Hi Glenn, I am dealing with a few store cards from GE capital and had letters today for them saying they can only hold data for 5 years etc. The one account only goes from June 01 and I want to get my LBA off (already sent prelim but also asked for remaining statements in that letter) they have said they will credit my acc which I will refuse as Im claiming CCI. Do you know if I can estimate the previous charges (i.e. 1 every month from Jan 01) and put that in my prelim or should I make a complaint first. Just wondered the best way to go about it as I want to crack on with this to get the money back as Im on maternity leave and could do with the money sooner rather than later. Thanks in advance.

Letter received today saying they only have to supply infomration they hold so they have complied with data protection act and that it is not a legal requirement under data protection to hold info fo a period of 6 years and they hold the info for 5 years! they say they have credit the account with the fees but will not credit the interest as they do not charge interest on fees. Compiling LBA saying I do not accept their offer and they must not credit my account (plus I asked for a chq anyway) and although they did not charge interest on fees, the interest they did charge was on a balance higher than it should have been and had the charges not been applied my balance would have been reduced significantly. Revised CCI will also go out with the letter tomorrow as more interest as now accrued!
  3. Nah I wont put it in my POC but thought if I put it in the LBA they might be more inclined to know I will DEFINITELY file a court case and give me my request instead of facing more charges....there again Gorillas might fly!

Just realised I havent started a thread to record the events so here goes: prelim sent on 26.01.07 asking for charges plus CCI Reply received from Martin Reid dated 31.01.07 (quick response but thats about the only good thing) at Fife address saying I agreed to be bound by the fees so no refund. Just compiled LBA (discovered I didnt add all interest payment onto original CCI spready so sending revised schedule of charges) saying that they did not adhere to their terms of the contract i.e. they would conduct themselves lawfully etc. Sending it to Martin Reid tomorrow but have also copied it to Halifax Registered office in Trinity road. Watch this space!
  5. Hi Few, If the 14 days are up (which it sounds like they are) from your Prelim letter, just go ahead and send your "letter before action" to them. You are dictating the timescales...not them! Good luck!

  7. Hi folks, Just a quick question. Im sending my LBA for Halifax credit card today and have done the spreadsheet (correctly now with all interest entries...public thanks to bill...here, have a crate of bananas for your well deserved efforts !) Im claiming at 17.95% but I want to put in my letter that it will attract daily rate of CCI until sorted. How do I work out the daily rate and amount it will be purrrlllllleeeeease?
  8. Hi again, just read my message again to you and I didnt put it very well. I meant send the 34% with your prelim (i made it sound like you only claim at court stage but that wasnt what I meant...thats what I get for rushing tut tut!) you will probably get the good old letter offering you difference between £20 & £12 and then after your LBA you will probably get a letter saying "thats your lot so bug*er off". Stick to your guns and you will get it all back. Good Luck with it.

  10. Willow, you wont be able to get in via Vamps as her chambers are closed at the mo. You should get it through Google as Chezt says. Chezt - Have you recovered from the interest nightmare that we didn't do on our spreadsheets?
  11. Hi Kazz. Not sure about the credit file but I would say stick to your guns with the 34% when you file for court. You can't claim the 8% as well. Have you looked at the spreadsheets that are on here for interest which calculates it all for you?
  12. You just need to put the interest that you were charged after the charge was levied and the spreadsheet will work out how much was in respect of the charge. I am currently in a conversation at the moment that you are supposed to add all the interest for every month after the charge on this spreadsheet until the balance was clear but am waiting for proper outcome of this at present.
  13. If you dont mind Bill cos it doesn't look right to me. I would say that maybe a note that we should put all the interest in the spreadies should maybe go in Vamps chambers cos I reckon a lot of people would have done it like me.
  14. The estimate of previous charges you dont really need to use unless you were estimating previous charges that you dont have on your statements. The interest charged+ is where you enter how much you were charged in interest after you had the charge levied

  17. No you're not thick, it is very confusing. I made the mistake of doing this (x12) and was told it was wrong. Hang on I will check what thread of mine it is and send you a link and then you can have a read of it.
  18. Well I'll be darned! Im sure I did that before and it went haywire but now it seems better although I have put interest in of £57.61 on 09.10.03 and balance was £889.79 and I paid off £25 the following month. Columns K & L now total £20 between them. Is this right cos my penalty of £25 in my 1st column only comes to a fiver and the date was earlier and the balance higher?
  19. I think it will depend how they do your interest. i.e. do they take it off lower % first cos if so you should use the highest one....also....are you claiming compounded contractual as if you are muliplying it by 12 wont give you the compounded contractual rate.
  20. Hi, you wont be able to get them at the mo as Vamps chamber is closed as she is looking at them again. Ive never used no.13 so cant tell you the difference. If you have have all your statements with balances etc then you can use spready 16.
  21. How do we enter the other months on the spready then Bill please as it wont seem to work. I had no idea we should be putting all the interest separately. It would increase a bit if its 5 years worth surely! Crikes.....that means I will have to amend all my spreadies again!!! This is doing my nut in lol (if I dont laugh about it I will cry!)

  23. Hi Peaches' mum, I am in process with Capital one and if you look on your statement, under totals it will give you the monthly % for purchase interest. Mine is 1.708%.
