      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

People who stand in a long queue at the supermarket checkout and wait till they get served before realising that they actually have to pay and then start rummaging through oversized handbags to find purse, open purse, count out small change, realise they don't have enough, put change back in purse, remove bank note from purse, say "sorry I don't have anything smaller", put purse back in oversized handbag, take change, examine receipt, rummage in oversized handbag for purse, find purse, put change in purse, put purse back into oversized hand bag and NOW - YES ONLY NOW DO THEY THINK ABOUT PACKING THEIR BLOODY SHOPPING!

 

I'm not an impatient man but my life expectancy is only another 50 years or so and I don't want to spend it in a flippin supermarket!

Really irritated:mad:

 

Parents bring small child into my shop. He proceeds to knock a quantity of stock off shelf and of course it was only the fragile stuff. Parents cannot afford to pay for the damage. He then completes the job by ripping a shelf off the wall!

 

Following day I go to repair the damage but have to take 3 year old son with me as Mummy is in bed after a night shift. Small son distracts me (not his fault really) and a misplaced hammer blow results in me spending 4 hours in A&E with a fracture to my left ulna. Wouldn't be a problem apart from the fact I'm left handed.

 

Am I the first person in the world to have a self inflicted broken arm caused by trying to avoid braining son whilst holding claw hammer in non dominant hand?

 

Probably the best injury in the world:)

While your laffin I'm typing with me right hand and I'm still waiting for the swelling to go down enough for them to actually put it in plaster:o

 

The good news is it should only take about 6 weeks to heal.

 

The bad news is I washed my triangular bandage this morning and now I can't do a sling with it (think about it!)

Yesterday I went to fill the car up at a certain supermarket (in spite of the fact I shouldn't really be driving with a broken arm:o ).

 

I used the card pay pump and while it was authorising my DEBIT card I was approached by a rather cold looking female. The conversation went like this:

 

Her: Have you just used a credit card?

Me: Not really any of your business but no it's a debit card

Her: Have you heard about the As** credit card

Me: I have but I don't need one, thanks

Her: But we do a 0% balance transfer from your existing cards

Me: I think I just said I don't want one

Her: How much do you owe on your current credit cards?

Me: That has nothing to do with you

Her: As** credit card offers a 0% balance transfer

Me: Are you deaf?

Her: No

Me: Good, so be a good girl and f*** off then before I go to the managers office and complain about harrassment.

 

She left me alone then.

 

What irritates me - people who can't take no for an answer. (Ladies - think carefully before you pick me up on that statement;) I have my arm in plaster, it itches like buggery and it's taken me nearly 15 minutes to type this rant!)

i didnt know they could do that isnt that harrassment and try knitting needles revolting and dont make me laugh ill need the loo again :Dcan just picture u an hour typing it i could say anything now and itll take at least half the night to get me back :D;)xxkia

 

If i could make this mouse work properly i would post a picture of me so you can see if I'm the kind if bloke who would own knitting needles.

 

I have just found a very long emery board on the wifes dressing table. It's certainly scratched the itch but goodness only knows what my arm will look like in a months time if I keep doing that

Kia - It mysteriously stopped itching at about the same time as my fingers turned blue. I have been to hospital this morning to have the pot removed and now have to wait for the swelling to go down again before I can have it replaced.

 

All I need now is MRSA and C-Dif and the NHS work is complete:o

Knit one pearl one drop one curl one.......................Vindaloo? :D I have heard that the really long knitting needles are best for scratching cast itches. I have also heard that not breaking your arm is also a good cure but sometimes it cant be helped just like in this case.

 

It was a choice between my arm or a 3 year old head:o

 

I have to say that the outcome was instinctive rather than objective. If I didn't love hime so much I would have brained the little s**t:grin:

 

Problem then was I had to take him with me to hospital and try and control him for nearly 4 hours whilst nursing my injury. Apparently broken arms aren't life threatening. It nearly was for my son:wink:

well i hope it all gets better soon.

 

Glad you have your cast of for now as maybe you can get any itches on that arm.

 

I now have a contraption called a Bradford Sling. Big green spongy thing which enables me to suspend my arm above my head even when sleeping (trying to sleep with my arm above my head - give it a go sometime).

 

Back to frac clinic on Monday to see if they can put the pot back on without cutting off the circulation to my hand!

I see it like this

 

If the wife wasn't so gorgeous I wouldn't want to make love with her. If we didn't make love she wouldn't have got pregnant. If she didn't get pregnant we wouldn't have a son so son would not have walked into path of swinging hammer as he wouldn't exist.

 

My broken arm is then a result of the wife being gorgeous and thus her fault!
