I have looked at the information needed however I am based in Scotland. Does the CPR request apply? If so what is it? I have already posted off a CCA request over three weeks ago and have had no reply back as yet (sent it off registered delivery). Court case is at the end of October.

I have the exact same agreement from Aqua signed in the middle of 2006 and I have just been issued with a court order. The account was almost at the stage of being statute barred but received the court order out of the blue via Cabot. I know there have been some court cases recently and things have somewhat changed with what is enforceable and what isn't. Any advice?

No, Advantage Home Lending (ADV2) - Part of the Morgan Stanley Group. ADV2 went bust in 2009.

I am still looking to hear from people who are in the same situation as myself. Any news/stories would be gratefully received. Btw I did try to pm back but was blocked...... FOS made a final decision that they could not help as the loan is unregulated.

Experian remove defaults from your file exactly 6 years after the date of default, whether the account is satisfied or not. The term 'Status Barred' refers to the timeline lenders have to chase you for the debt, which is six years in England and Wales and five in Scotland.- 16 replies

Is there a way to avoid early repayment charge?

I would suggest calling the bank and asking the question directly to them. You could also try checking the terms and conditions of your loan. It sounds like you are coming to the end of your loan anyway so I doubt there would be a charge and you could possibly get a tiny bit of interest refunded too for paying the loan off early. -

Hi all has anyone had an unregulated secured loan with this lot? Has it been sold onto a DCA (namely Arrow). I would really appreciate your input as to what interest rate you have been charged and are being charged. My interest rate has not changed at all since 2009, despite it being linked to LIBOR (as per T & C's). My case is with FOS however they have not acted on it at all as they are waiting to hear what the outcome of the libor investigations are . I would really welcome any advice too ......
