  1. I too got a letter from the Commons which also led to the wife calling - Attached was the following transcript. I think it's a quite unfortunate place to end the document - I know AG is a LibDem but it's a bit harsh saying the Governement is keen to encourage low-income - hang on, no it isn't.

  4. You're on the right track - I've read somewhere else that the softly softly approach to lost account numbers works well...go in to the branch with I.D. (particularly if you have moved house since) and the branch staff can be quite helpful in finding things out for you. You don't need to tell them you want the info so you can sue them

Wasn't much of an offer considering the claim, but if anything goes wrong you can be assured my dear (and I mean that as 'expensive' and not an affectionate term) wife will remind me, oh about every hour, that we were offered.....   12. As I understand it, it doesn't matter if you sign to say you wan't claim again as the document wouldn't be worth the paper it was typed on.... You cannot be made to sign away your legal rights. Please put me right if you know better.
  13. No it doesn't. Stops DCA's, but the bank applies charges for each NEW breach of contract. Read about this in some other thread I can't find, sorry.

  15. 1. Dont Know sorry, but I think I read somewhere that this has been done (except maybe you should have the correspondance go to your friend for forwarding...dunno). If your 2 claims are for the same account then there is no reason why they should'nt be combined, as far as I am awars. 2. No Idea whatsoever sorry 3. If you claim with paper N1 and are in receipt of certain benefits you can get remission on fees and not pay a penny....but if you are using MCOL you can't, then there is a space for you to include court costs in your claim.
  16. Royalties charge appears monthly on or around the same date (11th in my case) and I believe it was £8, then £10, now £12. It might be mixed with overlimit penalty which can be claimed which is why you have to be careful. On your statement it will appear as 'CHG TO XXXXXXX' (acc no.) and if its more than the figures above then you are being hit for overlimit. Take the royalties fee off the CHG and claim that back.   18. To give you a little fore-knowledge of what is likely to occurr why don't you go to the courts in next couple of days and enquire if there are any county court hearings running. If you make the request and Judge and both parties agree, you will be allowed to sit in on a hearing. Don't take any notes and dress smartly. It will give you some insight into procedure even if it doens't directly relate to your case... Sorry I can't be much more help than that, but I'm a few weeks from court and haven't prepared yet.   22. Yes I knew about additional costs (my AQ will be £100) and I know there is possibility of exposure to costs, but as you say this is unlikely because I shall be propriety defined But I felt the benefits of standard disclosure made it worth the risk....

Now you have sent S A R and raised the possibility of penalty charges dispute, I believe you can phone the DCA and tell them the account is now in dispute and that they should stop calling and writing to the lady as you believe the bank is at fault and you will be dealing with the bank about it. If they continue calling or are particularly threatening over the phone there is a letter you can send that might help http://www.consumeractiongroup.co.uk/forum/bank-templates-library/37006-harassment-telephone-response-letter.html although it will need adjusting.. Otherwise the process for reclaiming the charges is unaffected by the fact that its you doing it for her, you simply have to sign the MCOL/N1 as 'friend of litigant' or something similar...   24. There is a registered address in London for Litigation but I can't find it in posts, however I just put my branch address. As a local outlet for the bank this will also help ensure your case stays in local courts.
