these both correct?

 

Also it says it can be no more than 1080 characters. It's currenty 1200, and I copied Bankfodders guide notes in bank templates library.

 

Please help!

 

Also, as I'm not going to to be actually claiming till the end of next week, I realise that the interest figures will have changed by then.

This is just a guide, not a template. As you have copied and pasted it, it makes sense whatsoever. For example:

 

You have a contract with the defendant

 

Who is 'you' - you're submitting the claim to a court so are you saying the court has a contract with the defendant?

 

You need to read through this carefully, change it so that it all makes sense, and then if it's still over the character limit see what words you can change, or what bits you can cut out to make it fit.

Hi all,

 

I've opened my parachute account - 2 as it happens! Co-op cashminder and Natwest Step.

 

Should I change everything over now? Or wait to see if they close my account? Also if I do wait, and they give me 30 days notice to close it, can I then write back with the retaliatory action letter? Right,

 

LBA was sent on 13th, give them the standard 2 days to receive it, means the 15th. 14 days from then means the 29th. Is this correct? Which in turn means that MCOL can't be filed until at least the 29th, which is tomorrow, is that right?

 

Do they accept claims made at the weekend? I've already set the money aside to claim, I might wait until first thing monday morning to actually file it. Is there any reason/advantages for me to do so?

 

Also I know that there is at least 1 more charge due to come out, and historically they have come out at the end of the month, so I'd like to wait to see if/when it comes out and add that to my claim as well instead of doing this all over again for 1 charge.

 

Also what do I need to do once I've filed Moneyclaim? Is there anyone I need to notify or anywhere I need to post to say that I've filed?

 

Any help appreciated.

I'm trying to submit the moneyclaim form, but the wording is too long by 2 lines. Can anyone help me shorten it? PLEASE?

 

I have a contract with the defendant dated

April 2005 and which is conducted on their

standard terms and conditions. I am

claiming the return of money taken by the

defendant in the way of charges over the

last year + the interest they have levied

on those charges. The bank's charges are a

disproportionate penalty and therefore

unenforceable as they are contrary to

common law. Further, as a disproportionate

penalty they are invalid under the Unfair

(Contracts) Terms Act 1977 s.4 and under

the Unfair Terms in Consumer Contracts

Regulations 1999. Para.8 and sch.2 1)(e).

In the event that the charges are not a

penalty then they are unreasonable within

the meaning of the Supply of Goods and

Services Act 1982 s.15. I have repeatedly

asked the bank to justify their charges but

they have declined to do so. I also claim

interest under section 69 of the County

Courts Act 1984 at the rate of 8% a year

from 27/09/2005 to 28/07/2006 of £47.70 and

also interest at the same rate up to the

date of judgment or earlier payment at a

daily rate of £0.16.

 

As far as I can see, there is no way that it can be shortened.

I've taken out the word 'bank's', so it now reads 'The charges are a disproportionate penalty...' 'have asked them to justify...'

 

Would that be ok? Does it still read ok? Still doesn't fit though. Can I substitue the plus sign (+) for the word 'and'?

I've amended it to say have not now and it still fits! YAY! Thanks for your help.

 

I've just tried to pay for it with my visa electron card and it doesn't accept electron only visa delta! GRR. Means a trip out in the rain (plus kids - bloody summer hols) to take money out of one account and put it into the other.

 

Oh well, hopefully I'll get it done at some point today.
