      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi anyone know this number 01772514514 they rang asking for my wife regarding personal business matter but refused to give company name. I advised them that I deal with all my wifes personal or business matters. They then said they would give me an address to send them a letter signed by my wife for me to act for them. I asked for the company name again guess what they would not give me the name. I then advised them my wife will not be writing to any unknown company and would definitely not be signing anything for them. If they wish to communicate further they will have to write giving full information regarding this matter, no other type of communication would be entered into.

 

We now only have three debts that are not sorted (IE not having any problems with) of these we are taking 2 to court and are waiting info from the third all no agreement or unenforceable.

 

Ain't it nice to very politely say get stuffed to these DCA gutter scrapers.

Daft question but has the OP tried calling it back (put 141 first and hang up once they answer hopefully saying who they are)? There are a couple of debt collectors based here in sunny Preston so could well be one of them

18/10/06 S.A.R - (Subject Access Request) sent

03/02/07 Claim allocated to small claims. Hearing set for 15/05/07. Lloyds ordered to file statement setting out how they calculate their charges

15/05/07 Lloyds do not attend. Judgement ordered for £192 approx, £3 travel costs and removal of default notice

29/05/07 4pm Lloyds deadline for payment of CCJ expires. Warrant of execution ready to go

19/06/07 Letter from court stating Lloyds have made a cheque payment to court

I searched the number on Google and it came up with a simular question you asked which was on Martin Lewis site, I think it is still down but the description of the nature of the call was the same as you originally asked

Hi yep tried that they just hang up (could be due to I withhold my number), what they do not know is that I record all incoming phone calls and have them on record refusing to give the company name. Will let them do it again a few more time before I report them to OFT re debt collection guidelines etc.

Are you registered with the TPS. Just a thought but as they wont identify who they are you could assume they are a sales call and report them to the TPS as such

Hi had another call Yesterday afternoon same carry on asked for my wife told them they have to deal with me.

Then asked what company are you they again would not answer that question, twit tried to say against DPA.

Advised them to write they said they had.

I said you have not all mail is answered.

They again said they had written

I then advised them to write recorded delivery or get lost.

These numbers called me yesterday 01273341404 and 01413023400 but I do not speak when I left up the phone, I wait for the person at the other end to speak first and after a minute when nobody speaks they person at the other end puts the phone down. I have a display phone so I know if it is someone that I know is calling me and it is safe to speak to them. It is they loss so it does not bother me. :wink:
