  1. OK - i have posted the letters to Black horse and at last some acknowledgment! I have had a letter saying they have received my complaint and are looking into it – they will have an answer by November 14th 2006 – mmm well it had better be the correct answer else I wont be amused! – but at least they have now acknowledged it! (hand signed too so a real live person is looking at it J ) I have yet to send the Carland letters as i would like to deal woth one company at a time and think a phrase blood and stone will come to mind when using CarLands complaint team!.
  2. its with egg and if you owe it you shoul dpay it imo, but the chances of you getting CQ to pay up are slim - Trading Standards are looking into my case for me
  3. Sorry to Hijack but I'd be interested on how to get them to remove it as Black Horse have done this to me and they wont reply to my letters asking them to remove it from teh HP register - any help would be great!
  4. yeah get it checked as they didnt default me untill i put the aledged debt into official dispute - now i have a default!

Paul - this is my thoughts entirly - i have about £400 charges - and the reason they *made* me take the managed loan was due to being £400 over my limit - they combined my up-to-date overdraft that was interest free and my credit card which i had never missed a payment on and was within its limit - i just dont see the logic - now i'm paying back 3k on what would have cost me £1500! i will be fighting this but due to current comitmenst it will be in teh new year i think!
  6. i sent it to a cardiff address - i called and asked where to send it and they said the general cardiff address. i sent all stuff recorded and they are getting signed for the other end - just hear no response - i will be issuing a full SAR and copying my complaints to trading standards as soon as i have a spare £10 for them!
  7. I'd be inclined to say they still havent provided what you require - as for forwarding your £10 etc to Halifax via them - rubbish - tell them you have done this to Halifax direct and they have yet to aknowledge it...

Well just spoken to TS - they are looking in to it, they will contact CapQuest today and are challanging the figures, the proof and the defualt which he is confident they will remove as they haven't provided any proof! he said Halifax are as much to blame for not selling the debt with the correct docs etc. i have to chase up Halifax Fraud dept next week RE deed of assignment and also regarding failed DSAR info. will keep you posted in due course!
  9. mmm - defo take furthe raction if it was mis-sold...i have same issue but they wont even cancel mine - well i say they wont, they refuse to respond to my letters so i dont see how it will be canceled! good luck with this - i will be watching intently!

Hi - my original complaint was copied into the OFT and i have sent the 'deed of assignment' to halifax fraud dept, so they can tell me if its genuine...i have also sent DSAR to Halifax for all accounts held - they responded with info on a credit card account that they have stoped chasing for and they cant provide info on any other accounts with them - i'm still persuing this to get a responce in writing - i'm busy this week but will chase it up next monday - i dont think they wil find it in which case CapQuest are chasing something that doesnt exist! I'll let you know how i get on with trading standards later
  11. sorry i was under the impression that as you were idscharged it wouldnt pose an issue - i guess you can still claim them - its just they may (and if you owe it should) go towards your debt
  12. as far as i kow so long as your discharged you should be fine...after all the charges are unlawful regardless of bankrupcy etc
  13. i would write and accept the offer (should you not want the hassel of persuing the other 880 - however 880 is quite a sum and i'd be tempted to chase it all - after all it is yours!) put in your letter that you require the funds to be paid in cheque madee out to you and under no circumstances do you wish to have it paid into your HSBC account - they should honor this and then you can still go for a DMP and do what you wish with the money
  14. eaxctly the same - i offered to pay them back £50 per month for an unautherised overdraft that they had let go over and added changers to - they hadn't asked for it back and i mad ethe decision to ask to pay it back - then my cards stoped working and i got a letter saying my unautherised overdraft had been turned into a managed loan along with my master card and my student over draft (interest free) both of which were within there limits and always paid on time - to me now having to pay 18%+ interest on the £1000 interest free student over draft and the 15% master card has put me in a worse situation so in my opintion is irresponsible lending - they could see iwas in triouble - they accepted my offer and they made my situation worse - i have had this £1800 loan for 15montsh now and have paid off £400 - but they have been getting £50 per month so thats £750 nearly double what they have knoced off. when they sent me the letter accepting my offer they enclosed the managed loan forms saying that either i pay in full or sign on the line - if i paid in full i would get my faciulities revoked regardless...even tho 2 out of the 3 were completely seperate and i hadnt abused them did i mention i hate HSBC!
  15. Well had a hand written 'compliment slip' today from tradings standards asking me to contact them to discuss this - i will do this at lunch time on Monday. anyone know what questions i shoudl expect?
  16. UPDATE: had letter back from trading standards: I am writing to confirm receipt of your recent letter to this office. I am sorry to read of your experience with the above trader. I will send details of your complaint to our fair trading team for their information. If they require further information they will contact you directly. shoudl you require civil advise etc etc contact local office in islington etc etc yours Laura Horrocks Advisory Officer. do you think their in house fair trading team will do anything?

UPDATE: well i sent a huge letter of complaint to trading standards and copied Capquest in on it to let them know i meant business... ...no word from TS but CapQuest responded with: Thank you for your recent correspondence. I can confirm that both of your accounts are now on hold, while we investigate into your complaint via our in-house complaints procedure. As soon as we have the results of our findings, we will contact you again. Yours sincerlely HAND SIGNED (but unreadable) Complaints Controller. Well i have to say its nice to have a person respond not a machine but i doubt they will do anything about it!

  19. thing is RBS are not in the wrong as far as they are concerned - they dont know i've paid it thats why they want 1st credit to contact them - and they wont!
  20. 1st credit havent put anything on my file - its RBS - they wont remove it unless 1st credit send them proof it was paid
  21. well as it wasnt a DSAR i better not say it was - however that doent mean they shoudl ignor me!! i do have it on my bank statement that the payment was made and it says it was 1st credit that took it - i also have the letter they sent me knocking about somewhere that requested i contact them to take advantage of a reduction in total payable. i like the idea of threatening them with fraud as i guess if they wont sort it out then its sort of is! i'll contact RBS this week just to confirm that its not been recoreded then i will send 1st credit an LBA and see what happens. cheers guys
  22. i cant get 1st credit to reply to me for anything! i think you should send a LBA to them as they dont seem to respond to any requests!

  24. i've got the same issue as everyone else but now i've had a letter telling me i'm in arears and dispite previous attempts to contact me i've ignored them!! now i've not missed a payment and they have never tried to contact me! i called them up and no one was able to take my call! they have put a one month in arrears on my credit file from day one althought i've never missed or paid late! (tho some times when a weekend falls it takes an extra day untill the payment clears but thats not my fault!) i hate HSBC!
