Hi all - whats your views on this then.

 

Been going along my merry way with my claim with Abbey. Ready now to issue.

 

I send them a 7 day letter before action and they write back and say I should wait for the decision from the OFT as all their cases are being put on hold pending this outcome.

 

Surely that cant be right? Whichever way the OFT decision goes, it will then get go to appeal.

 

Am I alright just to issue - its only small claims? Will it not get dealt with if I do?

 

What do you all say then - issue or not?

Hi Bluefairy,

 

This is a standard reply that all banks are issuing to claimants at the moment. You need to decide whether to file at court now or await the outcome of the test case. If you file at court, your claim will almost certainly be stayed along with all the other claims at the moment. However, if you decide to wait until the test case is over, some of your charges (depending on how old they are) may not be recoverable at a later date due to the Limitations Act.

I am afraid we dont know how long it is going to take, so I would file at court to be on the safe side :-)
