I know all my DVLA details are good. I recently (last year) renewed my license, and my car's V5 is current with the correct details; the same is valid for my partner. I'll continue to ignore the love letters 😂 and won't let it bother either me or my partner.  I'll revisit this post if/when I get a letter of claim.  F**k ém.

    • Good morning all, No further communication with P2G so now submitting my small claims action. Would be grateful for any feedback on my description of claim before I submit later. The defendant in this case is Parcel2Go Limited The claimant sent a parcel using Parcel2Go Ltd as a broker and Evri as the shipper containing two handmade bespoke wedding trays to a customer with tracking number P2Gxxxxxxxx. The parcel was never delivered although the defendant stated that three attempts had been made to deliver the parcel.  The claimants customer waited in for four days to receive the delivery but no delivery was attempted. There was no communication with the claimants customer.  Despite many web chats and emails the parcel was not delivered and on the Parcel2Go website it stated that the customer had refused delivery. This was not true as no delivery had been attempted.  I was informed that the parcel was being returned to me but after waiting three weeks was informed by Evri that the parcel was lost. I was offered compensation of £20 + shipping fee which I refused and after sending Parcel2Go a Letter of claim this was increased to £75 which I also refused. It is clear that the defendant is responsible for the loss of the parcel as they did not act with reasonable care and skill when handling the claimants parcel, contrary to section 49 of the Consumer Rights Act 2015. The claimant therefore seeks £370 in respect to the value of goods plus court costs. I thought it might be better to use the CRA rather than the Supply of Goods and Services Act as we are sole traders - is this correct?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have been following this site for a while and I am now on the last lap with my claim against the HELIFAX.

 

I am claiming £2788.87 incl interest - so hopefully I will get it all back

 

These charges have left me short on many occasions over the last six years

and have totally ****ed me off. :mad:

 

Time is running out ! :)

Started the ball rolling 10th April requesting statements for the past 6 years

 

Received about 50 evelopes full of statements - Postman left bewildered :???:

 

Worked out charges and interest using excel spreadsheet - total £2,788.87

 

Sent LBA 13/6/2006 ... received letter from Halifax - stating that it was my responsibility to manage my account, but as a gesture of goodwill they were prepared to refund £450.00 of charges in full and final settlement.

So its been a long haul and some been paid off in half of this time.

 

Its no secret though that the HF average settlement has been at stage 3 so they really do take it as far as they can.

 

If your claim mirrors many others here you will prob find them settling within a week or 2 of getting your moneyclaim in !!

Called the Halifax this morning, they start at 09:30 :???:

 

they have now offered me £1500 ... butI declined the offer and said I would go to court.

 

Tried to use the Moneyclaim site but was given Authorisation declined for payment of £120 ....:mad: :mad: :mad: :mad: :mad:

 

2 questions ....

 

Do I now proceed to the Sheffield County Court in person ???

 

and

 

What forms do I need to fill in ???

Why was payment declined ?

 

Going to court in person is an option (And their Head office is not a million miles away from Sheffield)

 

You would need to fill in a claim form and pay the fee there.

They are very helpful with guidance and there is supporting docs to help you fill in the forms

You should be able to see all the info on here.

It was declined as there was not enough money in the account ...

 

Just noticed that the N1 form is the one to use, so I will go and put the claim

in at the Court in person, I have £120 in cash to cover the cost

Do they stick it straight into your account without notification ?

It depends on what the Halifax are going to do, defend the claim or not ......read a few threads in the Halifax forum that people have won on and you will get a rough idea how long you will have to wait

They rarely settle at your stage.

They may file a defence and then settle.

One things for sure if they follow their pattern you should be sorted within the next 14 dys

Donna after 8 posts you should have read the faqs

 

You can proceed WITHOUT a S.A.R. but there may be information you need.

You must show you have given your bank scope for dialogue and there are no fast tracks or shortcuts.

Having your bank statements will allow you to send the prelim letter now but If I were you I would take some time reading from the site.

Claim issued to Sheffield County Court 29 June 2006 - £120.00

 

The defendant filed an Acknowledgement of Service on 11 July 2006

 

The defendant responded to the claim indicating an intention to defend all of the claim

 

I was expecting to receive this payment by now ..... :mad: :mad: :mad:

 

and the Halifax have now added another £600 worth of charges to my account

 

I am in BIG TROUBLE with missed payments ... Mortgage \ Bills etc ....

 

How much longer do I have to wait ???????????????????????????? :confused: :confused: :confused:

Hang on in there.......it wont be long now.

The additional 600 quid is a lot,and maybe worth telling them you want any charges levied since you filed,to be returned also.

 

Having said that,people have done secondary claims for less than this,so you would need to put in writing that the additional charges will be claimed at a later date if they are not reconciled to your refunds here.
