lol its no help to me as they have already had my money - they just wont tell RBs i have paid up so RBS wont update my default to settled! this is there website: 1st Credit i just want them to tell RBS - if they wont i want my money back so i can pay RBS directly!

OK guys this is getting to me now...i just cant get any responce out of first credit - i refuse to call them i have checked their address and recorded letters are arriving - RBS refuse to do anything untill i have written proof off first credit that this has been delth with - any ideas? i wnat this defualt removing as no contract etc with RBS any more but cant go down this route without having it settled as too much hassel!

agree with the above - but you can usually sell it to someone if they pay the finance company what you agree for it - say there is 4K owing and car is worth 2K you can ask the finance co if you can sell it so long as funds go to them - you advertise it for 2K and sell it getting the buyer to pay the finance co directly and then you owe the reminder for soemthing you no longer have...i know of freinds who have done this but to me its worse to be paying for it and not having it! -
no need to it will be a standard fob off letter - send them a LBA then when they still refuse start court proceedure etc - tho this will cost you and if your skint you should think about saving for this...also sending DSAR would be a good idea as you argue in court on the grounds that there has been no manual intervention etc to warrent the charges as computer generated etc...just a thought...thought you could try writing to get a responce to this particular question.

Hello, i work for a huge Architectural Practise as a trainee architect (Part 1) i used to work in the shrewsbury office in shropshire but last year in order to attend university one day a week i transfered to the London office - and got a 110% pay rise - tho living costs are 300% higher than living home for free lol. anyhow - i did 43 hours overtime in June and was told i could have 3 days in leiu - i refused these saying i wanted either paying overtime or the full 43 hours in lieu - nothing happened for some time then last month as this was still outstanding one of the partners said look these projects were small and took up lots of time so we made no profit on them and so thats why we couldnt afford to pay you the over time...however the client was so happy that we have won some bigger 20million + contracts so we'll give you the overtime for the 43 hours you worked as you did all the drawings etc and they loved them! Great - except this month when they paid it it was a standard rate - now the staff handbook says: 4.4 Overtime The company recognises that additional hours may be required in certain circumstances. Where these hours are significant, additional time off in lieu may be granted. You should agree any additional hours and associated time off with your Manager in advance. Where time off in lieu is impractical, and overtime is authorised in advance by your Manager, payment for additional hours worked will be made at the rate of one and a half times your basic rate. Overtime rates will apply for additional time worked in excess of normal working hours. No payment is made for travelling time I called up our headoffice and asked them about it saying that in the past at other office i have been paid 1.5 times standard rate as per the staff handbook and my contract. he said evryones contract is the same but the London office only pay standard time for extra hours and someone should have told me - thing is i see it as irrelevant that someone should have told me as its in Black and White - thats like saying we're halfing your agreed salary this month cause we feel like it but your contrcat stays the same. what can i do about this without falling out with anyone over it - i want to ask for payrise etc soon and dont wnat this to mess with that however i'm £300 down now and dont think its fair, when i pay all my uni fees etc and get no help from them - in the shrewsbury office this is all paid for including incentives to do well like £1500 for every subject you pass with a first etc and they buy books - the London office seems to have different rules and i dont know why! Ok no responce from Customer Service - still no statements and no letter to say y - i guess i'll have to post them the non compliance LBA template via recorded delivery! wonder if they will respond! -
this would be fraudulant so i suggest you dont do this - i would however try stanting that your 12months were up and as far as you knew there was no 3 month period - you should check if it was a 12month contract tho as most are life time agreements that you are allowe dto cancel after 12months

read my capquest thread by clicking the link in my signature - i thnk they sent me a fraudulen document - i have sent it special delivery to Halifax Fraud Department - i sugget you do the same with your bank to see if its a fake! they cant take you to court without the documenst so dont worry on that level - they have added a default to my file - check yours as they are not allowed to when a debt is in dispute! -

that may be classed as an unfair contract - you should be entitled to a refund for something if you havent received it! -
i have this with HSBC for a loan - i pay it every month standing order and it arrives 1-2 days later than the payment dat - shows as one month behind every month when really its one day! still i set up the standing order without factoring in the elay between accounts so its my own fault!

yeah they seem to like 3 years + though the fact taht you only have one previous address in that time shoudl be ok good Luck

you can (i think) get searches removed but you really dont have many to worry about - i have lots on mine and they dont afect my credit ability - the 22K i owe does lol. Black Horse gave me a car at 19%apr - tho its a loan for it not HP (see my link for issues with them!) i have 4 defualts all unsettled and its not affected my ability to get a car...worth a try so long as you dont get any of the 'extras' from the dealership and no ppi etc etc

well you can dispute it with them straight away as you know what son there - i recommend getting all your reports so you know whats what then taking it from there -

get in touch with the credit refernce agencies and get them to queiry it - if they come back with an unsatisfactory answer write direct to the company who placed it in there using the CCA default notice request template +£1 fee - if they fail to satisfy this you can take court action to have them removed. J -

LBA i guess - then court if no responce...depends how much it was and if its worth fighting for £10 maybe not worth the hassle even thought the principle is there - however if its considerable then go for it. -

I think everyones right as there is also 90K outstanding and you no longer have a house to protect you may as well wipe the slate...it shoudl be a huge weight off yourmind and its not the end of the world (thought it probably seems it!) I also note that someone has sabotaged the www.grumbletext.com there are some pathetic peopel there and that website was great - i hope that you will continue to use this site as the whole data base has been wiped including our posts re: CapQuest! good luck and come post your thought soon! they will agree to hold the account but they keep chasing it every day on the phone and solicitors letters that they never follow up! dont worry stand your ground

is the original loan company halifax? and did it defo come from the original lender? my 'deed of asignment' looks dodgey and i've sent it to the fruad investigation team following someone else doing so and Halifax proving that it was a fake! -

...i was on the phone to Voda as i typed - they told me as i have registered online i can view itemised stuff there - they just post a summary to inform me of how much i owe - have cheacked and sure enough its online - try there under my vodafone! -

vodafone have stopped itemising them - ironically my bills have been £30 a month more since! I think everyone is right you cant ask them to write off the bill if they didnt know the phone was stolen, maybe write to them and explain the situation and see if they can compromise...do you have insurance - as you reported it to the police you may be covered with that
