      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I got 2 acknowledgements of sevice dated 10th and 17th, it was filed by cobblers but no contact name, so who ever is dealing with me is incognito lol

 

Soz for not acknowledging your contribution earlier Chris (so much else going on at mo don't get on here as often as in past).

 

They (Cobblers) probably need more staff to cope with the enormous workload just from their NatWest a/c. Either that, or they can't actually find any of their staff behind all the piles of money they are earning out of NW. Why don't Natwest cut out the middle man and just refund "on demand"? UTOPIAH springs to mind. ;)

Ha Ha - there were no crumbs of comfort in ours!!

 

Do you know whether the Court fee (in our case £100) is claimable from NatWest? Or does the Court tot up all monies owed to us?

Court fees are automatically added on to the total amount owed. Therefore Natwest will, in order to make full payment, have to pay the fee too.

 

This is the lunacy of their leaving these claims this late and not paying up sooner. Especially when they see the library letters that we're all sending in and must realise that we're all on this site and won't just go away or give up! Anyway, 8% on top of our charges......best savings account I ever had!

Thank you very much sbb1979. I agree with you re the Banks' attitude - it would be interesting to know how many people have dropped out at this stage because they have felt intimidated .

 

I understand also that another letter will be sent from Cobbetts (before they settle) stating, in their opinion, we will not win the case in court. Without this wonderful site I might have "bottled it" by now.

Reply to our letter dated 18.09.06 from Cobbetts received today as follows:-

 

"We note your comments on our Request for Further Information. It is our client's contention that your Particulars of Claim did not properly particularise your claim. For example, our client cannot properly defend a claim where you have not given the details of each charge you claim is disproportionate and unreasonable.

The Court is bound by an overriding objective to deal with cases justly and ensure that parties are on an equal footing. It was clearly the case that our client could not respond to your claim where you did not provide sufficient particulars. Our client therefore objects to your allegation that the Request is intimidating."

 

We enclosed with our letter a copy of our schedule of charges as per this sites

speadsheet template so feel we HAVE given details.

 

Shall we reply saying we will justify our claim further in court? Or, is there something we missed? Is this their usual delaying tactics?

We did send Cobbetts a schedule when we declined their invite to answer CPR Part 18 so were gobsmacked to receive their follow-up letter (as above) today.

 

Realised that we had not sent a copy of same schedule when we returned completed AQ to court. Hubby rang court today and they advised they would need a copy - so one went off today with a covering note.

That's extremely encouraging laffar - thank you for that. Our deadline is 2nd October. If they make an offer we will only accept as part settlement - not full and final and certainly WILL NOT accept a gagging order!! I will want to shout it from the rooftops. :D :D Thank you.
