      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Turbo Breakdown! Warrenty won't pay out

Hi there,

 

I purchased a warrenty from Centurion for my BMW 320d, brought a 3 year warrenty which wasn't heap but thought its best to be safe then sorry, as i knew it was a common fault with this car the turbo going and thats the reason i took it out in the first place.

After a year down the line i was driving and lost power hardly any pickup took it to the garage which have said the bearing is broken in the turbo, and the turbo needs REPLACING! now i thought the warrenty would cover this upto £1000 and i would pay the difference which i was more then happy doing.

The cost of the turbo is £1000 and then labour so im looking at £1300!

 

I rang up the warrenty company and they are sending an engineer out tomorrow, but when i spoke to the gentleman on the phone he basically said we pay out if its a fault but its a wear and tear item they will not pay out.

I asked him to elaborate what is classed as wear and tear and he goes the bearing is classed as wear and tear which is the fault which the only solution to this is to REPLACE the turbo.

How is this item classed as wear and tear? as its inside the turbo i just dont understand how they are trying to make out its wear and tear.

After speaking to BMW and they said no the turbo is not a wear and tear item it should last lifetime as the engine its not a clutch, its not brakepads, discs which needs replacing after a certain period of time.

 

Now the engineer has not come out yet he will do tomorrow but i know what he will say, sorry mate wear and tear your not covered you need to pay out.

 

Where do i stand with the warrenty company what shall i do?

Can ayone give me some advice?

Call the BMW Emergency Services on 0800 777 111, and ask to speak to one of their mobile technicians, he'll be able to tell you whether it could be down to wear and tear or not (as far as I remember it, it isn't, but don't take my word for it).

 

From his answer, decide what you're going to do next. There is a possibility that the person you spoke to heard the "bearing" part, and zeroed in on that, instead of hearing the "turbo" part.

 

Incidentally, you are quite right, the turbo goes with alarming regularity on BMWs. That, and the Engine Management unit.

Hi

 

I am new to this so here goes.

I have a 318d on a 04 plate that has engine problems, I thought the big end were rattling due to the oil going missing over night so I purchased a new engine and fitted it but the new one is worse than the old one and also smokes badly. I have checked and there is oil coming out of the turbo but when I disconnected the turbo from the inlet manifold and ran the engine it still smoked and rattled:evil:. I am at my witts end.

I am being told that no one recognises a 318d so am strugling to get a quote for a turbo.

Any advise would be great.

my 520i has never let me down

lets move your these threads to where they should be.

 

Turbos fail for a reason....and there could be many reasons.If oil has contaminated the system you could also be looking to replace the cat too.
