  1. heavenly1, with my very limited knowledge (mostly gleaned from this site), did the orginal company place the default? or have you defaulted with Westcot? The cca request you sent was to ascertain if westcot had the agreement you signed with the orginal creditors, did westcot communicate with you if they had any such agreement? If westcot did not default you, than what they have put in their defence is true. Is the 7 days date of service still valued, or has that run out? Trying to get the right picture, and am hoping someone will help put you on the right track. I'm going to have more of a read about the CCa's;) All the best and don't give up yet;)

  4. hi Katieandscott, dont be concerned that you have not heard, they are snowed under;) . And we are all here to help one and other:D Who knows what the time scale is with Lloyds TSB, its just a matter of following the procedure, with the correct time scales, and you will get there:) I started in feb, my court date is in July, so just doing the waiting game and reading as much as I can on the way:p This should help Guide To Reclaiming Bank Charges **##~~~~**##~~~~ Read This First !! MIMP, going back to my post, do's he have internet banking? as you can bring up the statements, if not only takes a few days to set up, then you do not have to worry about not being sent correct information:rolleyes: . Beats waiting another 40 days;) the branch may suggest that if you want lost statements etc, it will cost you per sheet But as you have done MIMP, you paid your £10 with your DP letter which covers all.

Hi Craigwalton, Thanks for responding, I claimed for both, as the electrcian felt if the crack was the entry point and was not repaired, it could create the problem again, NO accidental damage cover:( YES to rendering. Lady did say(on the phone) if the rain had got under tiles or such and that was entry point I would be covered, my point is no one knows where the water has come from. I have had nothing in writing, until I got in touch with FOSwho said insurers should get in touch for details of the complaint (this was to do with increased premiums due to making a claim, which at that point I had'nt) and the letter said "contractors confirm electrics affected by water entering through crack in wall. Final letter" I am composing a letter to them about why the increased premiums, total lack of communication from themselves, and me having to chase for months (could the non notification of denied claim be to do with the increased premiums ie: this has now been 6 months of increases payments they have received? Me thinks I will request that they look into the electrics, mind the quote is £365 excess is £100 and the premium will go up (what again:rolleyes: ). Craigwalton, thank you for making me mull this over, hopefully I can now get on with this letter to them:D

    Hi Zimmie, have a read of this link, it tells you about the interest charges, and when and what to claim Guide To Reclaiming Bank Charges **##~~~~**##~~~~ Read This First !! I was exempt from fees, that is what you mean isn't it? and left that field empty, court filled it in fee exempt, and so the total on N1 was the same as the amount claimed. Has B in L got internet banking, as you can see your statements going back the 6 years, if not it only takes a few days to get on line banking, go into your branch, and they can start the ball rolling there. This is such good news, are the Banks now being forced to stop their threatening and stalling tactics which have no doubt put a lot of people off claiming back those unlawful charges:) What go's round come's round:cool: A spokesman for Lloyds TSB says: 'We are surprised by this judgment as we firmly believe we have the right to lodge a defence in any legal action brought against us.' ahh my heart bleeds:rolleyes:

Hi Aironaught, Have you done 3 copies of every thing to take to court? court stamps/seals all 3 copies, keeps one sends one to the address of bank you have inserted on N1 bottom left corner, and returns one to you. Suggest you juggle:p then you know its started, and no LOST in post:rolleyes: also you can double check any questions you have about the process, (Kazzie excluded! she knew more than the clerk:eek: ) Happy claiming:D

  15. Hi Indebtstudent, First, it was transferring accounts inhouse,I wanted a clear account just for DD's so if anything was left, thats what I had to live on. I thought it would be simple:rolleyes:. My first question to NW,(before I knew that all DD's had failed) was, why did they close the initial account down to DD's when they suggest you have enough money in your previous Bank account to cover time transfer. (this all happened on the same day) the response was just to reiterate what they had done. The reason I'm in this fiasco is because NW are saying they sent an automated message (electronic message) to all companies, I have been in touch with each company last week, none of which received anything from NW on the day in question and have asked for confirmation of this in writing. I did put on my complaint form to FOS that I could get confirmation from the companies, but thinking about the response from the FOS as shoestring intimates the FOS have allowed themselves to be persuaded by NW that they acted accordingly,and as such my information is not needed. excuse me I would'nt be here if they had:mad: . Is £50 enough:rolleyes: when they charge £30 for what! Thinking about your suggestion to write attention of CEO as something has (or not) happened ehmmmm! further prob I think arising from this is a thread I have started re Amber credit, money going in same day as dd coming out, NW say cancel it, so no charges, I cancel, Amber now saying I have defaulted pay £20 admin, I think because of the dd' appearing to be totally mucked up, and so it go's on:(
  16. shoestring, I sent email to FOS re copy of NW ADDACS and have had a response this morning that he is waiting to hear from NW re increased offer, and whether they are happy to release ADDACS file (not that I'm going to know what it means:D BUT hope an IT DD expert is wandering the site) to me or I go down the £10 statu route. Have read through correspondance with NW and am getting fired up as like you say its all fluffy and not answering my questions:mad: . GuidoT, as my court date isn't till the 25th july (ages:mad: ), LTSB have put me on the back boiler, is there anyway I can remind them I'm still here, or would it be worth trying to transfer to a larger court (or would this just take a couple of months anyway)? Any thoughts or gentle reminder letters??

My electrics kept tripping out (October), electrician, narrowed it down to one circuit (sockets) on ground floor living/dining room,(no sockets on said wall upstairs) reason unknown but there was signs of corrosion in 2 sockets ( there is a crack in the external wall) and the electrician agreed it could be rain, seeping through, and put this on his quote. Got a quote from a builder re the crack in the wall, and he said that water could come from anywhere, not neccassarily there. Quotes sent in and claim naturally rejected as non upkeep of maintenance (february) after constant calls etc to see how claim was progressing. I requested a loss adjuster as I felt they could not rely on the electricians belief that the water was coming through the crack, and was told they did not send out LA's, and the descion would stand, but if I could get proof, they might look into it. How can I do that if the builder says without pulling the house apart its not always apparent? Also 4 years ago, I had a leak in a pipe that serves the water tank in the loft, directly above said wall, only noticed when water dripping from bedroom central light. plumber in and paid for no claim made. could this be the problem? I don't know:mad: I have extension leads all over the place Xmas was fun:rolleyes: (was also told that I should get that sorted if I felt it was a problem, thats what I thought I was doing via the insurance). Any thoughts anyone? I am trying to compose a letter of complaint as I haver never had it in writing that it had been declined, it was only through my calling them that I found out, do I need to get a builder in again to say IMHO you can not know where the water damage originated? Have I got a leg to stand on? I am not a serial claimer, 2 claims in my life time, one water tank flooded the whole house, 2nd some plonker drove his van up the path and took off the awning over my front door (lloyds tsb paid up no problem). I'm so fed up with this:(
  23. Kazzie, you are going to know this system inside out, perhaps a job as a court clerk, so you can help us all, and keep the paper work that the court needs, so as not to create more work and worry for the individual:p bit worried about your box of frogs, will you release them once you've won:D
