  2. I didn't specify the business account and identified the current account by number and told them the date I wanted statements from and to...this was back in September. So if I send another letter widening the terms of the original request, that might do it? Cheers
  3. The penalty charge issue with banks and so forth is founded on common and contract law,consumer regulations and consumer credit law. Would any of these apply to higher education? Do you have a contract? If you do and if the penalty clause wasn't there when you signed that contract - could this be used against them?
  4. You got an hour? We got moved to them after doorstep salesman pestered us into it...plus we had family on it so we figured we could use the free calls. About 3 months in we decided to move the DD to a different account but they failed to set it up....about 3 months went by with no payments then suddenly we were restricted to incoming calls. It took about a week to get them the outstanding balance but a full week later we were still on incoming calls only. I phoned them to ask what the hell was going on and was assured that it would be sorted immediately, and to give them some credit, it was. However about 2hrs later the phone went off completely...if you dialled ANY number at all (even operator) a scottish voice said 'you are not subscribed to this service' and cut me off. I then started emailing and phoning...i used about £30 of call time in queues and sent at least 6 emails (all of which were auto-replied so I know they got them) over 7 days before giving up and getting reconnected to BT. To this day I haven't had a response to those emails......

  6. Intimidatory I would say...Threats to 'send someone round'?   9. Just got off the phone from the courts. Nothing received there either although they have until 4pm to submit (which the clerk told me was highly unlikely because they only get one delivery a day.) I have been told to submit for Judgement in Default of Acknowledgement and should they receive something in the meanwhile the court will send my judgement back.... More delaying tactics methinks? Off to the post office for a special delivery voucher!
  10. My brother has approached me to help him recover bank charges applied by his bank in N.Ireland. Does anyone have experience with the process over there? Thanks Phil
  11. I had submitted a data request to my bank specifically for the purposes of obtaining statements for the last 6 years, as per the template and these were duly sent. Now I would like access to all other data relating to the account I am currently pursuing going back to 1989 if possible when the account was opened. I also had a business account with the same branch for several years and I would like all those statements too. My question is, do I need to raise another S A R or should the first one be referenced to cover it? (i'd rather not have to pay again.) Thanks Phil

  15. Straight to court with you, I'd say. You would have been within your rights to start action on 18th December, so they have had plenty of good-will time.

  17. That's the way I read that also. So if they come in the night and slide £10 notes under your door they can just apply for a judgement because you've received a 'refund'? (Your footprint on this peice of paper signifies your acceptance.)

  20. Watching with added interest now as the first bit of my claim is outside limitation too, schoolboy error, but I left it ride to see what would happen, hoping to fall back on some aspect of sec32.
  21. I'll give the courts a ring tomorrow afternoon....give them plenty of time to get the post in. The wife is starting to get me nervous. Asking questions about 'What if it goes to court.' and 'When do we need a solicitor.' When I told her there was no solicitor and that I would go (I've got a suit!)and what did she think I'd been doing here for the last 7 months, she gave me a great boost of confidence. 'YOU!?!' she said, and took up smoking again. Now I'm not sure if that means she thinks we aren't going to be poor any more or what.
