      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have just come of the telephone to a lady at equifax who refused to give her name so I could make a complaint. She insisted that their was no supervisor or manager present and I could not speak to anyone else. She was extremely rude and although I had given my explicit permission to speak to my partner she refused to do so.

 

The complaint was that I had purchased a copy of my credit file in December and the electoral infomation contained on there was incorrect. I contacted the council and they sent the update to Equifax on the 2nd January 2008. I every day for about a week but they still did not update the information. I have called them several times since and kept bwing told just to wait and call them back in a few days. Eventually they updated the information today despite having it since the 2nd January. When I asked them what the new score was she refused to tell me and said I would have to purchase a copy of my file again since the 30days I had paid for were now up. I explained that the 30 days were only up because THEY had not updated the file and I had to do all the chasing. All she could say is if I wanted my information I would have to go online and pay for it.

 

Why should Equifax be paid more money as it was them that were so slow to update things. Also since requesting my file I have recieved several offers from loan companies through my door. It appears that not only do they want to profit from me, they also want to profit from selling my information.

 

I want to make a complaint, who should I complain too?

I have sent the following complaint.

 

Dear Sir/Madam,

I am very disappointed with the service I have received from Equifax.

 

I purchased a copy of my Credit Rating/File on the 7th December 2007. It was apparent that the information regarding electoral roll at my current address was incorrect.

 

I immediately notified the local council and completed the necessary forms. I called Equifax and updated the address details. A new score/file was uploaded.

 

On the 2nd January 2008 the Council supplied Equifax with the updated electoral roll information. I called Equifax several times over the following two weeks to see if the file had been updated. Eventually today (24/01/08) I was informed that the information had now been updated. I requested my new credit score but was refused this information unless I paid again for it.

 

I also gave permission for my partner to speak on my behalf but the operator insisted the phone was handed back to me because he was disputing the payment. She said 'This is not your account anyway!' Despite the fact I had given explicit instructions to speak to my partner on my behalf.

It is my understanding that the product I purchased was valid for 30 days and that it is your policy to upload the document in that time if amendments are made. My complaint is that Equifax was supplied with the information on the 2nd January 2008 which was within my 30 day period; however it took Equifax 19 days to update that information. If Equifax had updated the information before the 8th January 2008 I would have been entitled to my score/file without having to pay again.

The lady I spoke to at Equifax refused to accept this and demanded that if I wanted to know my score I would have to pay again. I asked to speak to a supervisor or manager but this was refused. I also asked for a name but she refused to give a surname, her first name was Sharon.

 

To resolve this matter please would you upload my new credit score/file and if you are unable to do this please explain why.

Please respond within 14 days.

I want my details that Equifax holds on me, does anyone have a template for this purpose because I want them to send me everything that they have relating to me.

 

Any help with this Subject to Access Request would be gratefully received:cry:

If you want the full deal with what a credit reference agency holds on you it's best to do a full Subject Access Request. Costs £10 but you get a whole lot more than just your credit file.

 

Just modify the SAR letter in the templates library to suit.

 

A friend of mine did this on Experian a few months back and got 2 packages in the post containing around 700 pages of documents. :eek:

i have a probblem with equifax giving incorrect info to haringey council, i have an £8000 bill for council tax from this council. i never lived there, and the man at the council told me equifax gave them the information, i emailed them but they dont reply, now i will write letter,

A company has acknowledged to the FSO they should not have made a debt search that has left a footprint of such on my file. I am trying to get Equifax to correct to correct this but they are dragging their feet, what legal recourse do we have with the agencies when they do this. ?
