  1. I have been mulling around looking for all my statements for a while and I just thought why dont I blinking phone them! I just have on the customer service number 08457 20 30 40 and they have been ordered at a charge of £7.50 and it only took me 5 minutes (and that was for 2 accounts). Damn I wish Id phoned earlier and I could have saved myself some work....never mind. The fight starts here Just out of interest, has anyone claimed against Halifax for more than 6 years and has anyone claimed compounded contractual interest with them? If so, just wondered how it was going or if you have been successful?
  2. Hi Rouge, Your explanation makes complete sense to me! I have done the more advanced version of Vamps spreadsheets as I had the balance on my statements so thought this would be the best one to use. Just out of interest, where did you go wrong? (I'm hoping I havent done the same). I couldnt find Cap 1s interest so I just used the interest for purchases on my statement and thought that if they argue the interest thing with me I will say I am actually claiming a lower % than what was charged and then ask them to give me the exact workings out of the interest on my charges. I think its fair to ask them to prove our interest figure is wrong if it was raised! I did read somewhere that some people asked their banks etc to work out the compounded contractual interest....and they did!!
  3. Hi Vamp, Thanks for the post. I did read your guidance notes but I think my brain has turned to mush after reading so many posts as well (that along with having a baby recently has left me with a few lost brain cells ). Im nearly there though I think. I think it is vital that Im 100% sure of the way it all works in case I did have to go to court and I think I was just worried if I had filled the spreadsheet in correctly as to get compounded contractual interest back would really help my situation at the moment and why should the banks make interest on money that is not rightly theirs. I really look forward to any help you could offer me.
  4. Hi rouge, I agree, it is all so confusing when you are new to it all. I read it in a thread but cant remember which one and it wasnt saying you couldnt put the yearly APR but it was saying that by x the monthly % it wouldnt work out compounded contractual properly and that figure should only be used for contractual. I have spent 2 days reading all those threads and I want to make sure that my interpretation is correct in case I end up in court. Lets hope someone will let us know the answer. It seems you are at the same stage as me so would be interesting to follow each other and see what we get back from them and compare. Did you use Vamps spreadsheet?

Hi everyone, I sent a prelim on 03.01.07 and it had the usual blurb at the end that if I did not get a response etc I will pursue for interest etc. I have since been reading the threads for compounded contractual interest and am going to include it in my LBA (when I send it as Im sure I will have to). Has anyone previously done this as I wondered what figure was put in the interest cell in Vamps advanced spreadsheet? My monthly interest was approx 1.708 which works out at 20.50%APR but Im sure I read somewhere that I shouldnt put that figure in for compounded contractual (read so many threads on interest my brain is going to explode!). Can anyone advise on this please? Also, out of interest I wondered if anyone had been successful in a claim with Capital One that has charges over more than the 6 years? Thanks in advance.
  6. 2 statements received but still one missing but am able to see that a charge was levied on the missing statement by calculations so prelim written and being posted tomorrow. Am being brave and claiming for compounded contractual interest too seeing as they have had the money since 2001. Have used Vamps fab advanced spreadsheet (crikes, I hope I have done it right!)
  7. Hi Simp, Does it not say on the statements how much the interest is? I am preparing my Halifax Visa and where it tells you the interest that has been charged, it also tells you the daily interest and then in brackets the annual interest.

