Well don't tell them unless you need to defend in court. Has the agreement been terminated on the back f this, if so they are stuffed. Finally have you been sent the correct notice of assignment for 1st credit? -

Do you have the DN? If not it might be worth doing a SAR to Halifax. If that is faulty that is another bar to them taking action. Try not to stress -

Thanks. Just to confuse the issue, what if there is a debt that was defaulted more than 6 years ago but I am still paying. Is it not a good idea to cca them as well to see if it is enforceable?

I know that feeling, they even use two different numbers, one in Nottingham and one from wherever. Luckily I have a smart phone so downloaded an app which stops the calls, txts are just filed away and the phone just picks up and drops the call, Even better I have an accurate log of how many times they try to contact me -
Thank you CitizenB. Knowing that they can not enforce would make the trouble of them writing to me bearable until such a time that either the debts become statute barred or I am in a position to repay. I am a case of can't pay as opposed to won't pay

How do I do this as Wonga took £100 from my account after I had told both them and Santander not to. I didn't notice for a while as I had changed banks. If I start a court claim will it cost me much and what are the chances of winning, i.e is there any case law? -
I am only talking about pre April 2007 agreements and I thought that S127(3) effectively barred enforcement if no agreement was in place and Waksman said that for enforcement the original should be available. I fully understand that post April 2007 agreements are completely different. Have I got that right? Then of course we go down the route of defaults/terminations/notice of assignments all of which can render an agreement UE

Thanks Brigadier I thought the whole point of a CCA request was exactly that, to see if they have an agreement. If they don't they can not enforce What difference will looking at my credit file make. As for details, all the debts are current i.e they have had a payment in the last year but I am not quite ready to post in public the full extent of my stupidity

Yes I understand that but after 6 years it will become statute barred. However I am interested in what the other methods Dx mentioned are. The debts are a mixture of loans and credit cards

Thanks. I have no intention of paying anyone or using a service such as the Rankines (I know they are gone) . I will look at what of my older debts are unenforceable, not because I want to dodge but because I have no money income or assets

There are just so many of them from big to small that if I pay them all £1 per month I would not have enough to live on. Thank you. I am going to have a look and see what are enforceable and what are not and see where I go from here. Some of them are quite old, early 2000's or before

Hi all I am very confused. I have been reading this forum for a very long time until I finally signed up. In the past when people have talked about sending a CCA request and that the result was unenforceable they have been told that this site does not condone debt avoidance, Fair enough, neither do I, if you owe a debt you owe it. More recently I have seen some more posts where members of long standing have been talking about debts being unenforceable or do not comply with the CCA. So does sending CCA request work and can you get out of paying a debt if the creditor doesn't comply. Really confused about the ethics of it all Thanks

Hi I am not sure if this is the right place to be posting or even the right forum. I have some huge debts and no way of repaying them, several people have suggested bankruptcy to me but I am loathed to go down that route. I sent all my creditors a cca request about 3 months ago. A couple have sent back letters saying they do not have them and will not chase me until they find one, two or three have sent what look like real agreements back and a couple have sent blatant recons back.Now I know the recons are ok so far as a cca request is concerned but don't they need the original to take me to court? There are some that have issued odd default notices and Natwest even terminated the account prior to the date on the default notice. Anyway my question is...do I SAR them now to get all the paperwork the have which will I assume include default notices, termination notices etc, or do I wait until they issue papers and then put in a defence and use CPR? I am not trying to avoid my debts and would only ever defend any action, I have good reasons why I can not afford to pay them and for how/why I got into the mess I am in To SAR them all would cost me over £300 so it would be on a one a month , maybe one a fortnight basis as to who is causing me most trouble

Help Like some sort of idiot I applied for 5 payday loans while only getting ESA. I can not remember what I put for occupation but I think it was either ESA with the job centre number or self employed. Now they are all chasing me, I have sent them a letter saying that I have mental incapacity(that is why I am on ESA) and that I can not pay. I have suggested they write it off or take me to court. Well I am still being hassled so I sent each one an email saying until they addressed the points in my original letter I would not reply. It hasn't worked what should I do?
