      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If anyone can help, I'm trying to see the connections between Federal Management Ltd, UK Debt Collection Ltd, and 'Creditsure' - apparently another CRA??

I keep seeing Skelmersdale, West Yorkshire cropping up.

Am baffled:confused: I recognise Skelmersdale for some reason, but can't think why.. Help!!! :D

 

It's in Lancashire, but hey, it's Christmas...

i am getting upset....not had a call from a DCA for a few months now!

You could always leave your phone number in this thread. This will enable those receiving excessive calls to change their number to yours, thereby reducing the amount of calls they get, and giving you the opportunity to have a chat with a DCA...?

Now that bothers me, I wasn't aware of this - quite seriously, I'm out of work, no benefits, but still have to pay for medicines, of which I need 8 different items a month! OK, so I buy a pre-pay card, but it's still costing me when so many are getting freebies...

As you point out, not their fault, and I'm not in a position to start a war as I'm rather short of tanks, aircraft and weapons at present.

 

However, it was information I was not aware of and now wish to change my doctor to one in Cardiff, or somewhere like that...

No - 0871 is actually re-classified as a premium rate service these days, and regulated by PhonePayPlus (PhonepayPlus - welcome to the PhonepayPlus home page), which used to be ICSTIS, rather than OfCom.

 

Just realised after pressing submit, there's some rule about not using premium rate numbers in relation to contacting the company hassling you - so by using 0871 they are breaching that as well.

Does this mean they do not recognise the Consumer Action Group as a consumer body ?

What about a CT appreciation website? One that looks rather similar, has all the keywords to get it showing in Google etc., but that has an alternative forum? :D

The domain name crudittotday.co.uk seems suitable and is available!

Ok just to bring everyone down to earth, setting up a forum is easy, but making it look right will take a bit of time, and making a site that is simaler to there site (but differant enough not to break copyright) will take time too.

 

i will work on a template for that, but will need "articals" to put in it, otherwise there will be no point;)

 

Removing Gingerbread stains from clothing isn't a suitable topic then?

 

News of monthly awards to various DCA's perhaps? Who was given the FB Level 1 certificate for January sort of thing...?

 

Of course, there would have to be a Hot Headline about a certain consumer group gaining more 'customers' than any of the DCA's.

That's what I like most about CAG. Lots of people in the same boat, helping and supporting others and not judging them.

I thought that would be an excellent headline story for the new Crudit Today. How CAG is uniting people in the fight against the 'crud' (to steal part of the site title).

I did try to add more green blobs but I'm told I must spead the happiness before I can give you any more:eek:

I find it very addictive, I keep getting email to tell me a thread has been updated, so come to see what it's all about, then I find myself looking down the new posts to see who else is having problems...

But - do I want a cure?

I've only got IE, but it works on that - apart from a hiccup making a post, it crashed the forum for a while - got a 'page cannot be displayed' message in the main frame. Went back and re-did the message, took AGES before accepting it.

The Post Office refused my 'doorstep' parcel, said it was too big and heavy and I needed a special carrier. I tried a Tesco one, but that split.

 

So, alternative despatched to Power 2 Contact, such a shame I forgot to put stamps on.

 

I've sent them a nice thick hand-cut slice of stale toast - a doorstep wedge of course!
