    • Thank you and well done  for posting up all those notices it must have have taken you ages.. The entrance sign is very helpful since the headline states                    FREE PARKING FOR CUSTOMERS ONLY in capitals with not time limit mentioned. Underneath and not in capitals they then give the actual times of parking which would not be possible to read when driving into the car park unless you actually stopped and read them. Very unlikely especially arriving at 5.30 pm with possibly other cars behind. On top of that the Notice goes on to say that the terms and conditions are inside the car park so the entrance sign cannot offer a contract it is merely an offer to treat. Inside the car park the signs are mostly too high up and the font size too small to be able to read much of their signs. DCBL have not shown a single sign that can be read on their SAR. Although as they show photographs which were taken the year after your alleged breach we do not know what the signs were when you were there. For instance the new signs showed the charge was then £100 whereas your PCN was for £85. Who knows, when you were there perhaps the time was for 3 hours. They were asked to produce  planning permission which would have been necessary for the ANPR cameras alone and didn't do so. Nor did they provide a copy of the contract-DCBL  "deeming them disproportionate or not relevant to the substantive issues in the dispute" How arrogant and untruthful is that? The contract and planning permission could be vital to having the claim thrown out. I can find no trace of planning permission for the signs nor the cameras on Tonbridge Council planning portal. and the contract of course is highly relevant since some contracts advise the parking rouges that they cannot take motorists to Court. I understand that Europarks are now running that car park which means that nexus didn't  last long before being thrown out.....................................

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

:? Confused and a bit deflated today. Have still not heard anything from anyone. Our deadline is 2nd Oct (Monday) so there is only one more post between now and then - tomorrow.

 

What will happen if we don't get anything in the post? Obviously we are prepared to go to court (although trepidatious) but my hubby has defended a motor accident claim against him in court before (and won!) so he's up for it - we were just hoping it wouldn't come to that.

Received full & final settlement from Cobbetts............

 

Have today received from Cobbetts on behalf of NW an offer of £900 in full and final settlement with conditions attached as follows.

 

Acceptance by you of this goodwill payment will be in full and final settlement of your claim against our client and strictly on the basis that:-

 

1. You agree not to discuss to any third party the fact of, or any details

relating to, this payment.

 

2. You write to the Court withdrawing your claim.

 

Obviously a letter accepting as part settlement only, will be sent, but that we will continue with the claim until we receive the full amount we are claiming which will include upto date interest What I want to know is do we inform Cobbetts of the £220. (£120 MCOL and £100 Court costs) that it has cost us to date?

ditto again, ollie - i think we've got the same person. they've offered me 1400 on my 3500 claim. naturally will be declining :)

 

i'm putting at the bottom of the letter that i require all interest, court fees, dpa fee, cost of postage and 0.0219% interest per day on top of the claim.

:D Thats good to hear! I must admit we have probably spent nigh on a fiver on recorded delivery postage alone, but hadn't thought to claim it. :smile: Can we charge for ink cartridges, stationery, wear and tear on PC (especially when stressed out with NW) burning the midnight oil for hours on end reading through the FAQS, petrol and parking fees when driving to post letters etc. phone calls to MCOL and C.Court??? Only kidding - like you think it is only a (short) matter of time away before the party begins. x ;)

Hi , with the AC questionaire, are you just sending the questionaire filled in as it asks, or are you sending a letter and a list of your charges to the court and to Cobbetts?? with the AC, ??

 

We did not send a schedule of charges initially with our AQ just a covering letter, but had second thoughts, so my hubby rang the court and they said that it was better for them to have it but not need it, than not to have it - and need it. So we sent it with a note apologising for our lapse.. We did not send Cobbetts a copy of the schedule, as they had previously been sent one. Hope this helps.

:( Another no-show in the post box this morning! (And after last night's result, feeling just a tad p****d off).

 

Can't even begin to think why the delay as we recorded our reply to Cobbetts full & final blah,blah and according to Royal Mail Track n Trace website it was delivered 09.10.06 although the image of the signature completely blank - (I shall resist stating the bleeding obvious!). :rolleyes:

 

So it's still a waiting game.............and they will blink first! :smile:

U-P-D-A-T-E

 

Called Cobbetts yesterday, as had heard nothing since replying to their offer letter of 4th October. Had to leave message on voice mail - but no-one called me back.

 

Called again today, same thing left message on vm but to my surprise received a call back a couple of hours later! Said they had no trace of receiving my reply (I said well it was sent recorded mail and according to Post Office website had been delivered on 9th Oct).

 

She asked would I mind reading my reply out over the phone - so I did. She asked me to confirm the total amount being claimed and said she will pass on to her Client. So, will I be hearing something very pleasing soon? I do hope so. ;-)

They paid in full £1711.86 which includes £120 MCOL and £100 court fees and interest. :D However the cheque specifies and I quote " Pay ****** (hubby's name) into account number ********" end quote.

 

Is this permissable as we would have preferred to pay it into an account we have with Nationwide? If anyone can give a speedy answer I would be very grateful as hubby is itching to go to bank and deposit it!!!

Do what we have done. I won against the Halifax on friday and the letter said they are putting the money into my Halifax account within 5 days.

 

Went down to the local Halifax branch on friday and told them we did not want it to go in that account, and asked if they could write a cheque out for us so we can put it into whichever account we want to.

 

The lady behind the counter said that would be fine. Just wait for the money to go in (which should be today or tomorrow), bring some form of identification with you and they will issue you a cheque.

 

I'm sure it will be the same with the Natwest
