  1. Hey dooby doo. I used the one Bong posted on Rouges thread and slightly changed the odd bit as Tanz refers to unathorised etc so I will refer to this when I do my Halifax claim. I have 2 other claims ready to file for court and I was going to do them tonight to get them out of the way but unbelievably my printer has just run out of ink.....that'll be all the work it has been doing lol.
  2. Thanks Chezt, I got the answer, which is completely logical but I didnt even think that way.... Its the CC one cos you make regular payments whereas a bank you dont ...just in case its any use to you in the future!
  3. Hi folks, My friend wants to claim charges back with paragon finance on a personal loan and wants to claim contractual. 1 question.....which spready should be used in this scenario....bank one or credit card one? Thanks
  4. Hi, My friend is dealing with Paragon finance for a loan where they charge £20 & £10 for letters and telephone calls. She wants to claim contractual interest against it but Im not sure which spready would be needed. Does anyone know if it is the bank account spready or the credit card spready she should use? Thanks

I am claiming contractual against Cap 1 and you can phone them to check your purchase interest rate or you can enter your monthly rate from your statement into Mindzai's bank spreadsheet and that will calculate the rate for you (you cant use the spready for your charge figures but it will work out APR from monthly rate) Mine worked out at 22.5%
  9. Yes you can use the normal SAR and change any wording required for credit cards. I just changed banking history to transaction history

  12. Hey Rouge, Ive just seen that Cap 1 have offered full charges and CCI on another thread I was subscribed too and he filed MCOL on 5th Feb. Hopefully your offer will be here in a few days....fingers crossed!

I think it is more one hand doesnt know what the other one is doing....its quite clear that it is numerous staff just sending out letters in UDYs name and I bet the court stuff goes to a different department....going to post mine off to court tomorrow....when I get this sorted I am then going to go back and fight them for charges prior to 6 years.....

  17. Hi again, you are correct with your assumption of without prejudice...it doesnt really matter though as Morgan Stanley dont tend to go as far as court...unless you are called Noo . It wasnt clear that you had sent letter saying with conditions but now you have explained that sounds fine....if they do refuse without conditions, I would type your own, sign it and send it....they will then pay.   18. Lil, They try this with everyone...they wont increase their offer either so you will need to go the whole hog and file at court to get the full charges. Good Luck
  19. Hi Freddy, Yes you send same SAR but I just changed banking history to card history. I would say you should still continue to pay your instalments and then if they offer to credit your account, you choose whether to accept and obviously this would reduce/clear your balance. Yes you can still claim if your acc has been closed. If it is with debt recovery people usually advise you to contact debt recovery and tell them the amount is in dispute. Yes prelim is the same as bank one, you may just slightly need to change the wording here and there to refer to credit card. Interest is up to you, you can claim contractual (if you understand it) or the 8% statutory when you file for court...and it will as I dont know anyone where Cap 1 has paid before court!   20. Letter received today from Adam Lee (Christ, cant 1 person just deal with the claim and follow it through!). The 1st 2 paragraphs were an exact copy of the 1st letter (how lazy!!!) and then it goes on to say, we have already been prepared to reimburse you will a full refund (which they havent as they are offering £25 ones back and not the £12 ones) and will not be willing to refund the interest on these charges so I am entitled to take my case to court (why thank you for letting me know Mr Lee!) Thats it...short and sweet but enough to get my back up. Will now prepare N1!

  22. Quite right Noo. I was lucky, my claim was only small so they coughed up the interest too. If you tried to take them to court THFC after they offered all charges, I wouldnt have thought the judge would take to kindly to that!

  24. THFC, Like Noo I dont understand why you rejected their offer. I had full settlement after LBA and it did have conditions so I sent letter accepting the settlement and I retyped the conditions to what I thought was acceptable, they still paid up. I suggest you send another letter accepting and retype conditions like I did.