HI, I spent the evening last night reading this thread as I am about to start claiming for mine and boyfriends charges. I want to add the interest as I think it is fair for them to pay this back but I just want to run my interpretation of this all by someone if this is ok as I am very new to all this. My understanding of Compound Interest is the interest I paid to them on the charges they levied on me. My understanding of Contractual Interest is the interest I will charge the bank for having my money when they shouldnt have. I could be completely wrong so could someone confirm if I have understood this properly please? Also, I have quickly filled in Vamps advanced spreadsheet for a store card and just wanted to clarify the entries in a few columns: The Interest charged column.....is this the interest I was charged in the same month as the charge was levied? The statement balance column...Is this the closing balance of the month the charge was levied? Finally, I presume the spreadsheet works the interest out from the date I enter until date I claim automatically or should I be entering the balance and interest of every months statement on the spreadsheet even if there was no charge? Would be really grateful for someones help as soon as poss as I want to understand all this before I send the letters in case it does go to court and I want to get letters sent out asap as I am on maternity leave and if I got some money back it would mean I could have 6 months off instead of 3. Sent Prelim to Morgan Stanley on 13.12.06 and received a reply on 21st December 06 saying we are currently investigating the matter and will reply in due course and attached a schedule of how their complaint service works. Have now prepared LBA and filled in Vamps advanced spreadsheet for interest (just waiting for some answers on another thread to check I have done this correct) and will then send LBA.
  11. 1st claim started against Creation for boyfriend so S.A.R - (Subject Access Request) sent on 13th Dec. Received statements on 3rd Jan 07 but only from April 01 and card was started way before then. Boyfriend phoned asking where Jan 01 to March 01 was and he was told they couldnt find February so will send out Jan & Mar 01....hopefully I can work out the balances between the 2 to see if there was a charge levied. Watch this space as they should have arrived Friday!
  12. Hi Maan, I am in the process of dealing with my boyfriends charges for a JJB card with Creation and I sent a SAR. Luckily I had the account number but they don't seem to be too good with their info as they only sent me statements from April 01 to date and some were manual typed ones and others were copy statements. My other half rang them asking where Jan to March 01 was and was told they couldnt locate Feb 01. Although really they should have sent statements for the whole period he had the card (which was well before Jan 01) but Im not trying to claim more than 6 years so I wont raise that. His statements had previous addresses on which he hadnt lived at in a long time so are you sure you didnt set it up at a different address? if you are then I think they may be trying to cover up the fact that they havent got your statements. Good luck with it but be prepared for them to omit some statements when you do finally get them.

  14. Hi all, Hoping someone can help me. My fiance had a LLoyds account that got in a right state due to all their charges (I have sent a SAR for this account), the account then got passed to BLS collections and he had to pay a little under £3,000 to completely clear the debt. This obviously included BLS charges. My question is.... If the charges by the bank were unlawful and they then referred the account to debt collectors, who in turn added their costs, is there any way to try and get the debt collector costs back? Hi everyone, I am still relatively new to this site but have done all my reading etc...I don't seem to have found an answer to the following question and would be grateful if anyone had any ideas... I know the time limit to go back is 6 years but when you request a SAR and you give them 40 days to respond, what is the 1st date you can go back to classed as? I.E - Sent a SAR on 13.12.06 and they responded last week with info but have missed 3 months (Jan - Mar 01) and I phoned them but they are dragging their heals saying the remaining statements were sent 1st class last week. Is the 6 yr date from the date I sent the SAR or is it from the date I send the preliminary letter? I may lose out on charges if it is the latter as I have charges on the 13.12.01 Thanks in advance

Hi folks, I have the majority of my Halifax statements from the last 6 years (I knew being a hoarder would come in useful one day! ), but I do have a few missing and dont really want to have to send a SAR giving 40 days when I only need about 12 missing ones (need to try and get money back asap as I am on maternity leave and if they pay up it means I can have a bit longer off). Has anybody been in this position and phoned requesting the statement numbers or does anyone know if you can retrive previous ones online? Any advice gratefully received
  17. Thanks for your really prompt replies. Is the 14 day time limit working days or 14 days in total irrelevant of weekends etc? Its my 1st one so I want to make sure I get it right before I do the big banks!
  18. Hi folks, I had a really good read through your site when I joined a few weeks ago and sent off a prelim letter to Morgan Stanley giving the 14 days time limit. I have received a letter back from them saying it is being investigated and they will contact me in due course. Should I wait for this contact from them or send 2nd letter as their 14 day time limit was up 2 days ago? Apologies if this question has been asked before, I have searched for a thread but to no avail. Appreciate someones advice.
  19. Hi all. I have just joined this site today and had a good read of everything (so much to take in but so helpful!) I have just done a SAR to send to Lloyds but the addresses are confusing in some of the forums! I took the following address from the "Data Protection Register - Entry Details" 25 Gresham Street London EC2V 7HN Can anyone confirm if this is the correct one please as I dont want to send it to the wrong address and end up wasting time while it gets redirected? Many thanks

  21. Hi everyone, I have had a good read through this site and have now decided to give it a go as like the rest of you I have had hundreds (may go into 4 figures) of charges. Shamefully over the last 6 yrs I can try and claim from the following: Halifax - Horrendous bank charges Morgan Stanley Ge Capital Bank Capital One Luckily, I try to keep on top of my payments now but why should they have our hard earned cash for silly oversights we made in the past, especially when it doesnt cover their costs!
